DECLARATION IN SUPPORT OF PROOF OF SERVICE NOTICE OF MOTION FOR LEAVE TO AMEND COMPLAINT AND NOTICE OF MOTION TO COMPEL.

I, the undersigned, declare:

  1. I am the plaintiff, Gary Robinson in this case.

  2. On 11-30-4 I had served upon Defendants SkyCar and Laura Nelson a Notice of Motion for Order Establishing Admission et al;

  3. I received both of these Notices unopened the a postal stamp stating "return to sender." In red pencil each envelope had writing stating the SkyCar (the addressee on the envelopes) was no longer in business. (See exhibit A for copies of the envelopes).

  4. After receiving the envelopes I called SkyCar at 310-645-2300 to see if they were still in business. The person who answered, answered "SkyCar."

  5. I then drove the 7135 W. Manchester Blvd. LA to see if they were at the same business location and they were. (See attached copies of photos taken on with one of the above stated returned letters on the windshield of a SkyCar car.)

  6. I drove to the post office coving the defendants address and the postal official stated that a letter carrier would not have written what was written on the envelop and that was probably from the addressee.

I declare under the penalty of perjury under the laws of the State of California that the foregoing is true and correct.
