      And on the eighth day of June in the said year of our Lord one thousand eight hundred and thirty nine, at the special instance and request of Henry William Baldwin of Bathurst in that Province of New Brunswick, now at New Carlisle in the County of Bonaventure in the District of Gaspé in the Province of Lower Canada, attorney named in and by the act or letter of substitution which preceded and is hereunto annexed.
    We,the undersigned Notary Public, duly admitted and sworn for the Province of Lower Canada, went purposely to the house and residence of William Macdonald, Esquire, one of Her Majesty's Justices of the Peace, authorized and appointed, by the petition of Alexander Mavor, second mate and chief surviving officer of the late barque Colborne, wrecked near Port Daniel in the said County in the month of October now last past, in the late voyage of the said vessel from London, in England, to the ports of Quebec and Montreal in this said Province, and whereof the late William Kent was master, situate and lying near New Carlisle in the County, District and Province aforesaid.
    And then and there being and speaking to the said William Macdonald and to John Le Boutillier, Esquires, another of the magistrates authorized to manage the affairs of the said late barque, did and by these presents do declare, signify, notify and make known unto the said William Macdonald and John Le Boutillier in their said respective quality for themselves and the other magistrates appointed to manage the affairs of the said late barque Colborne, and to all and every person or persons whomsoever, whom it doth, shall or may in any wise concern.
    That whereas under and by virtue of a certain power or letter of attorney, signed, sealed and delivered, being first duly stamped by William Collinson of Hull, in England, managing owner of the late barque called the Colborne, and the several other persons whose names and seals are hereunto signed and affixed, being respectively the shippers or proprietors of goods laden on board of the said late barque, in her late voyage aforesaid, bearing date the twenty second day of February, now last past, they, the said William Collinson and the several other persons aforesaid for the causes and considerations mentioned in the said power or letter of attorney, did constitute, nominate and appoint Messeurs Joseph Cunard and Henry Cunard, both of Miramichi in the Province of New Brunswick, merchants, the true and lawful attorney and attorneys, jointly and separately of them, the said William Collinson and the several other persons aforesaid, in their said respective qualities all which with other matters and things will more fully and at large appear in and by the said power or letter of attorney in part recited, reference thereunto being had.
    And whereas by virtue of the power and authority in and by the said recited power or letter of attorney mentioned and expressed given unto them the said Joseph Cunard and Henry Cunard, they the said Joseph Cunard and Henry Cunard did substitute, nominate and appoint & is thereupon .... and the said Henry William Baldwin and Lestock P. Desbrisay, also of Bathurst aforesaid, gentlemen, and each of them separately, their and each of their attorney and attorneys, for the purposes of the said in part recited power of attorney and in virtue of the power of substitution in the said in part recited power of attorney, expressed and confirmed, as will fully appear by the said power or letters of substitution, signed, sealed and delivered, or instruments in writing bearing date the first day of May now last past, reference thereunto being had and from the certified copy thereof hereunto annexed.
    And whereas by the said Henry William Baldwin, being so aforesaid named and appointed, is desirous of signifying and making known his said appointment unto the magistrates appointed to manage the affairs of the said late barque Colborne aforesaid, and unto all and every person or persons whomsoever whom it doth, shall or may concern, by virtue of the said letter of substitution, for all, each and every, the purposes of the said in part recited power of attorney.

     Now therefore these present that in order to give full and entire force, virtue and effect of the said Henry William Baldwin in his said quality, we the said Notaries at the aforesaid request, did signify, notify and make known unto the said William Macdonald and John Le Boutillier in their said respective qualities, # the said in part recited power of attorney and accompanying documents, and of the nomination and appointment therein made of the said Joseph Cunard and Henry Cunard and each of them separately as the attorney and attorneys of the said William Collinson and the several persons * whose names and seals are subscribed and affixed to the said power of attorney, in their respective qualities, for all and each the purposes of the said power of attorney.
    And did also further signify, notify and make known unto them, the said William Macdonald and John Le Boutillier in their said respective qualities, and other person or persons whom it doth, shall or may concern, speaking as aforesaid, the said power or letter of substitution and the nomination and appointment of the said Henry William Baldwin and Lestock P. Desbisay and each of them as the attorney and attorneys in the place and stead of them, the said Joseph Cunard and Henry Cunard, and did hereby require him, the said William Macdonald and John Le Boutillier, in their said respective qualities, and the other magistrates now or herefore having the management of the affair of the said barque Colborne and the cargo therein laden as aforesaid and all and every other person or persons whom it doth, shall or may in any wise concern, to take notice thereof and govern themselves accordingly, of all which act having been requested, we have granted these presents, to serve and avail as occasion may require.
    Thus done and signified as aforesaid at the residence aforesaid of the said William MacDonald on the day and the month and year herein first above written, having left each copies of the said power of attorney and accompanying documents, and of the aforesaid power of substitution and of each of them, speaking as aforesaid, with and for the said William Macdonald and John Le Boutillier in their said qualities and other members of the Board of Magistrates appointed to manage the affairs of the said late barque Colborne, and all and every other person or persons which it doth, shall or may in any wise concern, in order that they and each of them plead or allege not ignorance of the premises.
