testified by the petition of the said Alexander Mavor to the Court in that effect.

whereas the late William Kent was Master
   To all to whom these present shall concern, or whom the same in any wise may concern.
    Be it known and made manifest, that on this twenty fourth day of October in the year of our Lord one thousand eight hundred and thirty eight, in obedience of the order and instruction of the Court of Bonaventure in the District and Province aforesaid on the twenty second day of October instant, and, the further instance and request of Mavor #, now at Port Daniel aforesaid, second mate and chief surviving officer of the barque or vessel called the Colborne of London, of the burthen of three hundred and thirty tons or thereabouts, register measure, now lying stranded and wrecked at or near Harrington Cove near Port Daniel aforesaid, loaded with a general cargo and military stores *, the said barque or vessel called the Colborne, having been stranded and wrecked on the rocks near Harrington Cove, aforesaid on her voyage from the Port of London, England, to the Port of Quebec and Montreal in this said Province of Lower Canada, on the night of the fifteenth and the morning of the sixteenth day of October, instant.
    We, the undersigned John LeBoutillier, merchant, William Macdonald, land surveyor, and John M. Dougald and Joseph Meagher, merchants, all at present at Port Daniel aforesaid, went in obedience to the instruction and at the the request as aforesaid, to the different stores herein after mentioned in which the goods, wares and merchandize, saved from onboard the said barque Colborne are now placed, and then and there being after the most careful and diligent examination and inspection of the goods, wares and merchandize so saved, and the state and condition with the same may now be, did and do unanimously report as follows, to wit:
    That after examining the (No.1) on the east side of Port Daniel River beach, we found the same as contain a small lot of candles, one keg of powder, a box addressed to Major Deed, Montreal broker, two quarter casks Spanish wine, five pipes or hogsheads of wine and gin, two of which (wine) are damaged. We also found in the store (No. 2) on the said east side of the beach, a quantity of made cloths, candles, pieces of unbleached cotton, and even pieces of cloth, various colours, all which were damaged and in a perishable state, having been underwater for several days. We also found in the store (No. 3) on the southeast side of the said beach, a quantity of sails and cordage in a perishable state. Also in the store (No. 4), a quantity of tallow and a barrel of broken candles. We also found on the west side of the beach of Port Daniel River in the store No. 5, (Lyon's store), in one part, a quantity of cloth, cottons, carpeting & made clothes, three casks of liquor, one ullage cask of wine and several boxes of candles, pickles and other articles. In another part of the store (Lyon's), a number of boxes of candles, two silver lamp stands, several packages of books and letters, and several other small packages. Also in the loft of the said store, a quantity of made coats or clothing, a number of pieces of clothes, and a number of bottles containing liquor. Also in the lower part of the said store, silks and cottons. We also found in the store or forge (No. 7) on the said west side, twelve hogsheads supposed to be wine, three of which we ascertained to be in a damaged state. Also in (No. 8), or red store on the said west side, a quantity of merchandize, military apparel and nine hogsheads of liquor, the whole of which merchandize and clothes is in a perishable state, as also a quantity of hemp lying on the outside. Also in No. 9, Mr. Carter's farm on the said west side, three hogsheads of liquor in a damaged state. Also in a store (No. 10) on the said west side, a quantity of military apparel, clothes and other merchandize, as also a quantity of hemp on the outside. And lastly, we examined and surveyed the schooner called the Victoria lying in the bay of Port Daniel aforesaid, reported to have onboard goods from the said vessel called the Colborne, and that the said schooner had on board of the goods saved from the said vessel, two pipes of liquor, one cask or tallow, two quarter casks of wine and from ten to twelve gallons of brandy contained in the cask.

and not fit by any measure to be shipped
      All which goods, merchandize and effects before enumerated and saved from onboard of the said barque or vessel called the Colborne, we found to be soaked with salt water (except a few casks of liquor before mentioned) and in a damaged and perishable state and condition *, and of a review and examination of the whole of the goods and merchandize so saved. we are decidedly and unanimously of opinion that the same ought to be sold at public auction within the least possible delay for the interest and advantage of all parties interested or concerned herein. To the truth of all which said several matters and things herein before alleged and declared, we are ready and willing to make oath when thereunto requested. In testimony whereof we have hereunto set our hands and affixed our respective seal at Port Daniel aforesaid, in the County of Bonaventure in the District of Gaspé in the Province of Lower Canada (where no stamps are used), this said twenty forth day of October, one thousand eight hundred and thirty eight, having signed certificates all of the tenor and date.

     In fact and testimony and further corroboration of the preceding written certificate of survey, I, Martin Sheppard, Notary Public by Royal Authority, duly admitted and sworn for the Province of Lower Canada, being at present at Port Daniel in the said Province, do hereby certify, declare and attest unto all whom it may concern, that the said preceding written certificate of survey and the premise therein contained, were thus done and passed at my office in Port Daniel aforesaid, on the day and in the month and year therein first above and lastly written, and signed, sealed and delivered by John LeBoutillier, William Macdonald, Joseph Meagher and John Macdougald, surveyors mentioned in the said certificate of survey.
    Me, the undersigned Notary and the witnesses, whose names are set and subscribed at foot of the attestation of the said preceding written certificate of survey. And further that the signatures of John LeBoutillier (LS), William Macdonald (LS), Joseph Meagher (LS) John Macdougald (LS) * and the signatures and seals of the said John LeBoutillier, William Macdonald, Joseph Meagher and John Macdougald and of each of them respectively set and subscribed in my presence and in the presence of the witnesses above named and subscribed at foot of the preceding written certificate on the day and in the month and year therein written, the same having been first duly read according to law.
