Last Will and Testement of Moses Hickenbottom

In the name of God, Amen. The twenty ninth day of November 1804, I, MOSES
HICKENBOTTOM, of the County of Monroe, being perfect mind and memory, thanks be
given unto God, therefore, calling to mind the mortality of my body, and knowing that it
is appointed for all men are to die, do make and ordained this my last will and testament,
that is to say principally, and first of all, I give and recommend to the earth, to be buried in
Christian burial, at the discretion of my Executors, nothing doubting but at the general
resurrection, I shall receive the same again by the mighty power of God, and as touching
such worldly Estate, wherewith it has pleased God, to help me in this life. I give, demise,
and dispose of the same in the following manner and form.
First, I give and bequeath to MARY, my dearly beloved wife, all my horses, cattle, sheep,
and hogs with my household goods and moveable effects to her use, or to be disposed of,
as she may think proper.
Secondly, I give and bequeath to my beloved son, ANDREW HICKENBOTTOM, a tract
of land on Lovell Creek, containing one hundred and ninety acres, more or less.
Thirdly, it is my desire, that my Executors sell a tract of land containing four hundred
acres, and known by the Nob Place, and devide the money arising therefrom equally
between all my other children, giving to each an equal part.
Fourthly, I give and bequeath unto my beloved son, JAMES HICKENBOTTOM, my
plantation, whereon I now live, and being in the Cove, containing three hundred acres,
more or less, at his mother's death, as it is my desire, that she should keep possession of it
for her maintenance during life.
I likewise constitute and appoint, make, and ordain my friends, WILLIAM HERBERT and
JOHN LEWIS, with my son, JAMES HICKENBOTTOM, and MARY HICKENBOTTOM, my
wife, my sole Executors and Executorix, of this, my last will and testament, all and
singular, my lands and sessuages, and tenements, by him, JAMES HICKENBOTTOM,
freely to be possessed and enjoyed, and I do hereby utterly disallow, revoke, and
disannul all, and every other former testament wills, legacies, bequeaths, and execution
be me in any ways before named, willed, bequeathed, ratifying, and confirming this and
no other to be my last will and testament, in witness, whereof, I have here unto set my
hand and seal, this day and year above written.

Page 49 at a Court held for Monroe County, the nineteenth day of February 1805. This
will and testament of MOSES HICKENBOTTOM, dec'd, was presented in Court by JOHN
LEWIS and JAMES HICKENBOTTOM, two of the Executors, therein named, and MARY
HICKENBOTTOM, the Executorix, therein named, and proven by the oaths of JOHN
LEWIS, and WILLIAM CORNWELL, Witnesses thereto, and ordered to be recorded,
JOHN
LEWIS, one of the Executors, named in the said will, came into Court and declares, that
he will not take upon himself any part in the executing of the will aforesaid, where upon
JAMES HICKENBOTTOM and MARY HICKENBOTTOM, having taken the oath prescribed
by law, and on their motion, certificate is granted them for obtaining probate thereof in
due form, and their giving bond with security, whereupon they together with JOHN
HANDLEY, JR., JOHN McNUTT, and James MOSS, their securities, enter into, and
acknowledge a bond in the sum of one thousand dollars, conditioned for one executing
the said will, and administering of the sad decedent's estate.
