| Shaking Hands In Islamic Jurisprudence the term Mubah connotes something which you can do, or not do, it is your prerogative; doing it or not doing it are equal. How do we know that something is mubah? If there is no mention in Islam about something as to whether it should be done or not done then we call it mubah. Shaking hands with women enters in the area of mubah because there is no mention of it in Islam either way- positive or negative. And the general rule of the fuqahaa (Islamic scholars) is: Everything is okay; it is legitimate, unless we have proof to say that it is prohibited. If there is no proof then it is mubah. That question of shaking hands with a woman has two parts. 1. Does shaking hands with a woman necessitate performing one�s wudu again? 2. Is shaking hands with a woman haram or halal? As I mentioned there is nothing in Islam which says it is legitimate and there is a nothing which says it is prohibited and the general rule in the science of usul ul-fiqh (Islamic Jurisprudence) is that when there is nothing mentioned either way it means it is something which can be done. If we move to the other part of the question, which is related to wudu, we find that the schools of thought differ among themselves. One school of thought ( SHAFII ) says if a man shakes hands with a woman he has to make up his wudu because his wudu is void. Another school of thought says no, he can shake hands with women and still pray because his wudu is still in tact. |
