Sales Contract

 

This contract is for the sale of the following animal(s) by Lively Acres and/or Clayton Taylor, herein referred to as the Seller, to _____________________________, herein referred to as the Buyer, for the total amount of $____________.

The Seller is responsible for:

·        Feeding, housing, providing basic maintenance and healthcare to the above listed animal(s) until the agreed upon delivery date.

·        Giving possession of the above listed animal(s) to the Buyer on the agreed upon delivery date after payment is received in full.

·        Providing all American Goat Society and Nigerian Dwarf Goat Association recordation documentation (bill of sale, breeding memorandum, registration and/or transfer of ownership) to the Buyer on the agreed upon delivery date after payment is received in full for “breeding stock” and “show quality” animals only.

 

The Buyer is responsible for:

·        Signing and returning this contract within 10 business days of the official purchase agreement (the date this contract is signed and mailed to the Buyer, by the Seller) along with a down payment of 50% of total purchase price (by cash, cashiers check or money order).

·        Taking delivery of the animal(s) and making payment in full (by cash, cashiers check or money order) within 30 business days of the date of sale (the date the Buyer signs this contract).

·        Paying all costs for shipping, veterinary health certificates (required by law for interstate travel) or extra testing that the Buyer’s State may require.

·        Providing adequate transportation of the animal(s) – all animals must be transported in an adequately sized, covered, ventilated and safe vehicle or carrier where the animal may comfortably and safely stand, turn around and lay down. If the Buyer chooses to transport the animal by air and requires the Seller to provide transportation to the airport, the animal must depart from DFW airport, the Buyer must provide the Seller with approved carrier(s) (carriers can be purchased from the Seller), all necessary documentation and flight itinerary in adequate time to arrange transportation to the airport. The Buyer is responsible for all shipping and related charges.

Terms & Conditions:

·        Down payment is due when Buyer signs this contract and is non-refundable. If the Buyer decides not to purchase the animal the down payment will not be refunded.

·        If the Buyer does not take possession of the animal within 30 days of the date of sale, the Buyer forfeits the animal as well as the down payment.

·        The Buyer agrees that the animal will not be used for meat production purposes or be sold for slaughter.

·        The Seller guarantees that the animal is healthy at the time it leaves our farm. Because shipping is stressful and we cannot control that stress or the care the animal receives once it leaves our farm, we cannot offer any further guarantees related to the health of the animal.

·        The Seller guarantees fertility in any animal sold as “breeding stock” or “show quality” and will replace any infertile animal contingent upon the Buyer providing the Seller with a veterinarian's written statement that the infertility is genetic.

·        The Seller guarantees that any animal sold as “show quality” is free of disqualifying faults when leaving our farm but cannot guarantee eventual height, color or personality (although we strive to meet and maintain the height requirements of the AGS and NDGA registries).

·        If, at any time, the Buyer cannot continue to provide proper care to the animal, please contact Lively Acres and we will work with you to reach a mutually agreeable solution.

·        If this contract is not signed by the Buyer and returned to the Seller, along with the down payment, within 10 business days of the official purchase agreement (the date the contract is signed and mailed to the Buyer, by the Seller) or if payment in full is not received within 30 business days of the date of sale (the date the contract is signed by the Buyer) this contract will become null and void. Upon nullification of the contract, the Seller will retain the animal and/or re-list the animal for sale and the Buyer will forfeit the down payment and all rights to the animal.

 

By signing this contract, the Buyer and the Seller agree that they have read and understand the contents and are bound to all the responsibilities, terms and conditions herein.
