| This index provides a listing of microfilmed records for estate records, wills, child custody orders, and other court records in Ontario held by the Archives of Ontario. It currently houses records up to 1962. For records less than forty years, the genealogist must contact the local Surrogate office. Currently the Archives houses all the earliest (pre-1859) Surrogate records for each Surrogate Court in the Province. Up to 1850, the province was divided for most governmental purposes into Districts, not counties; the locate Surrogate Court records reflect these district divisions. There is no province-wide index to the early records, and the genealogist needs to know the District records he is going to need to examine. The records for the period 1793-1858 are not as complete for the period that follows. The estate files held by the Archives are not necessarily complete, so if no estate file is found, one should check the Registers for a record. Most of these Registers are indexed. There are few estate files for women during most of the nineteenth century. Until 1859, a married woman in Ontario could not hold property in her own right. Any property that she owned at the time of her marriage became the property of her husband. Only single women and widows could own property. It was not until 1884 that married women gained the same property rights as men and single women. Some Land Regisry Office hold 60% of all surviving wills because they were never probated, and the deceased's estate consisted only of property (most were farmers). An Estate File contains the documents used by the Surrogate Court to disperse the deceased person's estate, whether he or she died with or without a will. |
