     2.  Abraham2 Mitchell (John1) was born Abt. 1780 in Amelia County, Virginia, and died Bef. August 26, 1848 in Edgefield District, South Carolina.  He married Mary Abt. 1798.

Abraham MITCHELL of the first part, Mary MITCHELL of the second part and R. J. Burton of the third part . . . "whereas the said Mary MITCHELL by and with the consent and approbation of her husband the said Abraham MITCHELL which consent is fully attested by his being a party to and signing and sealing this indenture intends to deal, trade, and traffick as a sole trader and free dealer and whereas due and proper notice according to the provisions of the law in such case made and provided has been given and published in a newspaper called the "Carolinian" published at Edgefield Court House in the district and state aforesaid . . . Now be it known that I the said Abraham MITCHELL for and in consideration of $1 to me in hand paid by the said R. J. Burton the receipt whereof is hereby acknowledged and also in the further consideration of the covenants hereinafter expressed have declared, made and constituted and by this indenture do solemnly declare, make and constitute my wife the said Mary MITCHELL a sole trader and free dealer with all the rights, privileges and immunities appertaining or belonging or in any wise by law incident to that character and with full and ample powers to do and perform any and all acts which a feme-sole trader or free dealer may by the laws of this state now lawfully do or perform . . . And the said Abraham MITCHELL doth further covenant and agree that he will not molest, hinder or prevent her the said Mary MITCHELL from dealing, trading and trafficking in as full and ample a manner as if she was a feme-sole and that he will not appropriate to his own use nor in any wise intermeddle with any property which she the said Mary MITCHELL may hereafter obtain or acquire in her right and character of sole-trader and free dealer as aforesaid but that the same whatever it may be either real or personal shall be and remain free and clear from all claims of himself or of his present or future creditors and to and for the sole and separate of he the said Mary MITCHELL and to be disposed of by her by deed or otherwise in any manner that she may deem proper without any control, let, or hindreance of him the said Abraham MITCHELL . . . And the said Burton on his behalf covenant and agrees to and with the said Abraham MITCHELL that he the said R. J. Burton will and permit his name to be used as trustee for the said Mary MITCHELL for all proper and legal purposes so far as the same may be necessary to sevure to her the full and complete enjoyment and benefit of the character of sole-trader and free dealer as aforesaid . . . In witness whereof the said Abraham MITCHELL, Mary MITCHELL, and R. J. Burton have hereunto put their hands and seals the day and year above written. Signed, sealed, and delivered in the presence of Rhd Burton, S R, Smith Radford, William Lyttleton.

WILL OF MARY MITCHELL: "I Mary Mitchell widow of the late Abraham Mitchell of the District and State aforesaid do make and declare my last Will and Testament in manner and form following...

1 I constitute and appoint my son Lloyd L. Mitchell executor of my estate.

 

2 I devise and bequeath to my grandson Pickens B. Yarbrough one ninth part of all my real and personal estate.

 

3 I devise and bequeath unto my eight children Martha Hays, Joseph Mitchell, Eliza Blease, Harriette Holmes, Nonie Ann Hays, Rosellena McCullough, Caroline Mitchell, and Lloyd L. Mitchell one eighth part each of all my estate both real and personal after deducting the share of Pickens B. Yarbrough.

 

4 It is further my desire that the share of my son Joseph Mitchell shall be given to him during his life but not subject to his debts now or hereafter contracted and after his death to revert to his children

 

5 It is further my desire that the shares of my daughters shall be held and enjoyed by them respectively for their sole and separate use independent of the control marital rights or contracts of any person or persons whomsoever.

       13          vi.        Harriet Mitchell, born Abt. 1809 in Edgefield District, South Carolina; died February 25, 1886 in Augusta, Richmond County, Georgia.  She married John M. Holmes July 29, 1830 in Harmony Methodist Church, Edgefield District, South Carolina.

       14         vii.        Elizabeth Mitchell, born Abt. 1812; died in Newberry County, South Carolina.  She married Horatio M. Blease; born Abt. 1804 in England.

       15         viii.        Polly Caroline Bodie Mitchell, born November 18, 1813; died Bef. August 26, 1848.

       16          ix.        Rose Ellen Mitchell, born Abt. 1814 in Edgefield District, South Carolina; died Bef. 1850.  She married John J. McCullough March 17, 1834 in Edgefield District, South Carolina.

       17           x.        Abraham Lloyd Mitchell, born June 09, 1819 in Edgefield District, South Carolina.  He married Mary Ann Moseley; born Abt. 1827 in South Carolina.

       18          xi.        Mary Caroline Mitchell, born 1825 in Edgefield District, South Carolina.  She married Samuel Williams October 14, 1851; born Abt. 1815 in South Carolina.
