December 1, 1894 Williamson County Texas) on December 31, 1868 Wayne County Kentucky, the son of John Tuggle and Susan Hurt.(2nd) Henry Alvin UpChurch (b. April 1840- DIED June 28, 1918)on January 5, 1888 Wayne County Kentucky. Nancy died March 2, 1917 Clinton County Kentucky, she is buried in Central Grove Baptist Church Cemetery.Henry Alvin was first married to Susan Hurt. He is buried next to her in the Pyles Cemetery, Powersburg.

Statement by Z.T Tuggle: "We lived together until February 1877 when Nancy left my house with John Whitehead and is guilty of adultery and has never returned home."

Statement by Nancy (Burnett) Tuggle: "I employed said Whitehead to move me and my childern from Clinton County at Albany to my father, Johnathan S Burnett's house in Wayne County. Tuggle has behaved toward me in such a cruel and inhumane manner as to indicate a settled aversion to her and to destroy permantly her peace and happiness. Z.T Tuggle is a non resident of the state of Kentucky and has for the past one year been living with another woman. She believes he lives in Illinois."

Statement by John Whitehead: " Z.T Tuggle lives in Missouri. For several months before they seperated he was running around and not staying at home and keeping company with Nancy Stockton and when he left the state, he took Nancy Stockton with him and then they both returned to Kentucky after that and remained for 2 or 3 months and while in the County on that trip, said Nancy Stockton gave birth to c child and I saw the mother and child. She was unmarried woman when she left Kentucky with the plaintiff. Tuggle employed me to take his wife and childern to her father, J.S Burnett's house in Wayne County, which I did and he declared he never intended to live with her again. In the winter before the seperation, I was at his house. The weather was very cold. His wife had no wood, no meal or meat and he had been gone from home for 2 or 3 days. At the time the plaintiff sent his wife to her father's, she appeared to be in great distress and trouble. He sent her away without provisions or money to pay the expenses of the trip. Numerous summons were issued to find the plaintiff, Z.T Tuggle, but each time, a report come back to the court that a dillegent effort had been made to find and inform him concerning the pendacy of this action, but no available. "He can not be found" The last summons was returned September 15,1880 by Tuggle's attorney. Samuel C Hardin
A Judge then ruled that the defendant Nancy Burnett Tuggle be and is herby divorced from the bonds of marriage with Z.T Tuggle and restored all the rights and privlidges of an unmarried woman.
