| Will---James Webb I, James Webb, of Williamsport, County of Grant and State of West Virginia, being of sound mind , memory and understanding, do make my last will and testament, in manner and form following: First, I hereby give, devise and bequeath to my wife, Elizabeth, the house situated in Williamsport, W.Va., now owned and occupied by me, to be hers to occupy, rent , sell or dispose of as she wishes. Second, I also bequeath to my wife all my money, notes and papers of value of what kind so ever after paying my funeral expenses and such other amounts as I shall hereinsfer state. Third, I hereby bequeath to my children, who may be living at the time of my death call my household and kitchen furniture, beds, bedding of all kinds to be divided by them, share and share alike as they shall agree, after allowing my wife to keep such of the same as she desire. Fourth, I give to my wife my horse and buggy which shall be hers free of all incumbrance. Fifth, The Fountain Flour Mill now owned by me shall be rented from year to year and one-half the rent so obtained shall be used to repair the mill and mill property, provided that the property shall rent for more than two hundred dollars. The remainder of the rent from the mill shall be divided equally by my son, Westfall L Webb and my son-in-law, Jacob Markwood. Sixth, I hereby give to my niece, Lucy G Jacob and my nephew, Bursey E Jacob, provoded they remain with my wife until they become twenty-one years of age, at which time they shall be paid fifty dollars each, to be paid from my money left to my wife. Seventh, I hereby appoint my son, Westfall L. Webb and my son-in-law Jacob Markwood my executors of this will and they shall be required to give bond for the performance of the same. Eighth, I also desire that C. E. Martin and C.C.Marshall shall have no part in settling or providing my estate and that there shall be no sale of my property at public auction and that the estate shall be divided as I have directed without employing a lawyer. Ninth, All the other property that belongs to me at the time of my death that is not heretofor mentioned shall be equally divided among my heirs, as they shall agree upon, and in the case of any dispute arising it shall be settled by taking a vote upon the question in dispute by the heirs, allowing the majority to settle the dispute, which decision shall be final.
