| This deed made the 22nd day of August in the year 1868 between Thomas Burgess, Jr and Elizabeth his wife of the one part and Christopher C Burgess of the other part, all of Grant County in the State of West Virginia. Witnesseth that for and inconsideration of the sum of Twelve hundred and forty dollars to be paid in manner following: to wit; Four hundred and forty dollars thereof to be paid on or before the 15th day of October 1868, and the residue to be paid in three equal annual payments of two hundred sixty-six 2/3 dollars each, becoming due and payable on the 15th day of October in three several bonds bearing even date herewith, to secure the payment of which bonds a lien on the property hereinafter described is hereby expressly reserved, the said Thomas Burgess Jr and Elizabeth his wife do grant and convey in fee simple with general warranty unto the said Christopher Columbus Burgess all of a certain tract or parcel of land drains of the northfork of Luneys Creek and on spurs of Alleghany Mountain and bounded as follows: Beginning at a bunch of maple saplings and a stake by to spanish oaks corner to Philip Benstein and in a line of the original Chambers survey and with the latter S. 8 1/4 degrees W 81 poles to two chestnut oaks corner to the original and to Adam Harness' Valentine survey and with a line thereof S 21 1/4 degrees W 44 poles to two red oaks and a chestnut oak in sid line corner to Casper Hammerstedt and with his line N 59 degrees W 410 poles to three pines, one of them very large, on the west side of a ridge, corner to said Hammersteadt, thence N 28 degrees E 114 poles (passing a corner at 21 poles) to live chestnut oak saplings by a stone pile, corner to A Hetzlar then S 59 degrees E 378 poles to the beginning containing two hundred and eighty acres more or less together with all the appertances to the said two tracts belonging to premises hereby granted being the same that were conveyed by John G Benzenhafer and wife to the said Thomas Burgess Jr by deed bearing date the 17th day of November 1855 and of record in the Clerk's office of Hardy County Court to which reference is hereby had. Witness the following signatures and seals Thomas Burgess Elizabeth Burgess State of West Virginia County of Grant to wit; I, Ernest Muntzing, Recorder for the County a foresaid, hereby certify that Thomas Burgess Jr and Elizabeth his wife, whose names are signed to the foregoing deed bearing date on the 22nd day of August 1869 have acknowledged the same before me in my office in the County aforesaid, and the said Elizabeth Burgess, the wife of Thomas Burgess, being examined by me privily and apart from her husband and having the deed aforesaid fully explained to her, declared that she had willingly excuted the same and does not wish to retract it.
