Will of Moses Caplinger

I Moses Caplinger Senior do hereby make my last will testament in manner and form following that is to say.

First I desire that what money may be left after my decease shall be applied to the payment of my just debts and funeral expenses. If however they prove not sufficient then the perishable property I may have I wish sold and applied to those purposes or sold thereof as shall be necessary-

Secondly After the payment of my debts and funeral expenses I give my wife Mary Ann all my estate real and personal to hold in trust for her maintance and the benefit of herself and our children during the period of her widowhood and as long as she shall live, but in case of her decease or contraction of a marriage then in either event all of said property shall be sold and the proceeds divided equally among my children. My wife in the constituted executor of this position of my and guardian of the interest of our children in (couldn�t read) discharge of which duties I have all confidence.

Thirdly In case of either of the event mentioned transpires Viz, death or marriage of my wife Mary Ann then I d??? the executor I have appointed and herein after named dispose of all my property real and personal to the best advantage they are able and make equal division of the proceeds among my children namely Juliann, Susan, Caroline, Priscilla, Christian, Jacob Markwood, Mary Catherine, Moses, Ann Elizabeth and Gabriel Stickley ten in all.

I desire the executor to make such arrangements as best condone to the interest of any of the children as stated be of age at the time when it shall be neeysary to make the division � as I don�t wish them to enter upon their possession of their shares until they become of lawful age.

And lastly I do hereby constitute and appoint my friend Snowden Scott and Moses Keplinger junior executor of this my last will and testament.

In Testimony whereof I have hereunto set my hand and affixed my seal this twenty seventh day of January one thousand eight hundred and fifty fifth.

At a Court held for Hardy County the 2nd day of April 1855.

This last will and testament of Moses Caplinger Senior decd was proved by the oaths of Gideon Keplinger and Charles W. Scott subscribing witnesses thereto and ordered to be recorded. On the motion of Moses Keplinger jr one of the executors in said will named who made oath according to law a certipeate (??) is granted him for obtaining a probate thereof in due form on giving bond and security whereupon he with security entered into and acknowledged above conditioned as the san direct and which is ordered to be recorded.

At Des Court 1855 the letters testimentary granted Moses Keplinger jr was revoked and letters granted to Mary Ann Keplinger as heir.
