Will of Ernest Franz

I, ERNEST FRANZ, of Maysville, West Virginia, being of sound mind and disposing memory, do hereby make, publish and declare this to be my last Will and Testament, hereby revoking any and all Wills heretofore made by me at any time.

FIRST: I direct that all my just debts and funeral expenses be paid.

SECOND: I give, devise and bequeath my entire estate, real, personal and mixed to my wife, LOUISE FRANZ: however, in the event that my wife sould predecease me, I give, devise and bequeath my entire estate to my son, DAVID FRANZ.

THIRD: I nominate, constitute and appoint my wife, LOUISE, as the Executrix of my estate, and request that she be allowed to serve without bond, and in the event that she should predeceased me, I nominate DAVID FRANZ as my Executor, and request that he be allowed to sere without bond.

IN  TESTIMONY WHEREOF, I have hereunto subscribed my name and affixed my seal this 31st day of July, 1970.

The foregoing signature of the testator was made and the foregoing Will was acknowledged to be his last Will and Testament by the said testator, in the presence of us, two competent witnesses present at the same time, and we, the said witnesses, hereunto subscribed the said Will on the day last above written at his request as attesting witnesses, in the presence of the testator and of each other, and we certify that he was then of sound mind and over the age of twenty-one.

In the Clerk�s Office of the County Commission of Grant County, West Virginia, November 8, 1977 � In recess of said Court:

This day Duke A. McDaniel produced to the Clerk a paper writing, purporting to be the last Will and Testament of Ernest Franz, deceased, and upon motion of the said Duke A. McDaniel, said will was proven by the oaths of Duke A. McDaniel and Twila M. Kessel, the subscribing witnesses thereto, and ordered to be recorded, according to law.
