Will of Charles E. Simpson

I, CHARLES E. SIMPSON, of Grant County, West Virginia, do hereby make, publish and declare this to be my Last Will and Testament hereby revoking all Wills and Testamentary Papers at any time heretofore made by me.

FIRST: I direct the payment of all my just debts, if any, I may owe at the time of my death including the erection of a modest monument for myself at my grave.

SECOND: Subject to the contengiences enumerated in �THIRD� paragraph hereof, I give, devise and bequeath all my estate and effects, real, personal or mixed of every kind and character, whatsoever and wheresoever situate now owned by me or which I may die seized and possessed of to my wife, Beulah G. Simpson, as her absolute property.

THIRD: If I am predeceased by my wife, Beulah G. Simpson, or should my wife die within a period of one year from the date of my death, or should my wife die under circumstances containing no sufficient evidence that we died otherwise than simultaneously, then in such an event, I give, devise and bequeath all the rest and residue of my estate and effects real, personal or mixed of every kind and character whatsoever and wheresoever situate now owned by me, or which I may die seized and possessed of equally to my five children, namely, Elvalee S. Goldizen, Ireda S. Ours, Mary Ellen Rohrbaugh, Mae Ann Kisamore, and Norma S. Shoemaker, share and share alike.

FOURTH: I nominate and appoint muy wife, Beulah G. Simpson, as Executrix of this my Last Will and Testament and direct that she be allowed to serve without bond. In the event, however, my wife, Beulah G. Simpson, should die under circumstances hereinbefore enumerated under paragraph designated �THIRD� of this Will, then I nominate and appoint Norma S. Shoemaker as Executor of this Last Will and Testament and direct that she be allowed to serve without bond.

Given under my hand this the 26th day of July, 1973.

Signed, published and declared by Charles E. Simpson as and for his Last Will and Testament, in the presence of us, who in his presence, at his request, and in the presence of one another, have hereunto subscribed our names
As Witnesses, this the 26th day of July, 1973, at which time the said Charles E. Simpson was over the age of twenty one years and in our opinion, of sound mind and disposing memory.

This day Beulah G. Simpson produced to the Clerk a paper writing, purporting to be the last Will and Testament of Charles E. Simpson, deceased, and upon motion of the said Beulah G. Simpson, said will was proven by the oaths of John G. VanMeter and Karen Kitzmiller the subscribing witnesses thereto, and ordered to be recorded, according to law.
