Catherine Warfield to C. A. Markwood

This indenture made this the 14th day of September 1898, by and between Catharine Warfield party of the first part and C.A. Markwood party of the second part, both of Grant County, WV Witnesseth: that the party of the first part does hereby lease and let unto the party of the second part all her lands and houses, situated near the post office of Martin in the County of Grant and State of West Virginia, to hold the same for the term of five years commencing on the first day of March 1899, or such a part of said five years as he may desire to hold them, the said party of the second part yielding and paying rent therefore the sum of fifty dollars for each and every year, and after the same note for any part of a year, that he may hold said premises, said fifty dollars to be paid in manner following:  twenty five dollars to be paid on the 1st day of October of each year and twenty five dollars to be worked out upon the premises each year at the rate of seventy five cents per day, in such improvements as the party of the second part may elect.  And in addition to the annual rent of fifty dollars the party of the first part shall have one third of all the grain that the party of the second part may raise up on aforesaid lands, and grain to be divided in the shock.  The party of the first part reserves for her own use the eastern building of the dwelling knows as the Hollen part of the houses and the kitchen attached thereto and such part of the milk house and granary as she may need for her milk and grain, also one half of the garden.  There shall be no restrictions upon the party of the second part as to which parts of the land he shall farm or where he shall cut his firewood or how he shall use and manage the aforesaid property except that he shall not cut from same more timber than is needed for firewood and improvements upon the premises.  The party of the second part shall be permitted to have and to peel ten cords of tan bark each year upon said lands for which he shall pay the party of the first part one dollar per cord providing the amount of timber peeled is needed for rails and firewood upon the premises.  The party of the first part shall have pasture for one cow upon the lands aforesaid, for which she shall pay the party of the second part one dollar per month for the pasturing season, and shall be permitted to cut all of the fire wood she may desire from the lands.  The party of the second part shall have full possession and control of the aforesaid premises on the 15th day of September 1898, and as rent for same until the first day of March 1899, he shall get firewood and attend to feeding one cow for the party of the first part till March 1st 1899, the party of the first part furnishing said feed and timber for wood.  The party of the second part hereby reserves privilege to quit and give up the aforesaid premises at any time he may desire after March 1st 1900, and he shall not be liable for any rent after he quits said premises and notifies the party of the first party that he does not longer desire to retain them and he further agrees to return said premises in as good condition as he finds them upon taking possession, the usual wear and casualties of fire, water and unavoidable causes excepted.  Signed this the 14th day of September 1898]
