Deed Book # 2   Page 48-49


This Deed made this 30th day of April in the year 1868.  Between Christopher C Burgess and Susan his wife of the one part, and Michael Kessel of the other part, all of Union township in the County of Grant and State of West Virginia. Witnesseth that for and in consideration of the sum of two hundred and fifty dollars paid and to be paid in manner following to wit; One hundred dollars in hand paid by the said Michael Kessel, the receipt whereof is hereby acknowledged, seventy five dollars more thereof to be paid on or before the first day of October 1868 and the residue of seventy five dollars to be paid on or before the first day of October 1869, as evidenced by tow bonds bearing even date herewith, executed by the said Michael Kessel to the said C C Burgess, to secure the payment of which bonds a lein on the property hereinafter described is hereby expressly reserved, the said Christopher C Burgess and Susan his wife do grant and convey in fee simple with general warranty unto the said Michael Kessel a certain tract or parcel of land, situate in said Union township on waters of Welton's run and on spurs and face of Alleghany Mountain and bounded as follows; Beginning at a white oak and pile of stones on a bank East of Welton's run, corner to E F Vossler and in the East line of the original and with the latter S 14 degrees W 20 poles to two white oaks by a path, corner to said original  and with it S 55 1/2 degrees 60 1/3 poles to a white oak in said original, thence leaving it and running N 59 degrees W crossing several drains 636 to a large blazed birch under the top of the mountain, thence N 26 degrees E 78 1/2 poles to a pile of stone on top of the mountain in the plains opposite Baker's place, thence S 29 degrees E 688 poles to the beginning, containing three hundred and thirty acres, be the same more or less and being the same that was conveyed by Magdalene Rocsler to said C C Burgess by deed bearing date on the 8th day of August 1866 and of record in the recorder's office of Grant County aforesaid Book No 1 Page 201, to which references hereby had - To have and to hold the said tract of land with all and singular the appurtenances thereunto belonging unto the said Michael Kessel, his heirs and assigns forever.

            I Samuel Rohrbaugh, a justice in and for the County aforesaid, hereby certify that Christopher C Burgess and Susan Burgess, his wife, whose names are signed to the foregoing deed bearing date on the 30th day of April 1868 have this day acknowledged that same before me in my County aforesaid, and the said Susan Burgess being examined by me privily and apart from her husband and having the writing aforesaid fully explained to her declared, that she has willingly executed the same, and does not wish to retract it.

        On this 22nd day of March 1869 - The within Deed was produced to me in my office with the certificate thereon endorsed and admitted to record, and I further certify that the said Deed had thereon and adhesive stamp, duly cancelled, of fifty cents for donation of the duly imposed by the Excise Law.
