ENGAGEMENT AGREEMENT

 

 

 

 

AGREEMENT made this ____ day of ________, 2004, between “Rock Street Productions” (hereinafter called “Disc Jockey,” “DJ,” “Karaoke Jockey,” “KJ,” “Entertainer,” “Sound Engineer,” or “Provider”) and _______________________________ (hereinafter called "Purchaser").

 

IT IS MUTUALLY AGREED BETWEEN THE PARTIES THAT:

 

1. Provider will furnish and Purchaser will accept, for the engagement hereinafter described, the services comprising of Professional Disc Jockey Entertainment.  The services will be provided on a continuous basis during the stated hours.

7.  In the event Purchaser desires that Rock Street Productions provide extended services, said Professional Disc Jockey Service shall be provided at a rate of $ __________ per hour, which must be paid in full prior to the performance of the extended services.  Rock Street Productions reserves the right to decline extended service request at any time until extended service request is agreed upon and authorized here:

8. A 50% non-refundable reservation fee is required to secure Rock Street Productions for the engagement date(s).  This amount will be deducted from the total price of the engagement.  Reservation fee paid on this _____ day of ____________________, 2003.

 

9. Purchaser must pay the remaining balance of $ __________ in full, no later than seven days prior to the engagement date by cash or money order, or make arrangements to prepay in advance.

 

10. Engagements cancelled within seven days of engagement date will be subject to a 50% cancellation fee (50% of the remaining balance) unless date is rescheduled within one month of original date at which time the cancellation fee will be credited to new engagement balance (subject to availability).

 

11. It is agreed that Provider executes this agreement as an independent contractor and is not an employee of the Purchaser.

 

12. Provider will, at all times have complete supervision, direction, and control over the services of its personnel on this engagement and expressly reserves the right to control the manner, means, and details of the performance of services, as well as the ends to be accomplished.

 

13. Purchaser grants Provider unconditional release for the use of their name, photographs, audio and/or video recordings taken at herein-described engagement for the purpose of Provider’s advertising or promotion.

 

14. In the event of circumstances deemed by the DJ to present a threat or implied threat of injury to the DJ or any property (equipment, lighting, c.d.’s, etc.) in the DJ’s possession, the DJ reserves the right to cease performance.  Purchaser is responsible for payment in full, regardless of whether the situation is resolved or whether Provider resumes engagement.  It is understood and agreed that the Purchaser agrees to provide crowd control if warranted.  Purchaser will be liable for any loss, damage, or injury of the Provider’s equipment or person that is caused by Purchaser or his/her guests, customers, students, etc.  Purchaser agrees to indemnify and hold harmless Gary F. Meyer, Rock Street Productions or employees thereof for any injuries or damages arising from the performance of this agreement.

 

15. Purchaser will provide the following for DJ Set-up and for duration of engagement: reliable power source (preferably one 15 amp, 110 volt circuits).  If the engagement is outdoors, Purchaser must ensure the DJ and any property (equipment, lighting, c.d.’s, etc.) in the DJ’s possession, are furnished with adequate covering from the outdoor elements.  Please make sure the DJ has a good view of the crowd.

 

16.  In the event of war or military recall, Rock Street Production’s military reserve personnel may be responsible for acting out military duty.  As such, purchaser must, by law, allow absence of DJ services.  Gary F. Meyer or employees of Rock Street Productions will, however, do what is possible to provide an alternate contracted DJ service of equal or greater value.

 

17. This agreement shall be considered to have been made in the State of Hawaii and shall be interpreted, and rights and liabilities determined, in accordance with the laws of said State.  If any of the provisions of this agreement are contrary to, prohibited by, or held invalid under applicable laws or regulations of any jurisdiction in which it is sought to be enforced, then that provision shall be considered inapplicable and omitted but shall not invalidate the remaining provisions.

 

18. This contract constitutes the entire agreement between ________________________________________________________
and Gary F. Meyer d.b.a. Rock Street Productions or employees thereof.  This contract may not be modified unless amended in writing and signed by the parties hereto.
