RULES AND REGULATIONS

Section 1.

Authority to Maintain Discipline.

    ACSAT shall maintain good discipline inside the campus as well as outside its premises when students are engaged in authorized school activities.

Section 2.

Student Disciplinary Board.

    A student Disciplinary Board is hereby created and authorized to hear and decide cases involving student. It shall received evidence and on the basis thereof render a decision and impose the sanctionprovided in this Article.

Section 3.

Composition of Student Disciplinary Board.

    The student Disciplinary Board shall be composed of the following:
    1) An officer from the ACSAT Administration, as Chairman;
    2) A faculty member from any Department; and
    3) A student recommended by the Faculty and approved by the School Director, as member.
    The Student Disciplinary Board shall render its decision based on a majority vote within fourteen (14) days from date of receipt of the complaint or incident report.

Section 4.

Categories of Administrative Sanctions.

    Disciplinary administrative sanctions may be imposed on a student for the commission of any offense. Such sanctions may take the form of,
    1) Reprimand, Censure - These are sanctions meted out by admonishing the erring student.

      2) Written Warning - a written admonistion with a warning that repetition of the offense would subject him to a stiffer penalty.
      3) Suspension - A penalty imposed for an offense committed for which a student may be barred for a certain period from a particular class ofr from ACSAT.
      4) Exclusion - This is a disciplinary measure which allows an erring student to finish the semester or term but is thereafter excluded from returning to ACSAT, or where the penalty
    of expulsion cannot for any reason, extraneours or otherwise, be enforced.
      5) Expulsion - This is the supreme disciplinary measure, as distinquished from exclusion, it is imposed and implemented during the semester or term when the offense was committed subject to existing law, policies and procedures.

    Section 5.

    Preventive Suspension.

      A student under investigation may be placed under preventive suspension as a deterrent to the disruption of normal ACSAT operations that my be caused by the continued presence of a student-offender on campus. It may also be imposed to protect the student-offenders from acts of vindictiveness.

    Section 6.

    Classification of Offenses,

    The following acts constitute offenses punishable under this Code:
    1) Those against campus peace, porder, security and safety;
    2) Those offensive to public decency, good customs and morals;
    3) Those detrimental to the property rights and interests of the institution and the academic community;and
    5) Those against the inviolability of school records, official papers, certificates and othe documents.
    6) All other offenses against good moral conduct and behavior, against the law and all other which are detrimental to the school, faculty, owners, and/or representative of the owner and any person.

Section 7.

Imposition of Disciplinary Administrative Sanctions.

    In the table below, the corresponding disciplinary administrative sanction shall be imposed on the first offense.
    There shall be a progresive imposition of disiplinary actions on succeeding offenses.
    Should three or more infractions be committed within a school term, each offenses meriting reprimand, censure or warming a cumulate basis of imposing disciplinary action shall be implemented. A student may thereofre be suspended or excluded on the grounds of gross misbehavior on the principle that multiple and repeated infractions of various policies shall be taken as gross misbehavior.
    If a student voluntarily admits his guilt or there is the presence of mitigating circumstances the disciplinary actions which is a degree lower than what is stipulated in this Code may be imposed.
    On the other hand, the stiffer disciplinary action may be imposed if aggravating circumstances accompany the offense committed.
    ACSAT, in the exercise of its management prerogatives and inherent authority to disciplines, may imposed disciplinary actions to offenses analogous to or not stated in the table below.

Offenses Against Campus Peace, Order, Security and Safety.

    1) Instigating, inciting, provoking, leading or taking part in illegal and/or violent demostrations or activities, or giving active support thereto in any form or manner whether financial, physical or material
    2) Leading or otherwise taking part in any activity which disrupts school functions or adversely affects classroom instructions, whether such activity is sor is not accompanied by violence, such as disconnecting to tampering with electrical connections, switches, generators, motors, ir conditioners, fans, lights, and fire alarms; giving false alarms; shouting, banging doors, walls, tables, desks, chairs, and other acts of rowdiness and disturbance.
    3) Carrying explosives, firearms, knives orother deadly weapons of whatever kind within ACSAT premises.
    4) Detonating explosives or fireworks within school premises and its immediate vicinity.
    5) Assaulting, challenging, or committing physical abuse or any act of gross disrespect directed aginst fellow students, faculty members, personnel or threatening to do any of the aforementioned acts;
    6) Threatening, intimidating, coercing, harassing or provoking a fellow employee, adminstrator, student or parents at any time.
    7) Conviction by final judgment by any competent court of any criminal offense.
    8) Distributing any written or printed literature derogatory to the college.
    9) Membership in unauthorized organization.
    10) Hazing.
    11) Preventing, in any manner, school officials, faculty members and personnel and/or fellow students from performing their duties or exercising their rights;
    12) Lending, borrowing, tampering with and/or forging of certificates of matriculation. IDs, class cards, clearance certificates or other documents; or otherwise committing, allowing or abetting acts of impersonation and/or misrepresentation for the purpose of entering the school premises, enrolling, securing permits or taking of examinations; and
    13) Failure or refusal to wear the required ID and/or student uniform within the school.
    14) Loitering.
    15) Classroom mischief, failure to turn off or to turn cellphone to mute or silent mode.

Offenses Against Public Decency, Good Customs and Morals.

    1) Indecent exposure, gross immorality and other acts contituting scandalous and reprehensible conduct.
    2) Plagiarism.
    4) Use, possession, or trafficin, prohibited drugs illegal substances.
    5) Bringing alcoholic beverages or prohibited drugs in the school premises.
    6) Acts oflasciviousness; immoral or disgraceful conduct.
    7) Resorting to invectives, personal insults, black propaganda, or malicious imputations, oral orwritten, in order to discredit or ridicule school officials, personnel, faculty members or fellow students;
    8) Cheating in examination, bribary or effecting any chage of grades without proper authority.
    9) Entering the school premises under the influence of liquir or being in a state of drunkenness therein;
    10) Unauthorized solicition or bussiness transaction.
    11) Discourtesy and disorderly conducts towards co-students, employees, administration.
    12) Gambling,maintaining or participating in any game or chance within the school premises.
    13) Public display or romantic affection.

OFFENSES ENDANGERING HEALTH AND SANITATION

    1) Clogging of toilet bowls, unirals and lavaratories or causing spillage of waste and the like
    2)Deliberate concealment of serious a communicable disease which may endanger co-student,employees and administration.
    3) Smoking anywhere on campus.
    4)Spitting on floors or walls.
    5)Littering of paper or any form of waste within the classroom or other parts of th school premises.

Offenses Detrimental to the Property Rights and Interests OF ACSAT, Administration Officials, Personnel, Faculty Member and students.

    1) Misappropriation of or failure to account for funds belonging to ACSAT or any recognized organization.
    2) Unauthorized distribution within the school premises of subbersive materials, leaflets,handbills or other printed material whose authorship is not clearly or specifically stated therein;
    3) Robbery thievery and acts of malicius mischief involving school property or the memners of the academic community, including College guest and callers.
    4) Malversation of funds under one's care.
    5) Gross disobidience to or disregard of a lawful order or any faculty member or school official.
    6) Acts of vandalism,such as defacing and/or writing on walls, paintings, doors, desks, tables, chairs, etc; tearing of books, notices or circulars; destruction of window panes, toilet bowls, fans, laboratory equipment, water fountains, air conditioners, clocks and other school equipment or furnishings,
    7) Solicitation of money, donation or contribution in kind without the prior approval of ACSAT or the CHED or the TESDA
    8) Unauthorized use of the nade of ACSAT, ACSAT logo, ACSAT property, obtaining or attempting to obtain materials without official permission.
    9) Unauthorized removal or alteration of equipment tags, labels, signboards, etc.
    10) Taking examinations or attending classes without having duly enrolled therein or without required permit.
    11) Carelessness, improper or incorrect use of the school's materials and equipment.
    12) Improper use of school equipment or facilities.
    13) Use of school premises and/or facilities without prior authorization.

Offenses Against the Inviolability of School Records and Official Papers or Documents.

    1) Destroying, tampering with or falsifying school or student records.
    2) Knowingly using said tampered or falsified documents.

NOTE: Any offense not listed above shall be meted a penalty determined by the Disciplinary Board after observing due process.

    LEGEND:

      1 - Reprimand or Censure
      2 - Written Warning
      3 - Suspension

        3b - brief suspension (not exceeding 3 class days)
        3p - prolonged Suspension (exceeding 3 class days)

      4 - Exclusion
      5 - Expulsion
      Sanction shall depend on the serousness of offense; with reparation in cases where it is applicable.

      Note: A student who refuses to cooperate with the school authorities in any investigation violations of this Code (e.g. refusing to identify the student who violated a school regulation when he knew the offending student) shall be subjected to the imposition of serious penalties as stated in Manual of Regulations for Private Schools and/or Remedial Actions indicated herein.

      Section 8.

      Extent of Jurisdiction.

        Any offense committed against a member of the academic community as a consequence of the discharge of his duties, is cognizable by the Student Disciplinary Board.
        The school shall exercise its power over its students for acts committed outside the school and beyond school hours in the ollowing circumtances:
        1) In cases of violations of school policies or regulations occurring in connection with a school-sponsored activity off-campus;
        2) In cases where the misconduct of the student involves his status as a student or affects the good name or reputation of the school.

      Section 9.

      Government Action Not Prejudiced.

        Any action taken or penalty imposed under this Code shall be without prejudice to any proceedings under the laws of the Republic of the Philippines.
