As of this date, 06-08-05, this folder contains 1 item. ******* item 1 SOME WANT RIGHT NOT TO BE BORN ********************************************************************************************************* ******* item 1 SOME WANT RIGHT NOT TO BE BORN - The Vancouver Province Wed 12 Dec 2001 Editorial A14 Column Susan Martinuk ******* From: "Pro-Life E-News" via John Hof ******* Can a biological defect negate the value of a person's life? ******* According to the French courts, yes. ******* One year ago, a severely disabled boy won a landmark court case against the doctors who supposedly made the medical error of allowing him to be born. ******* Nicolas Perruche's mother thought she had contracted German measles during her pregnancy, but laboratory tests produced contradictory results and the doctor assured her that the pregnancy was fine. ******* But it wasn't fine -- Nicolas was later born with significant abnormalities, including an inability to hear, speak or see, a weak heart and mental retardation; he is confined to a wheelchair for life. ******* His mother subsequently sued, saying she would have aborted her child if the measles exposure had been confirmed. (Perhaps it's a good thing Nicolas is deaf.) ******* Since then, two high court rulings have affirmed this judgment and thereby cemented the legal view that a disabled life simply isn't worth living. ******* In both cases, the judges determined that disabled and Downs' syndrome children are entitled to compensation if their mothers weren't given advance warning of an abnormality and offered an abortion. ******* Ironically, in all these cases, there was no medical negligence that caused a deformity in the unborn children. ******* Yet French doctors, lawyers and ethicists are now saying that the rulings set a dangerous precedent and open the door to thousands of lawsuits by children who have any kind of imperfection. ******* Some journalists have referred to it as "legalized eugenics," and a leading obstetrician says the ruling "condemns doctors for not having killed" and encourages them to promote abortion at the slightest suspicion of any problem. ******* Doctors are now threatening to go on strike and, as of January 1, they will refuse to perform any prenatal screening tests -- the liability risks are just too high. ******* Medical technology has clearly changed our standards of human acceptability. Ultrasound, amniocentesis and genetic screening have all created the illusion that we can control our biological/ genetic destiny. ******* It has fed the absurd expectation that we can -- and therefore must -- have genetically perfect children and should reject anything less. ******* Consequently, 92 per cent of infants diagnosed with Downs' syndrome in utero are aborted; as are 80 per cent of infants with other genetic imperfections. ******* But we all carry at least five genetic defects of some sort -- so few of us could stand up to the rigours of perfection that we now require of the unborn. ******* And the medical technology that we are so willing to put our trust in is by no means foolproof. ******* A study in The Lancet reported on 174 babies that were diagnosed with abnormalities in utero, yet born perfectly healthy. ******* This suggests that we shouldn't be putting our faith -- and the full weight of the legal system --in their use. But the French have now done just that. ******* Sadly, the rulings imply that 1) It is better to be dead, than disabled, 2) Unborn children have a legal right to be aborted, and 3) Doctors and parents have a legal duty to protect that right. ******* For years, reasoned debate over the legal status of the unborn has been overshadowed by the battle for "rights." ******* Given this obsession, perhaps it isn't so surprising that the bizarre notion of a right "not to be born" is now becoming law. *************************************************** The material contained in this file is made available courtesy contributors and editors of Pro-Life E-News.
