A certain tract or parcel of land containing Six hundred and forty acres lying in Sumner County in the First District on the North side of Cumberland River, on the waters of the middle fork of Goose Creek; joining a two hundred and seventy four acre tract of John Paytons near the kobbs-Beginning in the North boundary line of said tract, thirty seven poles West from the North East corner, runs North one hundred and sixty poles to two large sugartrees and dogwood. This indenture made this Seventh Day of January one thousand Eight Hundred
Between James Haw of Sumner County and State of Tennessee of the one part &
James Frazor of the County and State aforesaid of the other part. Witnesseth
that the said James Frazor for and in consideration of the sum of two
thousand Dollars to him in Hand paid the Receipt whereof is hereby
acknowledged have granted bargained and sold and by these presents do grant
bargain and sell unto the said James Haw one certain tract or parcel of land,
containing one hundred sixty seven and a half acres, lying in Sumner county
on the waters of Drakes Creek it being part of a preemption obtained by Henry
Watkins bounded as follows beginning atg a stake Boxelder and Dogwood thence
East one hundred and one poles to a stake then south two hundred and sixty
five poles to a dogwood & elderberry west one hundred and one poles to a horn
beam dogwood & hackberry thence north to the beginning. Together with the
appurtenances thereto belonging to have and to hold the aforesaid tract of
land unto the said James Haw his heirs and assignes and the said James Frazor
for himself his heirs and assignes against the claim of all persons devised
by from or under him or any person under whom he claimes, will warrant and
forever defend agreeable to a former contract entered into by the parties, in

THE FAMILY OF GEORGE WINCHESTER FRAZOR AND MARY "POLLY" KIZER
(NOTE: I tried to be accurate. In some instances, I added whole names where the census enumerator only used initials and added first and middle names that I knew. I also added my own comments using parenthesis.)
George Winchester Frazor is the son of Major James Frazor (1759-1833). George Frazor was born ca 1795. Major James Frazor married Hanna Carr September 10, 1797. We have found nothing that indicates who George's mother was. The dates on Hanna Carr are 1775-1820, though most records indicate that she was born in 1771.
George Frazor married Mary Bates on November 27, 1820. The son of George Frazor and Mary Bates is

George Frazor married Mary "Polly" Kizer on November 27, 1821.

6. Francis Marion Frazor (1841- July 11, 1863)
Francis Marion Frazor was wounded and captured during Pickett's Charge at Gettysburg, Pennsylvania on July 3, 1863. He died in hands of the U.S. Army on July 11, 1863. He was buried at Gettysburg and his body was later exhumed and buried in the Gettysburg section at Hollywood Cemetery in Richmond, Virginia.
George Winchester Frazor, Jr. was in battles at Seven Pines, Cedar Run, Wilderness, Gettysburg, Petersburg. He was wounded at Shepherdstown, Virginia on September 20, 1862. A shell cut his gun into two pieces injuring his shoulder. He was hospitalized eight weeks. He was captured at Wilderness, Virginia on May 4, 1864 and exchanged on October 29, 1864. He was given a forty day furlough on February 10, 1865. He was paroled at Appomattox, Virginia on April 9, 1865.
John M. Frazor was wounded slightly in the leg at Murfreesboro, Tennessee on December 31, 1862. He was sent to a hospital at Atlanta, Georgia, where he died on March 5, 1863. He was buried at Oakland Cemetery in Atlanta.

WILLS AND SETTLEMENTS
ESTATE SETTLEMENT OF GEORGE WINCHESTER FRAZOR AND MARY KIZER FRAZOR
To the Hon. Geo. W. Allen, judge of the County Court of Sumner County
The bill of William Frazor, Theophilus Frazor, John M. Frazor, George W. Frazor, Elizabeth Hubbard, J. D. Vaughan and wife Mary Jane Vaughan, and Francis M. Frazor, a minor by his regular guardian Theophilus Frazor and James Frazor, Adm of G. W. Frazor and Mary Frazor, wife.
Complainants would show to the Court that they are the children and all of the heirs of George W. Frazor, except James Frazor who is the Adm of George W. Frazor, and that said George W. Frazor died in Sumner County in the year 1861, intestate, leaving a tract of land in said County containing 257 1/2 acres, situated in Dis. No. 9 on Drakes Creek adjoining the lands of Wm. Boyd, Mrs. Kizer, John E. Turner, Geo. W. Terry, and Wm. Frazor--they would show that the debts of the estate are all settled up, and that the widow Mary Frazor is now dead, intestate, and said heirs and children are anxious that said land be partitioned among them, and they would show that they think it would be to the interest of all parties to have said land partitioned. They would also show that Mary Frazor survived her husband but is now dead and James Frazor is her administrator, they would show that said Mary was the owner of two Negroes; a woman named Jane, aged 17 years and a girl named Tennessee aged about 6 years--they would show that it would be impossible to divide the two Negroes among the heirs and that it would be manifestly to the interest of all the parties in interest that said Negroes be sold for division. They would show that Francis M. Frazor is a minor now about 20 years of age and that Theophilus Frazor is his regular guardian, they would show that Mary Jane a daughter of Geo. W. Frazor has intermarried with James D. Vaughan. These premises considered the parties of age having a right to have their portions in the land set apart which would amount to a division among all as there is but one minor, ask that said land be partitioned among the children & heirs of Geo. W. Frazor, and that commisioners be appointed for said purpose and that the said Negroes Jane and Tennessee be sold for division among the children of Mary Frazor and they waive publication of the sale in a newspaper and grant to them such other and further relief as the nature of their case may demand.

Confirmed. ____ is appearing to the Court that the parties in interest were all adults except one and that they were entitled to have their portions in the land allotted to them, leaving the share of the minor to itself which would amount to a partition among all, it is ardered and decreed by the court that G. W. Terry, Hugh Kirkpatrick, Felix G. Tally, Lee Shute and Stephen Willis be appointed commissioners to partition the land described in the pleading into seven parts so as to give to each of the seven children of G. W. Frazor d'd and whose services are set forth in the bill an equal portions in value or as near so, as possible, and the said commissioners will return their report to the next time of this court if practicable if not, then to the March term--
And it appearing that it is inpracticable to divide the two negroes among the seven heirs, and that it would be manifestly to the interest of the minor that said negroes be sold; it is ordered and decreed that the clerk sell the two negroes mentioned in the bill at public sale on a credit of twelve months taking note with good security, except one hundred dollars cash out of which the clerk will pay the costs of this proceeding and will pay B. F. Allen a fee of thirty five dollars being a charge of five dollars on the share of each heir-the clerk will report to this court after the sale is made. There being no newspaper published in the county and the parties having waived a newspaper publication, the clerk will advertise the sale of the negroes by written notices posted at the court house door and at the places in the county, ordered that said sale be made at the late residence of G. W. Frazor d'd

This cause comes on for hearing before this 7th January 1862 before Hon. G. W. Allen judge of the County Court upon the bill of petitioners where the matter was referred to the clerk to take proof as to whether the land mentioned in the pleadings was susceptible of division partition and whether the negroes mentioned could be partitioned and whether it would be to the manifest interest of the minor that said slaves should be sold for partition. The clerk will report to the present term if practicable.

Be it remembered that on this the 7th January 1862 this cause came on for hearing before G. W. Allen judges upon the report of the clerk which is as follows

Juris petitioners William Frazor, Theophilus Frazor, G. W. Frazor, Jesse G. Turner & wife Elizabeth, formerly Elizabeth Frazor, David Vaughan & wife Mary Jane Vaughan, formerly Mary Jane Frazor, all citizens of Sumner County-and G. W. Terry, adm. of John M. Frazor and Marion Frazor dec'd would respectfully show unto Jesse Herron that John M. Frazor and Marion Frazor departed this life intestate and join petitioner G. W. Terry administrator in his estate. The remainder of Juris petitioners are the heirs at law of the deceased. All of petitioners are of age and claim in their own right, except Elizabeth, intermarried with Jesse G. Turner and Mary Jane, intermarried with David Vaughan. The two parties deceased left the petitioners their only heirs at law, and, ___, they did not have a joint interest in the land, still the petitioner has such an interest and ___, file this petition for the sale of both tracts.
Juris petitioners would show that John M. Frazor owned a tract of land of thirty five acres in Sumner County, adjoining the land of James Frazor & others. Marion Frazor owned a tract of forty acres, adjoined the lands of John E. Turner & others. These are all the lands owned by the deceased. There is plenty of personal property to pay the debts of the estate. The Court will see that said lands cannot be divided without a sale. It is thin and broken and has ___ little wood and timber. Juris petitioners would further show that it will be manifest for their interest to sell said land in order to divide the same. They therefore pray that said lands be sold upon such terms as to the court ___ with; and as in ___ ___ will we pray.

We are aquainted with the two tracts of land mentioned in the pleadings_one tract of 35 acres_The other of forty acres. The land is broken and thin_not valuable_very little timber-___wood on the 35 acres. The 35 acre tract belongs to John M. Frazor's estate. The 40 acre tract, to the estate of Marion Frazor. The heirs are five in number. The land could not, on account of its quantity and situation, be divided among thhe heirs. It is manifestly to their interest not to divide the land, but to sell it. Think it should be sold. The thirty five acre tract is worth ten dollars per acre, on twelve months credit. The 40 acre tract is worth ten dollars per acre on a credit of twelve months.

In the name of God, Amen. I, Sarah E. TURNER of Hendersonville, Sumner County, Tennessee, make this my last will and testament. I give devise and bequeath my estate and property, real and personal, as follows, that is to say, I will and bequeath to my son, M. P. HUBBARD, the homestead upon which I now live, consisting of (31 1/4) thirty one and one fourth acres of land, together with all of my household and kitchen furniture
excepting one feather bed which I devise to my grandson Jesse M. BOONE. The above named real estate and personal property to be equally divided between my son W. J. TURNER and my daughter Mary A. Knowing the certainty of Death and the uncertainty of Life and being
desireous to provide for those that is near and dear to me on
Earth I do constitute this my last Will and Testament revoking all
others.
1st after I am dead I will that my burial expenses be first paid out of
my money belonging to my Estate.
2nd I will that all my debts that I may owe be paid out of any money
belonging to my Estate and that enough of my personal property be sold
by my wife, Sarah E. Turner, to pay all my debts and expenses that may
occur.
3rd I will to my wife, Sarah E. Turner, all my landed or real estate
during her widowhood, and should at any time marry again then my land to
go to my two children, William T. and Mary R. Turner and any posthumous
child that she may give birth to after my death. Likewise I give her
all my personal property after my debts is paid, during her
widowhood, and should she at any time marry again then my personal
property to revert to my children as my land as provided for in the part
of this clause. Witness my hand and seal this 21st day of August,
