CEN-CON Update

Cen-Con took up discussion of the two proposed Centennial city ordinances on nuisances and over-sized vehicle parking at the January 7, 2002 meeting. Space does not permit reprinting of these two ordinances, but you may view the latest versions at the C-Watch web site, www.c-watch-news.com. Several concerns were voiced concerning the ordinances as currently drafted Cathy Noon, President of Cen-Con, prepared a letter to the city council with the following concerns:

1. Citizens are concerned that selective enforcement may occur if the system is complaint driven. Cen-Con would like the council to explore neighborhood mediation as an option for enforcement.

2. The nuisance ordinance in particular is quite subjective. What may be a nuisance to some is palatable to others.

3. Concerns were expressed over the definition of �commercial vehicle.� The ordinance may not allow personally owned vehicles marked with business names to be parked in a driveway. (Note: This is the current regulation in FoxRidge. You must park such a vehicle in a garage.)

4. The ordinances are too restrictive. Even so, the ordinance fails to address issues such as noise, snow removal, pet issues, etc., which some may consider to be nuisances and important quality of life issues.

5. Who will enforce the ordinances? The city will not have a municipal court until at least July. When does the fine imposed of $300.00 per day start? Will liens be placed on homes for enforcement?

The second of two public hearings on the ordinances will be held at 7:00pm on February 7th at Goodson Recreation Center on University.

 


One Down ...

Hard to believe, but I�ve been president of FIA for a year already. In my first Foxtales report last March, I said any accomplishments we achieved were going to be the result of hard work by many volunteers, Board, and Committee members.

The great news is that the level of volunteerism in FoxRidge is higher than it�s been in many years. You have a great Board and many other volunteers working on your behalf. Look in the other articles for all the things we�ve got going on.

 

Home Show - April 7th:

One upcoming event I�d like to let you know about is our second annual FoxRidge Home Show, an event where you can meet and talk with roofers, siding experts, deck builders, installers, concrete experts, etc. etc., see samples of their products and get a pretty good BBQ or hot dog. It will be at Homestead Elementary School, on Sunday, April 7th. Watch future Foxtales for more information.

More in 2002

We will be hosting a neighborhood-wide Spring Clean-up and provide roll-offs for large throw-away items, and a place to drop off remodeled items that are still in good condition � sinks, doors, cabinets, lighting fixtures, and appliances � to be donated to charity home builders.

In the coming year, we hope to continue the momentum that�s building to beautify FoxRidge and raise the standards of community maintenance and involvement. Let us know how we�re doing!!


Money in the Bank

We finished the year with a little bigger balance than we had at the end of 2000, but we are expecting some large bills (e.g. printing and postage for the recent big mailing) still to arrive.  Let me urge you to pay your 2002 dues A.S.A.P. to reduce the chance that we could have a month or two with inadequate funds.

I have spent about 6 months on the Board, and have been impressed with my fellow members � they are hard-working and well-intentioned.  Thank goodness we don�t always agree on things, but we sure do all agree that we want FoxRidge to be the best community that it can be ... with your help, of course.

Residents Speak Out!

FROM:  Bryan Kramer, Foxridge West    As we started to 'expand' ourselves into our basement - finally putting carpet in and adding furniture - I started to recall haunting stories of people's washing-machines or water-heaters going bonkers and flooding their basements. So, I set out to mitigate this threat with my 'Project Watergate'. 

I tested our sump-pump to verify it had the reliability and power to pull large amounts of water from the basement, made sure it had an overflow lip if the floor-drain were to back-up or clog, and water could pour into it's well and get drawn out of the house that way. After that, I drew up plans to isolate all areas of the basement that had water-using appliances so that if they were to fail and water were to hit the floor, it would be contained and directed into either the floor drain or the sump-pump well. Most of the basement layout was fine - but the two doorways (one into the laundry room and one into the utility room) were risks. I addressed these by putting a 2x2 across the entryway on the floor. Then we used silicone caulk and sealed the floor edges around the entire interior of the 'at-risk' areas - basically making a 'water gate' of up to 1.5". If the water level rises over this - then it won't hold - but hopefully by that time the sump-pump would kick-in and rescue our carpet from a disaster.

Total project cost - probably about $20 for lumber and caulk! I was a little concerned that the 2x2 would cause us to 'trip' going into those rooms - but you get used to it being there & just always step over it.

FoxRidge Social Club

Joining the FoxRidge neighborhood is more than buying a house. In order to make it a home you need a loving family and FRIENDS! Do you want to connect with your neighbors and develop friendships? Well, we would like to try something new to help you along in the form of the Foxridge Social Club.

HIGHLIGHTS FROM AMENDED RULES & REGULATIONS

You have already received amended versions of the Articles of Incorporation and the Corporate By-Laws.  These are governing documents and are important for setting the general guidelines, responsibilities, authorities, and processes of the FoxRidge Improvement Association. 

Changes for Non-profits:  This is the first time these documents have been updated since the inception of FoxRidge, and several State-related issues for non-profit organizations are out-of-date.  We also took the opportunity to better define some of the parameters of the Association.  Changes to these documents require approval by a majority of Active Members of the Association.

Rules & Regs:   Another important governing document is the Rules and Regulations.  It helps to clarify procedures for interpreting and enforcing Covenants and responsibilities of the Board, the A.C.C., and the Appeals Committee. This document was last updated and properly filed in 1984, and changes require approval by a majority of F.I.A. Board members rather than active members.  The Rules & Regulations deal with specifics whereas the former documents deal with generalizations.  The Rules & Regulations can also be updated annually at the discretion of the Board.

Power:  The Board receives its power from the original incorporation and the Covenants.  There have been many efforts to update our many documents over the years, and many residents are unsure of exactly which are valid.  Don�t feel alone, the Board is finding out new information all the time. 

Valid Filings:  All valid governing documents will be filed with the County (and probably the City after Feb. 9) and are available to any resident.  

Four documents:  The approved Rules and Regulations together with the two documents you recently received by mail and your original Covenants that you received at the closing of your home (not the 1983 version) make up the four valid governing documents for you reference as a member of FoxRidge.

Draft Version:  The Draft Version of Rules & Regulations will be available for resident review and feedback at the Annual Meeting on Monday, Feb. 11th.  Comments will be incorporated into the Draft document and the Amended Rules & Regulations will be presented and voted upon by the Board at the April meeting.

What�s in the Rules & Regs?:  The Rules & Regs can not contradict nor change the Covenants.  They are intended solely to clarify and to state obvious �good neighbor� behavior.  Here�s a few:

     Cars are allowed to be parked in the front of your house on the driveway or street only � no exceptions.  Homes with a two-car garage may contain an additional gravel, brick or concrete driveway to allow you to park a car, commercial or recreational vehicle on the side of your home as long as adequate screening from the street is provided for and approved by the ACC.

     Fines can be assessed by the Association for non-compliance with Covenant enforcement.  This is not new, but prior interpretations were unsure of this authority because many times dues and assessments are considered the same � and we know dues are voluntary.  However, fines are mandatory.

     All exterior changes require A.C.C. approval.  Again, not new, but much better defined.  Yards must be kept landscaped, trash, and weed-free/leaf-free so as not to disturb neighboring tidy yards.  This is a common courtesy and not a problem except in the rarest of cases in FoxRidge.

     Sign regulations haven�t changed.  Still only allowed to have one �For Sale� sign, but parameters are better defined.

     Motor homes, boats, other recreational and commercial vehicles still have limitations on how long they can be parked in your driveway � 48 hours to load and unload.  The City is looking at stricter limitations on street parking of large vehicles, too.

Our Covenants have teeth ... and the Rules & Regs are like a freshening mouthwash that makes them acceptable to everyone.

BEFORE Replacing Your Roof

The A.C.C. approval process has not changed.  If you�re in a hurry, homeowners can begin a roof replacement with an approved product and a verbal approval prior to receiving formal written approval from the ACC.  However, homeowners still need ACC Approval - in writing - when the roof is being replaced � with product and color and name of contractor. 

Also, there are a few limitations placed on contractors replacing roofs (or conducting any home improvement project).

1  Debris must be collected and disposed of daily.

2  If a dumpster is used by the contractor, it must be removed immediately upon the projects completion.

3  No contractor advertising (signs or banners) are allowed to be displayed in your yard per our Covenants.

GREAT WALL?!

The new  entrance at Niagara Street and the concrete wall along County Line did not turn out quite as expected. The walls are five feet higher than anticipated, and the East and West sides do not match in height and curvature. More importantly, this intersection may pose a safety issue. A difficult line of sight, tall medians and no Westbound deceleration lane make the turn into and out of FoxRidge a potential hazard.  Members of FIA met with CDOT, Arapahoe County and Mayor Randy Pye of Centennial to express our concerns and disappointment about the completed project.  CDOT is re-measuring line of sight issues and traffic flow patterns, and should have a pleasing and safe solution soon!


NEW SIGNS ARE COMING!

FIA has contracted with Precision West Signs to replace our worn out signs (Racquet Club, Hillside, etc.) and add additional signage into our neighborhood.  New entrance signs  will match those currently at Otero and Holly and will be placed at (1) Poplar/Quebec, (2) Monaco/Mineral, (3) Monaco/Magnolia, (4) Niagara/County Line.  Signs will be placed on brick monuments with metal lettering to identify our neighborhood.  If the weather cooperates, we hope the project will be complete by mid-spring.


WOULD TRAFFIC CALMING WORK

ON MINERAL AVENUE?

FoxRidge resident Lyle Ewert attended the January FIA meeting with a request for support for a petition he will be circulating to present to the local traffic engineering department. For those of you who don�t know Lyle, he is the gracious gentleman whose backyard sits on the northwest corner of Mineral and Niagara Way, and whose fence is demolished 3 or 4 times every winter by drivers who lose control of their cars on the slippery westbound stretch of Mineral. Lyle simply wants to find some solution to his fence destruction problem, and to stop being on a first name basis with every auto insurance adjuster in town. The FIA board voted to support Lyle in his endeavor, and the board welcomes any suggestions that neighbors may have to help Lyle in his quest.

After a presentation at Cen-Con by traffic engineers from Aurora and Golden, it was noted that traffic on westbound Mineral might be slowed with the use of one or more �traffic calming� techniques now used successfully by those cities, among others. Speeding on Mineral is nothing new. We�ve all seen the mobile speed monitoring trailer set up near the park. Studies have shown that people slow down for a few days after the trailer leaves, and then everybody speeds up again. In one neighborhood, a city council person actually increased speed to try to see how high the speed monitor could go! Studies have also shown that by narrowing the roadway, traffic has a tendency to slow down.

Without going into the seven major methods of traffic calming, it seems that a couple of them might be worth considering on Mineral. A full, two-block median might be effective from Oneida west to Niagara Court. People might slow down as they approached the east end of the median. Another option would be to raise either the intersections at Mineral and Olive Court and Mineral and Oneida, or the crosswalks from the pool to the park and the trail to the north side of Mineral, thus slowing down the traffic east of and before the curve begins. A third option used in some neighborhoods would be traffic circles strategically placed along Mineral. Each of these has its pros and cons from a safety standpoint. I understand the fire department is not crazy about the raised areas because they can slow them down, too. All options are expensive.

I�m no traffic engineer, but something needs to be done to correct the longstanding problem that our neighbor Lyle is forced to deal with much too often. I think most of us would like to see traffic slowed on Mineral, even if it just gives us some piece of mind that our kids may have a fighting chance when they cross that street.

What Does $38 Get You?

Dues are being increased for the first time in 10+ years, and it�s a good time to recall what you�re getting for your hard earned money.  Without someone to look after these things, this would NOT be a neighborhood that you would want to live in.

     Maintain a consistent look throughout the neighborhood -which maintains and increases property values.

     Enforce Covenants, and mediate between neighbors when an issue cannot be resolved face-to-face.

     Coordinate improvements in common areas, such as new landscaping, utilities maintenance and clean-up.

     Work with County, City, and other Agencies to improve perimeter areas and to resolve safety and traffic issues.

     Facilitate use of G.I.D. funds for the overall benefit of the neighborhood, such as signage, fencing, trail clean-up bins,  etc.

     Help integrate neighbors through social activities, such as the Home Show, Spring Clean-up, Book Club, Bridge Club, and Annual Picnic.

     Communicate concerns and changing issues through the Foxtales newsletter and off-set costs through ad sales.

     Having someone to call and complain to ... priceless!

Budget (Burt) :  Email proxy vote to accept proposed 2002 budget and increase dues to $38/year.  Vote carried.  FIA is current with obligations.  Burt recommends maintaining a higher residual balance in 2002 as revenues are unpredictable (percent of HO paying dues and revenue from �Foxtales� advertising.)  2002 Prediction is 59% of HO will pay dues and become �active� members of association.  Printing, prep and postage cost to mail out packet containing Bylaws, Budget and Articles of Incorporation was nearly $2,000.00

ACC Approvals (Ken):  11 roofs, 1 window and 1 deck this month.   ACC will divide responsibilities (paint, roof etc.) among the 3 ACC members.  FIA Home Show is tentative for Sunday, April 7th.

Covenant Violations (Anita):  3 reports: (1) vehicle that has not been licensed since 1996 was reported to the county.  (2) HO not taking care of leaves/lawn.  (3)  roof that has been installed that is not the correct color.  Continue to follow up.  Continuing to remove illegal signs from neighborhood.

Consolidation (Anita): Rules and regulations - Need notes from board members, particularly on fine structure.  Rules and Regs should be available for annual meeting in February.  50% of �active� members (dues paying) must approve Bylaws and Articles of Incorporation.

Maintenance (Katie):  Fence damage at 6682 So. Niagara Way.  Cars have struck this fence 4 times since October, 2001.  FIA and HO are petitioning the county and City for safety assistance.  Want new crosswalk at the park crossing at Mineral & Magnolia Way.  Sign work should begin soon.

Landscaping (John): Attempting to coordinate landscape efforts at Niagara St. & County Line with Church of Latter Day Saints (NE corner). Spoke with Jim Priddy of So Suburban � want to look for places to improve look of neighborhood.  Bob Datson noted a �master landscaping plan� that we�ve working from. Upcoming:  landscaping Locust Way �dead end�at County Line, replacing red rocks along Mineral at Monaco,  replacing trees along Mineral.

CEN-CON:  (Michael):  Work on regulations regarding oversize vehicles and �nuisance ordinance.�  Hearing at Arap. Cty. Infrastructure Building 1/31/02. Presentation on �traffic calming� (e.g. traffic �humps� rather than speed bumps)  Big discussion - allowing commercial traffic at Centennial Airport. City needs revenue, but citizens do not want the noise and security issues.

GID (Bob B.): Currently $54,000 plus $48,000 will be added for year 2002.

Foxtales (Anita): Surpassed projected revenue ($7800) and income was ($9903).  Goal for 2002 is $11,000. 

County Line Road Improvement (Jamie): Still waiting for F/U on dimensions of the wall.  CDOT is trying to locate paper trail that led to the wall and intersection turning out the way it has.

NEW BUSINESS:

          Job description for Resident Manager.  Criteria: great deal of people and organizational skill; an appreciation of the need for documentation.

          Need �professional signs� announcing FIA meetings


NEIGHBORHOOD VOICES

Several residents have volunteered to help with the most important job of the association:  to facilitate communications between neighbors.  Sometimes it is easier to bring up a concern with someone who lives on your street than to a Board member that you�ve never met.
