IF DEALING WITH "SPA WAREHOUSE" IN UNION, OREGON. OR JUST
ORDERING FROM A COMPANY OUT OF TOWN BY MAIL OR ANY OTHER MEANS KNOW YOUR RIGHTS.
Did you know that if you purchase mechandise that you ordered
over the phone or by mail, and not at the companies place of business, you have
(3) working days to return that merchandise or product for a full refund? (I
didn't). If the company is out of town, or not, they have (20) days from the
time you notify them to pickup their product and refund your money (or) the
product and the money becomes yours. This is one law everyone should read up
on and be aware of, especially when ordering a product from a out of town source.
Our nightmare started in July of 1999 when we decided take our savings and purchase
a spa for the family, we shopped around town and priced different model's and
features and found them to be more expensive than we had planned on. I work
for a Little Nickel Publications where we were running an ad that came to us
by way of a program called adlink, these ads are placed in several publications
in many areas, they are placed usually by out of town companies or private parties
that want to reach other towns or states. Through this program I came across
an advertisment for Spa Warehouse in Union, Oregon. This ad sounded very promising,
you could purchase a spa or hot tub with all the whistles and bells, free delivery,
setup, the works, all for $1500 more or less than our local companies. We called
the company, sure enough, they could put us into a 8x8 spa with 53 jets, 2 5-hps
motors, the works for $4600. this was unreal to us, the owner sent us a sheet
showing they had top notch people contracted in our area to do all their warranty
work, parts, etc. They claimed they could dispatch these people out to solve
any problmes we may encounter. The term "if it sounds to good to be true, than
it is" should have applied here, (but) greed set in and took over and we ordered
a spa from this company. ON the following Friday the spa was to arrive from
La Grand, Oregon, we had purchased tickets for that night to see "Alabama",
the driver was suppose to be at our house by 5:00-5:30,the concert was at 9:00,
(no problem). The Spa Warehouse requested that we supply 3 or 4 guys to help
with the unloading and positioning of the tub, they would only be sending one
man, (we agreed). Friday came and the driver was late, we missed our concert
and were not happy, but we realized things happen, we didn't complain. The drive
arrived before dark,we paid him $4600 cash, we placed the tub on our patio he
told us a few things about the tub and left, we hadn't realized till he left
there were no digital controls, everything was push buttons and operated off
air, our mistake, we should have looked, before paying. That night we got the
tub filled and right off the bat we had problems with the buttons for the jets,
and we couldn't figure out why the water level was off, it didn't line up around
the tub, it was fuller on one side. We felt this was a good time to call Spa
Warehouse well we were in for a surprise, the owner whos name was Ron Morris
didn't seem as concerned about the problems we were haveing as we were, he wanted
my husband Robert to run all over town and purchase plastic line used in aquariums
to try to fix the jets, and not to worry about the water line being off. We
new at this point we messed up with this company, we asked Ron, the owner to
send someone out, he said he would be in town in a few weeks and would come
by than, this was by far not what he told us before he had our money, he said
he wouldn't send anyone over unless it was an emergency, we were at his mercy
that night and by the next day it was even worse, the tub had started to collapse,
the spa was caving in, it was seperating from the tub cabinet, we called Ron,
he said we were exaderating, (huh) excuse me but this tub was collapsing, he
said that the fact the caulking had seperated from the tub and was coming up
was just cosmetic,he could fix this, (right), what actually happened is the
spa had collapsed, this was becoming a nightmare and overnigth at that, we couldn't
reason with him by Saturday evening, so we told him we wanted our money back
and to come get his tub, he refused and said we would never get our money back
and that we just wanted to mess with him, and that we were complaining about
nothing, "yeah right". Under the tub I found a paper that stated we had 3 working
day to "void this transaction", we called him, he said no, I called the BBB
for Oregon and Wasington they told me it was the law, 3 days, full refund, they
put me in contact with the Attorney Generals Office, they told me to send his
letter to him registered mail so it would reach him in 3 days, we did, in the
mean time we contact all the companies associated with this spa, the spa maker,
the company for the motors, etc. Told them what Ron Morris had done to us, they
were mad, we took pictures and sent them, they said the spa had not been braced
and had collapsed, no longer any good and not to use it. Over the next few days
they contacted Ron and he receive the registered letter, he called and called
us name for medling in his life, calling the people who supply him, he also
said he would give back our money as soon as we deliver the tub to Oregon, no
way we said, you have 20 day to pick it up and give us the money back, he said
no, we told him to read his own letter, he did and called us back later, he
said, I will be there on Friday to pick up the tub and give you your money,
no appology, nothing, just mean words. We did get our moneyback, it ruined our
vaction, and we missed our concert, but he didn't care, this man is rude. Please
use caution when dealing with out of town or mail order companies, check out
your rights first and their warranties. Don't go through what we did. Not all
companies are like Spa Warehouse, there are good companies you just to find
