Yes, it's judicial activism, but the US Supes on the First Amendment concern me more. He says it's the end of marriage, and I think if no-fault divorce and sleazy reality shows didn't kill marriage, this won't. Marriage is more a church thing than a civil thing in my opinion anyway. My biggest concern is constitutional amendments, etc. The Constitution is not supposed to cover social mores. I would vote against an amendment.
