Updating methods to obtain an equal justice system for all citizens.
Dear Citizens of Illinois and the United States of America.
Vote NO for judges in all retention elections until judges are required to follow the law 100% of the time through an immediate appeal system before common citizens, and until we have an improved system that "elects" and educates qualified citizens to be judges. Reasoning: Consider my case file, number 06-CM-700, that is open to the public in the Henry County Courthouse in Cambridge, Illinois, for reasons to work for new methods to obtain an equal justice system.
Part of my opening statement (Day 1, p.17) to the jury on August 28, 2008, is the following: "I believe I have been falsely charged with Criminal Trespass to Real Property when, on December 10, 2006, I was arrested as I was peacefully sitting in my church, Concordia Evangelical Lutheran Church of Geneseo, IL, about 10 minutes before the 8 AM public worship service began. I have plead, and continue to plea, not guilty. I am very passionate about my legal rights, honesty, and equal justice under the law." Day 1 and 2 proceedings were filed on September 11, 2008.
Most of my defenses were filed April 11, 2007 as Exhibit #2 in my reconsideration Motion (to dismiss) Reply and included: Religious Freedom in the U.S. and Illinois Constitution's bill of rights; the law does not apply to a building open to the public; the law does not apply to an owner, as I was as a voting members of Concordia; Concordia did not ask me to be off the property, nor authorized an agent to order me off the property. Therefore when the Geneseo officer arrested me he violated those rights. I told him three times before he arrested me that I had the right to be there.
In the July 15, 2008 Pretrial hearing Presiding Judge Stanley Steines improperly denied me the right to use the bill of rights as a defense in my jury trial. You can read about that in the hearing transcript in my Objections to Orders filed September 5, 2008 as Exhibit #5, page 9. Judge Steines made this order even though he stated, lines 14-15: "Certainly, the Constitution prohibits the Government from saying you can't be there, ..." You and I know that the arresting police officer is an agent of the government (Geneseo), therefore my arrest was improper!
Also in the July 15th hearing Judge Steines improperly denied me the right to enter the arrest law, [720 ILCS 5/21-3(a) (Vol. 6, page 1602)], as my Trial Exhibit #1. You can read about that on page 15 of that hearing transcript. The arrest statue states the following exception in subsection 21-3(a) of the law, Section 5/21-3: "... this Section shall not apply to being in a building which is open to the public while the building is open to the public during its normal hours of operation." The jury should have read this because Concordia1s Sunday morning worship services are public service therefore the building was open to the public at the time of my improper arrest!
On September 17, 2008 Judge Steines improperly denied my motion for a new trial because Assistant State1s Attorney Brian Kerr did not follow the Rule of Professional Conduct and other requirements when he: did not provide all relevant evidence; failed to provide all relevant witnesses and/or expert witnesses to repute Roth claims of his rights; and he made improper remarks in his closing arguments, especially his telling the jury that Concordia Lutheran Church didn't have to abide by their constitutions and bylaws. That false statement is recorded in Day 2 proceeding pages 50-51, lines 24-2. It should be noted that the State entered the church1s constitution and bylaws (Day 1, page 45) as State1s evidence and questioned Concordia members on it. I should have been given a new trial because the State mislead the jury with that statement and attorneys are required to be candid and honest by the Illinois Supreme Court's Rules of Professional Conduct.
I am telling you this because fairness and justice for all people is what I value, I hope it is what you valve. I know that asserting these values is essential to a healthy life.
