These three recorded documents claim to be the CCR's of Sea Crest:

1988 CCRs

Hunter Quistgard aquired Otter Village in the late 1980's. He replated it
as Sea Crest and recorded CCR's in 1988 that were largely based on the Otter
Village CCR's recorded in 1981. As the 'declarant' of the CCR's, he had the
power to appoint three of the five board members and change the CCR's.


Amendment 1

Hunter Quistgard agreed to end his control over the Association as 
the 'declarant' as part of the settlement of the litigation with the
Inn at Otter Crest in 1996. After the settlement was signed, Equitable
Capital Group, a lender to Hunter Quistgard, and Hunter Quistagard 
claimed that ECG had actually been the declarant during the previous four
years of litigation and just didn't tell anyone so Hunter Quistgard's
resignation as declarant was meaningless. The Sea Crest Board 
contested this claim. ECG then sued the board. An out of court settlement 
was reached whereby ECG agreed not to pursue its claims as long as it was
satisfied with the Board�s management of Sea Crest. ECG recorded this
first 'amendment' to the CCR�s without a vote of the members in 1996.

Amendment 2

A different board in 1999 claimed it had the right to make amendments 
to the CCR�s without the approval of the members. Amazingly, they based this
on the further claim that ECG was the declarant.

This second 'amendment', recorded in February 2000, was never voted
on by the membership. It added the rule against removal of any tree 
four inches or larger and fines, which were not in the 1988 CCRs.
