I now see that since i started trading, the fansub distro and trading community has changed more than i thought that it ever could. I now see that CD trading is almost out of "style", not even mentioning VHS tapes. I can get more anime on downloading programs such a IRC in one week than i can get from trading in one month (I have over 60 CDs i burned from downloading from IRC in less than 2 weeks. :) If you still want to concern yourself with the rules below, I can still trade media for media. If you are interested in trading besides cds though, i am open for online trading as well. I can trade with AIM or mIRC. E-mail me, for more information.
------------------------------
Just a few things that need to be noted.
If you are interested in trade, E-Mail me at [email protected] with your list or where to get your list and what you are interested in of mine.
If this is the first time we've traded and you approached me, I will have to recieve your end of the trade or recieve some kind of shipping confirmation before I send my end. If we've traded before hopefully we will be able to trust each other enough that we will both ship at the same time.
I will do international trading. Please ask me.
We can discuss shippng methods. If possible, include insurance and tracking. If a package is lost in the mail before it gets to me, you are responcible. If it never makes it to you, i will replace the trade at no cost to you.
As of recently (this year) i have gotten more into cd trading than in tape trading. It has become too much hassle to hook up 2 VCR's (I have to borrow one to do it). If there is a tape that you can get no where else, i could do it for you.
I do not trade tapes for cds and cds for tapes. I trade the two based on the cost to buy and ship the two. I will trade 2 CDS for a tape, or 1 tape for 2 CDS. I would expect the same curtosy back.
Please record on new tapes, in SP mode, and please somehow label the tapes (or CDs) you send. (DO NOT USE BALL-POINT PEN TO MARK CDS)
Please no mixing tapes. If you pick two tapes that only fill up half, i can combine them if you request.
I can put anything you want on a CD, be it episodes, music, etc. If there is extra space, what would you like to fill it with?
If you settle a trade with me, PLEASE follow through with it. I have had a few times where a trade was settled, and the person forgot about the trade. I understand, but I would also like to be notified of any changes. If you request a trade from me, and I agree with it, Please E-mail me back, and tell me when you plan on sending the tapes or CDs. It doesn't have to be an exact time, if you tell me you will send them in a couple of weeks- that's fine. But I don't want to make tapes when people suddenly decide they don't feel like trading.
I would rather trade with TDK, Fuji, or Maxell brand tapes. I ask that you also use quality tapes (that have not previously been taped on) when you trade with me. Please don't use Sony V brand tapes when you trade with me! I used to trade mostly with these tapes. But experience has shown me that Sony V tapes seem okay at first- but they seem wear out quickly. I would also *rather* you not use RCA tapes either. I have gotten lots of tapes on Fuji, TDK, and Maxell and so far I have not had any problems with them wearing out.
The minumum tape request is 1, the maximum can be agreed upon later.
The Maximum CD trade will be ~20 CDS per trade (unless this is not our first trade)
If you have a fear of things "13", sorry. I have 13 rules and "Quatre Horrace" has 13 letter!
If you ever wondered why trading anime was legal, here are some pieces of copyright laws that apply:
Fair Use Doctrine:
PUBLIC LAW 94-553--OCT. 19, 1976
107. Limitations on exclusive rights: Fair Use
Notwithstanding the provisions of section 106 amd 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by and other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determing whether the use made of a work in any particular case is a fair use the factors to be considered shall include -
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work. [there is no market for these items in the US currently]
Japanese Copyright Law:
Subsection 5
Limitations on Copyright
(Reproduction for private use)
Art. 30.-(1) It shall be permissible for a user to reproduce by himself a work forming the subject matter of a copyright (hereinafter in this Subsection referred to as a "work") for the purpose of his personal use, family use or other similar uses within a limited circle (hereinafter referred to as "private use"), except in the case where such reproduction is made by means of automatic reproducing machines ("automatic reproducing machine" means a machine having reproducing functions and in which all or the main parts of the reproducing devices are automatic) placed for the use of the public.
(2) Any person who, for the purpose of private use, makes sound or visual recordings on such a digital recording medium as specified by Cabinet Order by means of such a digital recording machine as specified by Cabinet Order (excluding (a) machines having special characteristics generally not employed for private use, such as those for broadcasting, and (b) machines having recording functions incidental to the primary functions, such as telephones with sound recording function) shall pay a reasonable amount of compensation to the copyright owners concerned.
(Reproduction in libraries, etc.)
Art. 31. It shall be permissible to reproduce a work included in library materials ("library materials" in this Article means books, documents and other materials held in the collections of libraries, etc.) within the scope of the nonprofit- making activities of libraries, etc. ("libraries, etc." in this Article means libraries and other establishments, designated by Cabinet Order, having the purpose, among others, to offer library materials for the use of the public) in the following cases:
(i) where, at the request of a user and for the purpose of his own investigation or research, he is furnished with a single copy of a part of a work already made public or of all of an individual work included in a periodical already published for a considerable period of time;
(ii) where the reproduction is necessary for the purpose of preserving library materials;
(iii) where other libraries, etc., are furnished with a copy of library materials which are rarely available through normal trade channels because the materials are out of print or for other similar reasons.
