I Martha C. Carden, widow of John Carden, deceased, hereby relinquish my right under the laws of the State of Alabama, to administer on the estate of my said husband who died intestate in said county on the 5th day of June 1908 and I recommend T.C. Phillips who is son-in-law of said John Carden as being a suitable person to administer said estate. M.C. Phillips, respectfully represents that John Carden departed this life at his residence in said county on or about the fifth day of June 1908, leaving no last will or testatment as far as your petitioner knows or beleives and that his death was known more than fifteen days before this day and this petition further shows that they, the said John Carden was at the time of his death an inhabitant of this county and state of Alabama and died seized and possessed of real and personal estate in this said state consisting chiefly of N 1/2 of SE 1/4 & N 1/2 of SE 1/4 of Sec. 6, T 9, R 11 , Marion County ALabama and 2 mules, 2 cows, 1 heifer yearling, 1 two horse wagon, 1 single buggy, 1 soghum mill, 1 sewing machine, 1/2 interest in seperator run by horse power and other personal property all of said real and personal estate being estimated to be worth about $ 3500.00 dollars and proably not more. That the names residence , ages and condition of the heirs and destributors of the estate of the said decedant to far as your petitioner knows beleives are as follows: Widow, Martha C. Carden, aged 48 yrs. Paul Carden, a son, aged 6 yrs. Roy Carden, a son, aged 3 yrs. Maude Carden, a daughter, aged 12 yrs. Robert Carden, a son, aged 18 yrs. Georgia Floyd, wife of Charley Floyd age 16 yrs. , said Charley Floyd is 19 yrs. of age Lillie Hall, wife of George Hall, age 20 yrs. Andy Carden, a son, 22 yrs. of age Reuben Carden, a son, age 27 yrs. Anne Crow, wife of Jounce Crow, , age 25 yrs. Ella Phillips, wife of T.C. Phillips, age 31 yrs. James P. Carden, a son, age 40 yrs. all of the above reside in Marion County ALa. except Andy Carden , who resides in DeKalb County Ala. , P.O. Box address Albertville, RFD # 2 B. Carden , a son, age 38 yrs. , who resides at Keener, DeKalb County ALA. rfd, #1 Lela Crow, wife of Berry Crow, who resides in Franklin County Ala. , Phil Campbell, RFD # 2 and three children of Addie Beavers, deceased, who was a daughter of said John Carden, two of these children are girls, aged about 21 & 18 yrs. Laura, Beavers, age 18, Allie Beavers aged 21 and a son Horace Beavers , age 13, who reside with their father, John Beavers in the State of Texas, when last heard from his P.O. Box was Collinsville Texas. all of the above heirs and destributors, of the estate of the said decedant are of sound mind. That the said Martha C. Carden, has declined to administer the said estate as appears from the relinquishment heretofore said attached, that your petitioner being a son-in-law of said deceased, an inhabitant of this state above the age of twenty-one years and in no respect disqualified under the law from serving as an administer believing that said estate should be immediately administred to the end that the said property may be collected and preserved for those who shall appear to have legal right or interest there-in doer? therefore by wituer? of his right under the statute pray that your Honor will grant letters of Administration to the petitioner T.C. Phillips, on the estate of said John Carden deceased, upon his entering into bond in such sum as is required by the statute and with such security or securities as shall be approved by your Honor.
