In consideration of the above and foregoing, SELLER agrees to sell and PURCHASER agrees to purchase the above described pup. All funds are in US currency. PURCHASER agrees that the Deposit is nonrefundable unless the SELLER is unable to deliver the pup(s) from current year litter. SELLER warrants that she is the owner of the above described pup and has good title to the pup(s). Title and possession of the referenced pup(s) shall remain with the SELLER until all funds submitted as payment for the purchase have been received and cleared PURCHASERS bank.
The pup(s) is/are in good health at the time they leave SELLERS possession. The pup(s) is/are warranted against the existence of communicable pre-existing diseases at the time it leaves possession of SELLER. Due to SELLERS inability to control conditions once pup(s) leave SELLERS possession, SELLER'S warranty is expressly conditioned upon PURCHASER obtaining a physical examination (with supporting lab work to rule out communicable diseases), by a veterinarian, who is a member of the Association of Dog Veterinarians within three days of receipt (Sundays/Holidays excepted).
