| I think that ebay has an obligation, moral for sure and probably legal , to compensate Alisher's victims, especially in this case. This case is a new and special type of crime. You see crime up to now, either on ebay or elsewhere, was perpetrated by unscrupulous sellers, mostly one customer at a time and at different times. Let's call these people serial fraudsters. Alisher's, (alleged?, just to keep the legalities), fraud has the dubious distinction of being mass fraud, in that many customers were defrauded at the same time! It appears the term is so new that even google came up with only a few hits, when I searched it after I wrote about it in one of my replies at this forum. I assume no legal precedent exists for such a newly minted crime as far as ebay's liability is concerned. In the links below on a similar but worldwide ebay scam the perpetrators were caught with the help of Western Union employees and brought to justice. But no iformation on any ebay liability or settlements is available on this European originated mass fraud at this time. But I think we may have hit on something here. The computer age is still teaching us so many new things. And the criminal mind follows close behind dreaming of new crimes. But if we can identify these newfangled crimes and name them , then like in the case of Rumpelstiltskin we can make them go away! At least let's hope so.
Mass fraud, by definition, represents a massive breakdown of the ebay system. Therefore the system that created it has to be held accountable for this new type of crime. If legal means are the only ones available for fixing it, so be it. For anyone that doubts as to the course they have to take in this case, I think that mass fraud speaks for itself. Mass fraud doesn't grow in a vacuum. The ebay system nurtured it. There must be some accountability for that somewhere in the ebay system. The system keeps producing them! Mass fraudsters is a new breed of fraud artist. These fraud perps are computer assisted. They just copy and paste auctions creating illusions of products for sale that don't exist. Copying and pasting is so easy with computers! Victims are produced at the speed of a mouse click! But you cannot copy and paste money and you cannot copy and paste cameras and other goods. You must physically manufacture them! And go to work to get your money. Mass fraud is a by product of the ease of copying and pasting! If computer assisted scammers are left unchecked the whole justice system will fall dangerously behind, and technologically so, with terrible repercussions. It behooves all concerned to meet the challenge of mass fraud using a massive amount of Justice aided by a massive use of computers.
