NAME: BIRTH: DEATH: Martin Henry Sims 13 Jun 1864 11 Sep 1917 CEMETERY: LOCATION IN CEMETERY: Long UNMARKED NOTES: THE PARIS MORNING NEWS, Wednesday, Sept. 12, 1917: 'Tragedy On Pine Creek Over Family Affair -- M. H. Sims of Hugo, OK., a former resident of Lamar County, was killed about 2 o'clock yesterday afternoon at the home of his son in law, J. S. Landers, between eight and nine miles northeast of Paris on the D. S. Hammon farm on Pine Creek, The tragedy was the result of family trouble which resulted in the separation of Mr. Landers and his wife a year or two ago and the institution of a divorce suit by Mrs. Landers, which is still pending. Two of the children, boys six and eight years old, are staying with their father and the mother has possession of three of them. The two little boys were the only eye witnesses to the killing. ^According to the statement of Mr. Landers the deceased arrived at his home from Hugo in a jitney with two men who put him our at John Irwin's, half a mile from where Landers lived, and drove away about 1:30 o'clock. He and his two little boys were in the field picking cotton and the deceased went to where they were and drew a pistol and made him shed his cotton sack and march in front of him at the point of the pistol to Marvin Bailey's, a neighbor living about a quarter of a mile from his home. When he reached Mr. Bailey's, the deceased stopped to talk to the latter's wife and while he was talking to her Landers gave him the slip and went around the house and across the field to his home. ^When the deceased got through talking to Mrs. Bailey and discovered that he was gone he went to Irwin's in search of him, but failing to find him, then went to his home. Landers stated that when he saw the deceased coming he got his shotgun and sat out in the hall to protect himself, and that the deceased approached the house from the hack way and came around the smokehouse with his pistol in his hand. As soon as he turned the corner of the smokehouse in view of the gallery Landers fired at him with a shotgun loaded with No. 6 shot. ^Only one barrel was discharged while he was about ten steps away and the contents took effect in the lower part of his face and neck and all over the breast. The deceased turned and walked five or six steps and fell and expired. The two little boys of Mr. Landers were standing in the road near the house when the sot was fired. ^As soon as the shooting occurred Landers got his neighbors, Bailey and Irwin, to notify Sheriff Clarkson, who went out to the place accompanied by Deputy Sheriff McDonald and County Attorney Grady Sturgeon, and they found him at home waiting to surrender, he claiming self-defense. Sheriff Clarkson brought the body of Mr. Sims to Paris in his automobile and turned it over to Emberson and Brown, undertakers, who notified his wife. ^The examining trial of the defendant will be held before Justice of the Peace Jay Hall at 9 o'clock this morning. In the meantime by agreement between his attorney Judge Rube Wells and County Attorney Sturgeon the temporary bond was fixed at $500, which he made with D. S. Hammond and Tobe Ingram as sureties and was released. ^The deceased was a resident of Lamar County for a long time and farmed several years in the Harmon community. Later, he moved northeast of Paris to the West Point community and bought a farm, which he still owned at the time of his death. He was engaged in the hotel business in Paris awhile and moved to Hugo less than a year ago and was engaged in the hotel business there a few months. He was about 55 years old and leaves a wife and three or four children. ^J. S. Landers is 34 years old and has lived in Lamar county about 12 years. He has had the reputation among his acquaintances of being a quiet, peaceable man.' *Information from Dorothy Fisher, 715 N.E. 32nd, Paris, TX 75460, 6 Sep 1993: Martin died in Powderly and was born in IL., son of David Sims (born IL) and Margaret Ausmus Sims (born IL).
