LAND MANAGEMENT SERVICES

The Land Management Services serves as the technical adviser of the Regional Executive Director in terms of land survey, disposition and management.  Thus for CY 2007, it has shared significant contributions to the over-all performance of the region.

 

a.  Land Management Services

 

Under the Land Management Services, various activities have been implemented for the year.  These include the following

 

1.  Patent Issuance under Regular Fund

 

In order to promote social equity thru the issuance of Miscellaneous Sales Patent on public residential and commercial lands, a total of one hundred thirty six (136) patents covering an area 2.8697 hectares was issued to qualified patentees in the provinces of Aklan, Antique, Capiz, Iloilo, Guimaras and Negros Occidental giving an accomplishment of 100% for the year. This formalizes ownership to the land, improves security of tenure and opens financial access to land and thereby improving the Philippine economy.  

 

 

 

 

2.  Identification of School Sites

 

Identified seven (7) school sites in the province of Aklan for eventual proclamation and issuance of patent, 100% accomplishment for the year.  These are located in Brgys. Tambuan, Poblacion and San Roque, Malinao;  Mabilo, Ochando and Fatima, New Washingto, Bugtong-bato, Ibajay and Ambulong, Batan, Aklan.  It is expected that with the completion of documents for the purpose, these schools will receive their respective land titles in the near future.

3.  Disposition of Land Cases

 

To resolve land cases involving conflicts of rights between public land applicants, the region was able to investigate 23 cases in the provinces of Antique, Capiz and Iloilo which resulted to the resolution of thirty nine (39) cases for the year giving an accomplishment of 115% and 105%, respectively.

 

4.  Revenue Generation

 

For the year, the region generated a total amount of P7,218,293.42 coming from various LMS fees and dues, 205% accomplishment against the target set.  The high collection is due to increase in collection of rentals and occupation fees during the year  The province of Negros Occidental generated a highest revenue of P3,102,869.38 followed by Iloilo with P1,907,895.78, Aklan with P868,676.94, and the province of Guimaras with the lowest revenue generated of P93,242.30.

 

    b.  Land Surveys

 

1.  Inspection, Verification and Approval of    Surveys

In line with the inspection, verification and approval of survey returns, 21,712 lots covering an area of 7,169.9429 hectares were verified and approved for isolated and subdivision surveys of private lands, 273% for the year. Under the surveys conducted by the Department of Agrarian Reform  (DAR) there were 9,242 lots having an area of 10,892.2771 hectares also verified and approved giving an accomplishment of           117% during the year.

 

     c.   Management of Foreshore Areas

 

In order to rationalize and regulate the use and occupancy of public lands particularly on foreshore areas and in consonance to government policy to tap all resources on revenue generation, a massive Information and Education Campaign was conducted on the identified/inventoried foreshore sites. During the year, a total of eighty one (81)  contracts/permits with corresponding area of 56.0884 hectares was issued to qualified beneficiaries in the provinces of Aklan, Antique, Capiz, Iloilo, Guimaras and Negros Occidental occupied for residential and commercial purposes, giving an accomplishment of 91%. The target was not fully accomplished due to the failure of applicants to submit the required clearances needed in the issuance of contracts/permits.   These areas were surveyed for proper assessment, appraisal  and permitting to increase revenue generation.

 

        d.   Land Records Management

 

In order to improve/upgrade the management of public land and survey records and to facilitate easy retrieval as well as to make the records accessible to the public, a total of 2,607 sheets was encoded regionwide making an accomplishment of 114%.  Likewise, 145,982  records were also maintained for proper safekeeping  for the year.

 

       e.  DENR-LMS Building Construction

The region is one of the priority regions granted a financial assistance of P10 M for the construction of office building where to house the voluminous public land records generated through the years.   With this,  the request for the issuance of a Presidential Proclamation over a parcel of land for the office building site of the LMS, DENR, Region VI at Hervas St., Duran, Iloilo City was forwarded to the Office of the Secretary per Memorandum dated September 3, 2007.  Likewise, the Records Building Plan was submitted to the Land Management Bureau (LMB) last September 21, 2007 waiting for its approval. The said plan was also submitted to the Department of Public Works and Highways (DPWH) to secure its building permit. Preliminary activities like conferences, posting and publication towards the construction of the LMS Building Facility have been started and the bidding was conducted on December 17, 2007 and financial allocation was already obligated.    It is expected that the said building will be completed before the end of CY 2008.

 

          f.   Implementation of PRS ‘92

 

Under the Philippine Reference System of 1992 (PRS ’92), a total of 56 control points was established to the 3rd and 4th Orders in the provinces of Aklan, Antique and Iloilo  having an accomplishment of 100% for the year.  This activity was spearheaded by the Field Network Survey Party in close coordination with the concerned field offices and LGUs.

 

        g.   Comprehensive Agrarian Reform Program    (CARP)

 

Under the survey of alienable and disposable agricultural lands, a total of 5,686 lots with an aggregate area of   7,487.0001 hectares was submitted for verification and approval of surveys giving an accomplishment of 100% for the year.

In line with the distribution of alienable and disposable public agricultural lands to qualified beneficiaries, 5,490 free and homestead patents covering an area of 6,016.9883 hectares were transmitted to Registry of Deeds making an accomplishment of 88% both in the number of lots and  in terms of hectares covered.   The low accomplishment was due to the difficulty of the applicants in securing certifications from the court and/or Land Registration Authority as well as the failure of some applicants to submit the complete documents for processing of patents.  This is to improve the agricultural land tenure system of the country and the socio-economic status of the agrarian reform program beneficiaries.

 

 

        h.   Other Accomplishments

 

1.  Hosting of LMS – DENR (Visayas Group) Land Investigators and Inspectors Training

 

The office hosted the Visayas Group – LMS DENR Land Investigators and Inspectors Training last August 27-September 1, 2007 at Sugarland Hotel, Bacolod City.  The training was participated by  representatives from Regions VI, VII and VIII.  The activity was graced by USEC Atty. Jose N. Ferrer with his Chief of Staff Atty. Edgardo Gerobin.  The resource speakers from the Central Office were Atty. Edgardo  Gerobin, Atty. Fe Tuanda, Atty. Emelyne Talabis, Edna Tabadora-Anda, Dir. Ric Enriquez, Engr. Henry Pacis and from the Regional Office, Antonio Luis and Engr. Mamerto Caballero.  The primary objectives of the training include the capacitation of land investigators and inspectors on the different provisions of the law pertaining to land disposition and equip them of the lessons learned from past performance.

 

 

2. Orientation-Briefing on Land Management and Disposition

 

As a facilitating mechanism for land management and disposition, a training for potential and to be designated as Deputy Public Land Inspectors was conducted at the Regional Training Center in Jawili, Tangalan, Aklan last August 23-24, 2007 initiated by PENRO Aklan.  The nine (9) personnel who attended came from the Forestry Sector, Administrative and Planning Sections. The deputation of these personnel greatly helped the sector accomplished its target on patent processing and issuance.

 

 

3. Proposed Housing Projects and Issuance of Special Patent

 

The new draft of the proclamation and the proposed  subdivision of the parcel of land regarding the request of the City of Iloilo for the issuance of a Presidential Proclamation over a parcel of land covered by TCT No. T-7137 for socialized housing purposes in Barangay Quintin Salas, Jaro, Iloilo City was resubmitted to the Central Office.

 

The Region Office forwarded to the office of the DENR Secretary per memorandum dated April 18, 2007 the request for issuance of Special Patent in favor of the University of the Philippines in the Visayas, Miag-ao, Iloilo over parcels of land covered by Presidential Proclamation no. 866 dated June 21, 2005.

 

To support the government’s thrust of providing land and housing units to low income communities at an affordable price, CENRO Joan Nathaniel Gerangaya of CENRO Bacolod City in Negros Occidental spearheaded a dialogue with the residents of Barangay I regarding the long clamor of the occupants to award the parcel of land they are presently occupying. The members of the Task Force Public Land Acquisition which include the Bacolod Housing Authority and City Planning and Development Office also attended the gathering. It was finally resolved that the City Government shall extend financial support in the final survey of the area, while CENRO Bacolod City shall schedule the acceptance of application of 600 occupants within the area.    

 

4.  Handog Titulo in the Regional Office

A Handog Titulo program was conducted last May 9, 2007 at the Regional Office, Iloilo City by the DENR-PENRO Iloilo spearheaded by PENR Officer Valentin P. Talabero. The awardees of land titles were the main participants of the event and with other invited guests and representatives coming from other agencies such as the Philippine Charity Sweepstakes Office, Municipal Assessor of the municipalities of Ajuy, Sara and San Dionisio, City ENRO of Passi City, Registry of Deeds of Iloilo City, Media and DENR Personnel.  A total of 144 land titles covering an area of 154.9141 hectares was distributed by DENR-PENRO Iloilo to its deserving patentees during the said activity.

 

5.  Capability Building for LMS Personnel

Five (5) LMS personnel attended the Cadastral Database Build-up and Data Integration Training conducted by NAMRIA in Cebu City last May 21-25, 2007. The training provided the team with the technical capability on cadastral data conversion and transformation to PRS ’92. The training included the Geodetic Network Information System and Land Survey Data Management System.

 

Engr. Gemma Vicencio of LMS, Forester Vicente Mellizas, Jr. of FMS and Forester Conrado Marquez of ERDS attended the CBFM-CARP workshop on the Implementation of Upland Development activities under the Comprehensive Agrarian Reform Program  last May 24-27, 2007 at Baguio City.  This is the agency’s contribution to the hunger mitigation and poverty alleviation program of the government.

 

6.  Provision of Technical Assistaince to LGUs

The Survey Party of PENRO Aklan was requested by LGU Malay to conduct the survey of the existing landfill site for the municipalities of Malay and Buruanga, Aklan.   It was ascertained during the survey that portion of the landfill site falls within the A and D area of Buruanga, Aklan.   Complementarily, a survey of 131 sq.m. lot was conducted in Boracay Island as an area to be donated by the Heirs of Ciriaco Tirol located at Brgy. Manoc-manoc, Malay, Aklan to be utilized as office site of DENR in that island.

 

The FNSP survey team also attended the request of the LGU Nabas, Aklan regarding the disputed boundary of the municipalities of Nabas and Malay, Aklan.  Likewise, they also attended to the request of CENRO San Jose, Antique on the reported defective survey of the municipalities of Dao and Anini-y, Antique.
