Woman rescued from fire dies
Indications are that blaze was accidental
By Andy Nelesen [email protected] <mailto:[email protected]>
KEWAUNEE - A woman died after being pulled from a house fire Sunday.
Cheryl Delo, 45, of Kewaunee died after being transferred to St. Luke’s Medical Center in Milwaukee. She was one of two women who firefighters pulled from the fire at 321 Kilbourn St. about 6:30 p.m. Sunday.
Delo, a teacher, lived upstairs in the two-story house. Mildred Ihlenfeldt, 85, a resident of the lower level, was rescued from the fire by Kewaunee firefighters. She was listed in fair condition at Aurora BayCare Medical Center in Green Bay.
Ihlenfeldt’s husband, Emory, escaped the fire on his own, but was taken to the hospital for evaluation. The 90-year-old was listed in good condition, according to an Aurora spokesman.
Kewaunee County Coroner David Hudson said Monday that an autopsy was under way, but results were not yet available. Initial indications were that she died as a result of the fire, but the autopsy would rule out any chronic illness or other cause of death.
When firefighters arrived at the home Sunday, heavy smoke was coming from the second story, and fire was visible on the east side of the first floor.
Kewaunee Fire Chief Gregory Hlinak said crews rescued Mildred Ihlenfeldt and Delo during the first few minutes of the call. Emory Ihlenfeldt had told firefighters there were people still in the building.
“We started searching right away,” Hlinak said. “The fire wasn’t all that large. There was just a lot of smoke. We found them nearly immediately. We had them out within five minutes.”
Hlinak said the fire damage was contained to the kitchen and bedroom of the home, but there was smoke damage throughout the structure.
Fire investigators were on the scene Monday searching for more clues as to what started the fire.
Hlinak said initial indications were the fire was accidental.
“We’re looking at the first floor where the fire was at,” Hlinak said.

Wrongful death suit filed on behalf of ex-special ed teacher
By Kevin Boneske For The News-Chronicle Family members of a former Kewaunee special-education teacher, who died March 31 following a house fire in the city, recently filed a "wrongful death" lawsuit in Kewaunee County Circuit Court alleging the owners of the home where she resided with negligence.
Scott Delo, personal representative of the estate of Cheryl Ann Delo, and her parents, Melvin and Nancy Delo, all from Loyal, near Marshfield in central Wisconsin, accuse Emery E. and Mildred M. Ihlenfeldt of "carelessness and negligence" for the fire that caused Cheryl Ann Delo's death.
Cheryl Ann, also from Loyal, came to the Kewaunee School District in 1991 and spent 12 years teaching Kewaunee-area special-education children.
The Ihlenfeldts survived the March 30 fire, but Delo was pronounced dead the following morning at St. Luke's Hospital Burn Center in Milwaukee. The negligence alleged in the suit relates to the "construction, maintenance, inspection, and repair" of the house at 321 Kilbourn St.
The suit further alleges the Ihlenfeldts "were negligent in terms of providing inadequate and/or defective smoke detectors, fire alarms and similar devices," while the fire and Delo's death "resulted from one or more violations of applicable statutes, ordinances, and/or regulations."
The suit, which names the Ihlenfeldts' insurance company, Germantown Mutual Insurance Co., as a defendant, seeks an unspecified amount of compensatory damages, interest, costs, attorney fees and additional relief as determined in court. The defendants have been given 45 days to respond to the suit.

Dismissal sought in wrongful death suit
By Kevin Boneske For The News-Chronicle A Cedarburg law firm is seeking the dismissal of a "wrongful death" lawsuit in Kewaunee County Circuit Court against the owners of a home where a Kewaunee special education teacher resided before she died March 31 following a house fire in the city.
Levy & Levy, S.C., which is representing Emery E. and Mildred M. Ihlenfeldt, recently responded to the suit by denying allegations of "carelessness and negligence" against the couple for the fire that caused Cheryl Ann Delo's death.
Delo, who is from Loyal in central Wisconsin, came to the Kewaunee School District in 1991 and spent 12 years teaching Kewaunee area special education children. She resided for years at the Ihlenfeldts' house at 321 Kilbourn St.
The Ihlenfeldts survived the fire reported March 30, but Delo was pronounced dead the following morning at St. Luke's Hospital Burn Center in Milwaukee.
Scott Delo, the personal representative of Delo's estate, and her parents, Melvin and Nancy Delo, all from Loyal, are the plaintiffs in the suit, which alleges negligence relating to the "construction, maintenance, inspection, and repair" of the house.
The suit further alleges the Ihlenfeldts "were negligent in terms of providing inadequate and/or defective smoke detectors, fire alarms and similar devices," while the fire and Delo's death "resulted from one or more violations of applicable statutes, ordinances, and/or regulations."
But the response to the suit denies those allegations and contends any injuries or damage may have been sustained by Delo's "own carelessness, negligence and lack of ordinary care" in which the Ihlenfeldts "exercise no control or direction."
The suit, which also names the Ihlenfeldts' insurance company, Germantown Mutual Insurance Company, as a defendant, seeks an unspecified amount of compensatory damages, interest, costs, attorney fees and additional relief as determined in court.
The dismissal is being sought on the suits' merits and asks for related costs and disbursements.
