| ����������� This indenture of four parts made and entered into this fourth day of September in the year of our Lord One Thousand and Eight Hundred and Thirty eight and of the Independence of the United States the Sixty Third, by and between Sarah Wiggins, widow and relief (sp) of Amos Wiggins, late of the County and State aforesaid deceased, William W. Wiggins of the County of Twiggs and State aforesaid, Amos W. Wiggins of the County of Burke and State aforesaid, and William J. Evans of the County of Burke and State aforesaid in right of his wife Mahalia, formerly Mahalia Wiggins, which said William W. Amos W., and Mahalia are the children of the said Amos Wiggins deceased.� Witnesseth that whereas the said Amos Wiggins late of the County of Burke and State aforesaid, died intesm (sp) late and without will leaving a considerable estate both real and personal which is subject to distribution between the parties to this Indenture.� And whereas it is known to them that the said Amos Wiggins, did not wish the plantation and tract of land whereon he resided to be divided among all his legal distributees: but that he desired the same to be divided between his wife the said Sarah, and his son the said Amos W. in the following manner - that is to say - that all that part of the said tract of land and plantation, situate (sp) lying and being on the Eastern side of the public road leading from Augusta by way of Richmond Factory (sp) and Bynes' Mill on McBean Creek to Walker's Bridge on Brier Creek called - the Walker's Bridge road - should belong to his wife the said Sarah Wiggins: and that all the rest of the said tract and plantation, lying on the Northern side of the said road should be the property of his said son Amos W. And that all the residue of his property real and personal should be then divided, share and share alike between his said wife Sarah and his three children the said William W. Amos W. and Mahalia. ~ And whereas the said parties to this Indenture have mutually agreed that the wishes and intentions of the said Amos shall be carried into full effect, and have in pursuance thereof divided the whole estate real and personal (Except the tract or parcel of land purchased by the said Amos Wiggins from the Estate of Doctor Hews (sp), and known as the Polhill tract of land adjoining the tract on which the said Amos lived and died, and the land of Johnson and others - and which said Polhill tract the parties to this instrument have agreed shall be equally divided among them, when it may suit their convenience to do so, until which time it will remain in common to them, in the following manner to wit. - The said Sarah Wiggins has received all that part of the said tract of land and plantation whereon the said Amos Wiggins in his lifetime resided, which lies on the Eastern side of the said Walker's Bridge road, including the dwelling house and other improvements thereon - the following named Negroes - Viz - Oliver - Isaac - Ross - Jerry - John - Jonas - Eliza - Susanna - Fanny - Dolly - Adarene (sp) and Harry - All the Household and kitchen furniture, and her equal proportion of the horses, mules, corn - fodder, plantation tools and other personal property.������������������������������ | ||||||||||||||||||||||||
| The said William W. Wiggins has received the following named Negroes to wit. - Jim - Henry - Moses - Isham (sp) - Ben - Andrew - Sally Rose - Rachael - Swanny (sp). Maria and Nancy.
