17 July 1849 Indenture John Wiggins and Thomas Barber

This indenture made and entered into this seventeenth of July one thousand Eight hundred and forty nine between John Wiggins of the county of Burke and state afore said by his lawful Attorney Ambrose R. [W]Right of the one part and Thomas Barber of Washington County and State aforesaid of the other part.� Witnessethit that for and in consideration of the natural love and affection which he the said John Wiggins has and bears to his wife Sarah Wiggins and his Children Martha Wiggins Emily Wiggins and Francis Wiggins and for and consideration that the said Sarah Wiggins shall well and truly pay all the just debts of the said John Wiggins heretofore contracted and that She will clothe Educate and Support the aforesaid children Martha Emily and Francis and for and in consideration of the sum of one dollar cash in hand paid by said Thomas Barber at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and doth by these presents doth gained bargain sell and convey unto the said Thomas Barber for the use benefit and advantage in trust for said Sarah Wiggins and her children Martha Wiggins Emily Wiggins and Francis Wiggins free from the contract of the said John Wiggins or any future husband; all that tract or parcel of land situated lying and being in the County of Burke containing fifty seven acres more or less and adjoining lands (Ethalindia) Fountain Daniel White and others with all the rights (members) and (appurtenances) to said tract or parcel of land in any wise belonging; and also the growing crop now on said land together with stock of Cattle hogs (joob) corn and fodder horse cart one Horse all the (provisions) now on hand the entire lot of house hold and kitchen furniture my own personal clothing excepted, also all notes accounts bonds and other evidence of debt belonging to me the aforesaid John Wiggins also my Blacksmith Books Bee (Gunns) and (flotation) implements.� To have and to hold the above described property unto him the said Thomas Barber in trust for said Sarah Wiggins and her Children Martha Wiggins Emily Wiggins and Francis Wiggins in (fee simple) forever free from the debts (of the ???) contracts of me the aforesaid John Wiggins or any future husband to their benefit and (behoof).
