Whorwelsdown wt 1831 as 1 Transcribed by David Church Copied for MPL Wall, From Trowbridge RO Collection 2nd Febry 1831 Steeple Ashton 4 The Will of Thomas BUTCHER the elder Deceased This Will was proved at Sarum on the 2nd Day of February 1831 before the Rev.d John Greenly Clerk M A lawful Surrogate of the Reverend and Worshipful Liscombe Clarke, Clerk, Master of Arts, Archdeacon of the Archdeaconry of Sarum, And by him Administration of all and singulr the Goods and Chattels of the said Deceased, and any ways concerning his Will was committed unto Moses BUTCHER one of the joint Exors named within said Will the like power being reserved to Charlotte BUTCHER Widow Relict of the said deced and the other Exor also named in the said Will (being first duly Sworn of the Truth of the said Will, and faithfully to perform the same, and to pay the Deceased's Debts and Legacies as far forth as his Goods and Chattles will thereto extend and the Law bind him, and to exhibit a true and perfect Inventory of the Goods Chattels, and Credits of the Deceased, and yield a just a true Accompt when lawfully required) saving the Rights of all Persons. Edw.d Davies Registrar A/B Next Page This is the last Will and Testament of me Thomas BUTCHER the elder of Steeple Ashton in the County of Wilts Maltster being of sound and disposing mind memory and understanding. First I desire to be decently buried at the discretion of my Executor hereinafter named, and I give to my wife Charlotte the use of all my Plate, Household Goods and Furniture whatsoever, which shall belong to me at the time of my death during her widowhood, and after her decease I give the same to my children Priscilla, Thomas, Moses and George their Executors Administrators and Assigns or the Value thereof, share and share alike. Also I give and devise unto and to the use of my Wife during her Widowhood an Annuity or Yearly Sum of Fifty pounds clear of all Taxes and Deductions whatsoever to be paid and payable by my said son Moses by half Yearly Payments to commence from the time of my decease and to be made up by my said Children contributing alike out of their respective Share or Legacies hereinafter bequeathed. Also I give devise and bequeath to my son Thomas his Heirs and Assigns forever, all that my Freehold and Leasehold Messuage Hereditaments and Premises with the Appurtenances situate in the Borough of Devizes in the County of Wilts and now in the possession of Thomas DIMOND Tailor as Tenant thereof to me. And as to all the Rest Residue and Remainder of my Estate whatsoever and wheresoever and of what nature , kind or quality soever the same may be, after Payment of my Debts to my children and others, funeral Expences and the Expences of proving this my Will I do hereby give and bequeath the same (being all personal) unto my said Children Priscilla, Thomas, Moses and George share and share alike , deducting from the share due to my said son Thomas the value of the said Freehold and Leasehold Messuage Hereditaments and Premises with the Appurtenances to which he may be intituled. And whereas my said Son George has received from me various Sums since the Payment of the Premium of his Apprenticeship; now it is my will and desire that such Sums should be repaid or deducted from his legacy or Share with interest for the same at five per cent per Annum. And it is also my will and desire that my said Son Moses should receive and take satisfactory personal security from my other Children for the Payment of the said Annuity to my wife before he shall pay the Legacies (as Executor) due to them. And it is also my will and desire that the value of my said Freehold and personal Estate, and other of my Effects whatsoever, should be ascertained by some competent Person or Persons fairly chosen by my said Children, and that the farming and malting business should be carried on by my said Sons Thomas and Moses, for their sole use and benefit, and I do hereby make ordain constitute and appoint my said wife Charlotte Executrix and my said Son Moses Executor of this my last Will and Testament.
