Data Diggers Service Terms & Conditions

 

1.            General Information.

 

1.1.             In these terms and conditions, “We”, “Us” or “Our” refers to Data Diggers. The term “Customer” or “Client” refers to any company, firm, individuals or group of persons that contacts Data Diggers with reference to products and or services including diagnostic and/or data recovery

1.2.              The diagnostic process involves examination of the particular media involved and making a determination as to whether data recovery is possible from the customer’s media.

1.3.              It will be necessary to duplicate and analyze the data retrieved from the client’s media to determine whether the data is wholly in tact.

1.4.             Data Diggers hours of operation are Monday thru Friday with the exception of Public Holidays. Data Diggers may perform recovery services outside these hours at our discretion.

1.5.              We will do our best to meet turnaround times for service, but failure to do so is not essential to any contractual obligation.

 

2.            Quotes, Estimates & Payments.

 

2.1.             Any quote we make will be valid for ten business days after which the quote    may be adjusted without notice.

2.2.              Quoted prices do not include VAT which the current rate is 17.5% of the net total payable.

2.3.              We reserve the right to ignore any requests for service unless we receive acceptance of our quote via reply/return email confirmation.

2.4.             A small fee shall be payable before commencing any recovery work. This will be equal to one quarter of the accepted quote total and is non refundable.

2.5.              The customer understands that payment in full is due prior to release of retrieved intact document/data file. Payment can be made via our Web Site by Visa, MasterCard, Switch, and Electron.

2.6.              Our confidentiality policy requires that we DO NOT disclose information on data files recovered from client’s equipment without the consent of the client.

 

3.            The Recovery Process.

 

3.1.             We will inform the client via email or telephone if we have successfully     retrieved their data and if the data is in tact and may also email an excerpt from the data to verify whether it is the desired file that has been recovered. Once confirmation has been received the balance of the agreed quote will be due before release of the retrieved data.

3.2.              Due to the nature of data recovery, we will require access to media via any device it may be connected to, usually a PC or Laptop. Data Diggers are not responsible for any abnormal performance, quirks etc. which may occur as a result of data recovery attempts.

 

4.            Performance of Service.

 

4.1.             Data Diggers may use Royal Mail Special Delivery in order to convey data files on CD Rom, USB Pen Drive or Floppy Disk. Other arrangements may be agreed.

4.2.             Data Diggers will not be responsible for Delays which may be cause by the postal service nor will we be responsible for loss or damage while in route. We will not compensate for inconvenience or loss of profits unless previously agreed in writing by us.

4.3.             The client agrees to inspect the recovered data or product immediately after delivery. Any claim that the product or service does not comply with the product or service requested must be notified in writing via email within five business days of delivery. Claims made after five business days will be resolved at our discretion.

4.4.             Data Diggers will retain a copy of your document/file for ten business days from the date of release.

4.5.             Data Diggers offers no guarantees or warranties of any kind and any liability to the customer will be strictly limited to fees paid for recovery services.
