CROSSHATCH 22507.8(C)2) TICKET!
The citation simply listed a statute (CVC
22507.8(c)2), and the word CROSSHATCH on it I contested it and WON!
While shopping for a fishing pole for my son at a certain mega-store, which we
shall call W.M., I returned to my car to find a parking ticket under the
windshield wiper. The citation simply listed a statute (C.V.C. 22507.8(c)2), and
the word CROSSHATCH on it as cause for violation. All the way home I kept
asking myself, what the hell is a CROSSHATCH? It turns out that a CROSSHATCH
is the diagonal or slash lines which are next to or between most handicapped
spaces or at the end of a parking row.
After getting a ticket for being on the CROSSHATCH (CVC 22507.8(c)2), I was
shocked to find that the fine was $275.00, (or more, depending on where in
California you get this ticket!). I was even more disheartened when I went to
the law books, lawyer and internet and couldn�t find where anyone had contested
and won one of these! (If course you have probably already had that same
experience since your search engine has led you here.) This particular statute was most recently revised and
effective in January, 1998. So the law is apparently so new that there are no
winning cases (citable appeals) on it.
I had never even heard of a CROSSHATCH law before! And in most places, the
handicapped parking signs even fail to give notice or warning regarding this
statute! What�s even worse, even people with lawful handicapped plates or
placards can be subject to a citation for violation of CVC 22507.8(c)2! This
statute appears to be a revenue making catch-all. To support this theory is the
fact that many cities now require you to send payment or contest for the ticket
to some revenue office in another city and/or county so that you cant even go to
your own local court! (Can you say LAWFUL JURISDICTION?) In addition,
Section 22509 C.V.C. allows local municipalities to use the money raised by such
tickets to create, implement and support a special enforcement unit who may
issue notices of parking violation for violations of Section 22507.8 and local
ordinances adopted pursuant to Section 22511.7. Members of the special
enforcement unit shall not be peace officers and shall not make arrests in the
course of their official duties, but shall wear distinctive uniforms and badges
while on duty. A two-way radio unit, which may utilize police frequencies or
citizens' band, may be issued by the local authority to each member of the
special enforcement unit for use while on duty.
ANYWAY
After three weeks of doing much research, investigation, taking photos,
conferring with my attorney, and more, I filed my lengthy petition in contest,
plus certificate of mailing, photos, etc.. After almost two months I received
the result which said,
*you are not liable for this particular citation*. Yay!
Anyway, I do not know if it can help others, but if anyone wants a copy of my
petition in contest, just send me a $20.00 bill (cash or postal (from post
office) money order only! and I will immediately send you
out a copy, including my citation and the final decision. (redacted, of course).
My own checklist of things to do for preparation of the Petition to Contest is
also included. References are also made within the Petition to Contest to the photos and exhibits I
also attached when it was filed. (Postal Money Order should be
blank. Simply list "crosshatch research" in the purpose section, and your name
and address, of course.) I will return any money orders that are sent and filled
out improperly, so be careful how you prepare it.
I am making this available as educational and INFORMATIONAL ONLY, TO ASSIST WITH
RESEARCH. It is not meant to replace, substitute or negate assistance of
counsel. (My lawyer said I have to say this, ha ha.) If nothing else, it should
provide you with research and also the format to use in preparing your contest
petition document to fight it! (Same "format" could be used for most handicapped or disabled parking
tickets. 22507.8, 22507.9 et. seq., C.V.C.).
Oh well, $20.00 may seem like a lot, but compared to the outrageous fines, isnt
it worth it? In fact my lawyer says it is not enough, considering my time, expenses for
preparation, copying and mailing. I tried to tell him, this is not about the money, it is the
principal of the thing! (Yeah Right! Try to explain that to a lawyer!). I just
hope the information I have provided herein for free will give you some insight
or confidence in the type of document I prepared which ultimately won my own
case.
As for speed, do not worry. I have already made the copies and have them in envelopes ready to mail. As soon as I receive your payment, I will
address it and drop it in the mail to you by Certified or other traceable form
of mail! Just be sure your
name and address are easy to read. Or, if you like, you may enclose an address
label with your $20 Bill or Postal Money Order.
By the way, be sure to answer the citation within the time frame stated, or else you will loose by what they
call a DEFAULT JUDGMENT. (If your petition is summarily denied, you must also
file your APPEAL within the time frame stated.) Not only will you loose and pay even more, but it can prevent you from
renewing your license or registration in the future! (Plus, additional
legal and collection problems down the road). You have to also remember
that before you can take the ticket to your local Court, you MUST first comply
with these steps, otherwise the local court will dismiss your case for failing
to exhaust all administrative remedies!
