Comment Putting the cart in front of the horse except that in that favourite American adage one is dealing with two sorts of real entities and the blunder would be seen even without actual experiment.
With the 'state', no such a 'thing' exists anywhere other than on paper. (Or as some kind of often vague idea that people may have).
The 'state' in the political context means some kind of social organisation actually in place.
The business of the 'state' is to guarantee, protect, the rights of the individuals who are real people. That is the only reason for a 'state' ; (except of course somebody's usurpations in the name of 'state' and this is one of the definitions of the problem).
'State' has no 'rights' whatsoever ; the 'state' is not a real entity and it cannot have any 'rights'.
In the case of Dr. Jost the application of his theories would solve as, who exactly was to kill exactly whom. Reportedly some attempts had been done in some such directions but the 'scientific' bases were more than doubtful.

Anyway, why is the mentioned title by Doctor Jost not found at the University of California Library ?
(Not that I want to read it all that badly ; judging by the available reports. But why is the title not there ?)
