General Membership Agreement

This General Membership Agreement (Membership Agreement) between you and ClubSurf2Earn (The Club) sets out the terms of your membership.

I. Basic Requirements for Membership.

To maintain a Membership with the Club, You must meet the following requirements and the Club reserves the right to terminate the Membership of anyone who fails to meet these requirements on an ongoing basis: If you are under 18 years of age, you must have the permission of your parent or legal guardian before you can participate in our the Club program. One Account per Member. You may only sign up once and maintain one Membership at all times.

Provide Accurate Information. You must provide the Club with valid contact information and may not impersonate or misrepresent your identity. The Club reserves the right to terminate any associated membership, containing untruthful information.

Membership is non transferable. Your membership ID and password are personal to you and are non transferable; You're responsible for keeping your password confidential; the Club is not liable for any loss or damage caused by any disclosure of your password; You may only apply a membership account for yourself and may not establish account on behalf of anyone else.

Comply with Laws. You agree to comply with all local, state, province, country or regional legal restrictions that may be applicable to your membership with the Club.

Termination of Membership. To the full extent allowed by applicable law, the Club at its sole discretion and for any or no reason may refuse to accept applications for membership and may terminate any Members memberships without prior notice for

(a) any violation of any provision of this Membership Agreement;
(b) aiding in or promoting circumvention of the the Club Service;
(c) acting against the interests or reputation of the Club;
(d) otherwise acting unlawfully in relationship to the Club, the Club website or the the Club Service or
(e) any other reason at the discretion of the Club, and if your membership is terminated by the Club, You may not re-enroll or join under a new account unless formally invited to do so by the Club.

Lapsing of Membership. If you do not surf with the program you join actively within any 90 day period, your membership will automatically lapse without notice.

II. The Referral Program. As a Member of the Club, You may refer other people to the the Club membership program (Your Referrals). Members may not use Spam to obtain referrals. You may not use unsolicited e-mail, usenet and/or message board postings (spam) to generate referrals.

III. Limitation of Liability. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER THE CLUB NOR ANY OF MEMBERS, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS MEMBERSHIP AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IV. Force Majeure. the Club will not be in default or otherwise liable for any delay or failure in its performance under this Agreement where such delay or failure arises by reason of an Act of God, or any government or governmental body, acts of war, the elements, strikes or labor disputes, power or system failures, failure of the Internet, computer hacking, or other causes beyond the control of the Club.
