In the interest of setting out clearly defined guidelines and parameters as to what shall be henceforth deemed inappropriate simming behavior aboard the USS Wildcat; And in the interest of making these guidelines accessible to and easily understandable by all the following Uniform Code of Military Justice shall be posted both to the bulletin boards and to the Wildcat Website. If there are any questions as to any of the stipulations set down here, please contact me directly at [email protected] or private message me on the bulletin boards. Effective immediately, this UCMJ will be considered sovereign and binding to one and all who sim aboard the USS Wildcat. So as to keep all rulings governed by this code fair and equatible to all involved, any disciplinary action handed out as a result to an infraction or violation of any of the codes set forth herein may be appealed by contacting the Commanding Officer(CO). If you feel you have been treated unfairly please feel free to contact the Executive Officer(XO) to review your case. That being said, if you choose to SIM aboard the USS Wildcat, it will be assumed that you have fully read and understand and agreed to the following rules, regulations and guidelines. ~SECTION ONE: Defining the Strikes and Demerits System~ A Strike or Demerit constitutes a mark placed within your service record as a result of disciplinary actions resulting from infractions and violations of this code. Strikes are most often handed out for minor infractions and Demerits are gained thru accumulation of Strikes or for more serious offenses. - Receiving three (3) Strikes shall result in receiving one (1) Demerit. Anyone with more than two (2) strikes shall not be eligible to hold a "Chief" position and if already in such a position will be "suspended" from said position until their record has been cleared to below two (2) strikes. Chief Positions consist of: CO, XO, TAC, OPS, HELM, CSEC, CEO, CMO, CSCI and CNS. - Receiving three (3) Demerits shall result in autmatic reduction in Rank to the next lowest grade. (i.e. Lt to LtJg, LtJg to Ensign...if the person is already an Ensign then three (3) Demerits shall result in immediate suspension from the sim, the duration of which and the conditions for returning from such to be determined on a case by case basis by the CO, or in the CO's absence the XO.) - Receiving four (4) Demerits shall likewise result in reduction in rank AND automatic suspension from the sim, the duration of which and conditions for returning from such to be determined on a case by case basis by the CO, or in the CO's absence the XO. - Disciplinary marks are removed from your Personnel File at the rate of one (1) Strike per complete month (thirty <30> consecutive days) of satisfactory behavior. - So long as you have even one (1) Strike in your Personnel File you shall NOT be eligible for Promotion. - Ranks lost due to disciplinary actions may be recovered upon the removal of all Strikes and/or Demerits from your Personnel Record at the discretion of the CO. Ranks lost due to disciplinary actions are NOT automatically recovered upon the removal of all Strikes and Demerits from your record. ~SECTION TWO: MINOR INFRACTIONS (1-2 Strikes)~ - Absent Without Leave (AWOL): This occurs when any crewmember fails to make at least ONE (1) sim in a thirty (30) day period which is four (4) sims of the USS Wildcat without notifying the CO or the XO beforehand. This infraction carries a ONE (1) Strike penalty and may be waved if just reason can be given to the CO for the unexplained absence within ONE (1) week of the infraction. - Conduct Unbecoming an Officer: This occurs when any crewmember makes statements or actions towards another crewmember which are viewed by the receiving crewmember to be unacceptable or unwelcome. There is no infraction unless the receiving crewmember files a formal grievance. Examples of this include, but are not limited to: offensive language, offensive remarks, unwelcome sexual advances, etc. This infraction carries a mandatory TWO (2) Strike penalty PROVIDED the offender make immediate restitution to the offended in the form of written apology AND refrain from continuing the behavior causing the infraction. Should the offender fail to submit a written letter of apology to the offended, or should the actions repeat themselves, this infraction then becomes "GROSS MISCONDUCT" and is covered by SECTION THREE: MAJOR INFRACTIONS. ~SECTION THREE: MAJOR INFRACTIONS (1-2 Demerits)~ - Gross Misconduct: This occurs when Conduct Unbecoming an Officer has been cited against the offender and proper restitution has not been offered or the unacceptable behavior has been continued by the offender. This may also occur when any crewmember has received complaints from more than one (1) other crewmember concerning Conduct Unbecoming an Officer. This infraction carries with it a MANDATORY one (1) Demerit. - Harassment: This occurs when any crewmember gives undue negative attention to another crewmember resulting in making that crewmember feel uncomfortable or unwelcome. Examples of this infraction include, but are not limited to: Hazing, Riding and Alienating fellow crewmembers. There is no infraction if these actions have been discussed by both parties before hand and it has been agreed to portray them in the sim, for this infraction to occur the harassment must be UNWELCOME by the receiving party. This infraction carries a one (1) Demerit penalty. - Vigilantism: This occurs when any crewmember takes it upon themselves to decide actions for another crewmember without first getting the consent of the second party. This may also occur when any crewmember performs an action which would adversly affect another crewmember without first consulting the second party for consent. Examples of this infraction include, but are not limited to: Posting actions FOR another character other than your own without first obtaining permission to post said actions from the person originally controlling that character, Posting actions that would result in bodily harm or death to a character other than your own without first obtaining permission from the person controlling that character and Posting actions which would remove another character from play without first receiving permission for such action from the person controlling that character. This infraction carries a TWO (2) Demerit penalty. - Disruptive Behavior: This infraction occurs when any crewmember posts actions that are contrary to the story line of the plot in such a manner as to actually disrupt the flow of the current story. This infraction also occurs when any crewmember actively seeks to interrupt the smooth progression of the current story through excessive OOC posts. Continued Disruptive Behavior well result in a TWO (2) Demerit penalty. - Murder/Suicide: This infraction occurs when any crewmember posts actions resulting in the death of another character (Murder) or their own character (Suicide) without first clearing said actions with the person controlling the character killed AND the Commanding Officer (CO). This infraction carries a TWO (2) Demerit penalty AND automatic suspension from sim for not less than thirty (30) days. There is no infraction if the character death, be it thru Murder or Suicide, is pre-planned and agreed upon by all characters involved AND the Commanding Officer (CO). - Insubordination: This infraction occurs when any crewmember refuses to cooperate with the Commanding Officer(CO), the Executive Officer(XO) or the Sim Master(SM). Examples of this infraction include, but are not limited to: Openly defying or disobeying a direct order from the CO or the XO, Actively acting in a manner viewed as distructive to the Sim by the CO, XO or SM, Actively acting to disrupt or control the existing story without regard to the CO, XO or SM and without respect to the other crewmembers attempting to enjoy said story. This infraction carries a TWO (2) Demerit penalty and possible suspension from the Sim, at the discretion of the Commanding Officer(CO). Basically people, let's try and remember that we are a TEAM. The USS Wildcat cannot sim with just ONE person. Respect the rights of your fellow crewmates. Respect their characters and their visions. Respect the rights of your Sim Master and treat his story with courtesy and respect as well. If we all remember that one word, RESPECT, there should never be any reason for the implementation of the above Code. Any crewmember not wishing to be governed by the rules and regulations set forth therein may freely resign from the Sim at anytime with no loss in rank nor fear of any reprimands nor backlash. Any penalty handed out as a result of this Code may be appealed to your Commanding Officer(CO)or Executive Officer(XO) without fear of reprimand or backlash as a result.
