WAIVER FORM
RELEASE AND WAIVER OF ALL CLAIMS
I, (Please Print Name)__________________________________________hereby apply to participate in the Civil War Days, a Living History and Reenactment held on July 29, 30, 31, 2005 at Thunder Valley Stables, McKean, PA (hereinafter called the �premises�).
I understand that participating in said Reenactment will expose me to various foreseeable as well as unforeseeable risks of injury or harm. These risks include, but are not limited to, uneven or hazardous ground, physical contact or collision with other participants, spectators, animals or inanimate objects on or about the premises, musket firing, campfires and pyrotechnics.
I understand and acknowledge that participating in said Reenactment, involving potentially hazardous materials and/or implements, constitutes a potential injury to my person or loss to my property. I have elected to voluntarily enter upon the premises and/or participate in these activities and I voluntarily assume any and all risks, known, foreseeable or otherwise, that may be sustained by me. I represent that I have to health or physical problems that will interfere with my participation in the Reenactment. I agree that I am responsible for my own safety.
As a condition precedent to my participation, I hereby fully and forever release, discharge and covenant not to sue Thunder Valley Stables, The Re-enactment Consortium, their agents, directors, officers, employees, members, volunteers, and any and all persons and/or entities affiliated with them (hereinafter called �Sponsors�). It is my intention that this release shall release and indemnify any and all persons and entities (whether mentioned herein or not) who are or who may be jointly liable in tort.
Furthermore, I do hereby release the Sponsors from any and all liability, claims, demands, actions, suits or causes of action whatsoever, arising out of or related to any loss, damage, personal injury or death that might be or is sustained by me or to any property owned, leased, or utilized by me while in or upon or traveling to or from the premises.
This release shall be binding upon my heirs, administrators, executors, assigns and anyone acting on my behalf, including, but not limited to, a parent, guardian or next friend.
I hereby acknowledge that I have read this release/waiver, fully understand the ramifications of the signing of this release/waiver and have signed this release/waiver voluntarily and of my own free will.
I agree to indemnify and hold harmless the Sponsors form any loss, damage or expense sustained or incurred by them arising from any claims, causes of action, or liability, whether brought by me, anyone acting on my behalf, or by anyone else because of conduct attributed to me.
I agree that this agreement shall be construed and interpreted according to the laws of the Commonwealth of Pennsylvania.
