The defendant having sold and
having had in possession for the purpose of selling the goods
bearing the injured party's trademark counterfeited by another
person and having knowledge that the trademark are the
counterfeit trademark, is liable under the Trademark Act. The
fact that whether the goods distributed by the defendant have
a better quality than the genuine products and that no
customers have ever complained to the defendant concerning
damage arising from the goods purchased, will not make the
illegal act of the defendant become legal.
