The following update is from Barry Taylor, Legal Advocacy Director, Equip for Equality:"The following is an e-mail I received today from NAPAS re: the decisions states have made with respect to the Garrett Supreme Court amicus briefs. As you can see, Illinois has not yet committed to a position.
"As of June 1, here's what we definitely know about the states' activities in Garrett v. University of Alabama:
"Will file/sign on to a brief in support of the ADA:
Minnesota, West Virginia"Will stay neutral and not sign on to any brief:
California, Georgia, New Hampshire, North Dakota, Oregon, South Dakota, Vermont"Will file a state's rights/anti-ADA brief:
Hawaii."The good news is that a number of states are seriously considering signing on to the Minnesota brief. The bad news is that an equal, if not greater, number are considering signing on to the Hawaii brief. While advocates should continue to pressure their states to sign on to the Minnesota brief, it is imperative that they do all they can to make sure their state does not sign on to the Hawaii brief.
TIME IS OF THE ESSENCE -- THE HAWAII BRIEF GOES TO THE PRINTER ON OR ABOUT JUNE 15!"
