64. John SHIVELY

""He was a Revolutionary Soldier on the roll of the 3rd Vacant Company as a Private in the German Regiment of the Continental Forces commanded by Lt. Col. Lewis Weltner 1 May 1778.
In 1781, he was carried off by Indians during a raid and
never returned (Annals of the Buffalo Valley, pg. 199, Juniata and Susquehanna
Valleys, Vol. 11, pg. 1380). Administration of estate filed in 1784 in
Northumberland Co., PA. Estate settled in 1801 (widow Eve now married to Philip
Mann). In 1814, Philip Mann and wife Eve of Middletown Twp., Columbiana Co., OH,
together with Christian Shively of the same place give dismissal of bailship of

He was on the tax lists with 200 acres 1781 for Buffalo Twp., Northumberland, Pennsylvania.
He was on the tax lists  with 300 acres 1782 for Buffalo Twp., Northumberland, Pennsylvania. He was on the tax lists of his estate of 291 acres 1783 for Buffalo Twp., Northumberland, Pennsylvania. The estate administration is recorded 1784 in , Northumberland, Pennsylvania.
He had his estate settled by his widow, Eve Shively Mann 3 Nov 1801.
John married Eve Berger sister of Conrad Berger. John Died Mar 1781 and Eve died after 1814 in , Columbiana, Ohio and was buried in , Columbiana, Ohio.

In a letter to General Potter, Colonel Hunter states that Captain Thomas
Kempling, as he writes it, and his eldest son, were killed by the Indians, at the
mouth of Muncy creek, in March, 1781. In the petition of his widow, who writes her
name Mary Campleton, presented to the Assembly, September 23, 1784, she says: "My
husband and son, with others, went on a tour of duty up the West Branch, early in
the spring of 1781, and lying one night at the mouth of Muncy creek, in the morning
the savages came on them when my unfortunate husband and son, with one William
Campble, fell a sacrifice to all the cruelties and barbarities that savages could
inflict, leaving your petitioner and six children. We were driven from house and
home, and so reduced that I am unable to return to the place we had improved upon."
About this time, John Shively who lived on the place now owned by R. V. B.
Lincoln, Esquire, was captured by the Indians, in the meadow, in the rear of
Esquire Lincoln's house. He was never heard of afterwards. He left a widow and
sons, Christian and Frederick, who owned the place until the year 1804. His widow married Philip Mann, who lived in the Valley up to 1805.

Enlisted At Charlottesville, Albemarle County, Va. For Two Years, Served As A Private Under Captain Matthew Dewitt in Colonel Stephens 7 Virginia Regiment For 2 Years.
Before His Term Expired, He Re-Enlisted For Three More Years Under Captain Henry Young's, 5 Virginia Regiment And Was Honorably Discharged On 29 January 1780, After 3 Years, At Lancaster, Pa . The Discharge Was Signed By Col. Ferberker. He Was in The Battle Of Brandywine And Several battles.
A muster roll of Captain Whites Company of Virginia contains this item, Mosby CHILDERS, Corporal, age 20, Amherst County, Virginia. Enlisted Dec.18, 1779; served 18 months. Included among the Pension Papers at Washington, D. C. is a paper very faded and indistinct, reading in part; Jan. 29,1780. Receipt for bounty pay and clothing; These are to certify that Mosby CHILDERS, formerly a soldier in The 5th Virginia Regiment has duly and faithfully served through 3 years. For which he enlisted returned to his home free and unmolested he having received his bounty pay and clothing at Philadelphia Pa.
Records indicate That He Was Placed On The Pension Roll On June 9, 1819, And Received Back Pay From June 26, 1818. Pay Was At The Rate Of $80.00 Annually.

"Joseph Higginbotham (son of Moses, Sr.) died in Amherst County, Virginia in 1827. His will was proved September 17, 1827. See Will Book 7, page 34.

He willed his son James S. Higginbotham during his natural life and no longer, all the land that he might have in his possession at his death except his right and title to a part of a tract of land belonging to the estate of his brother Charles Higginbotham. Also a negro man named Pleasants, and "all my Household and Kitchen Furniture except my feather beds and furniture; all my stock of Horses, cattle and Hogs, and one half my stock of sheep, and one half of all my Negroes, exclusive of the one already mentioned"
At the death of James S. Higginbotham, to his lawful issue, in default of which, then grant to the children of testator, children of his daughter Frances McDaniel, viz: Joseph, James, Preston and Mary. Also to said grandchildren "one half of all the Negroes I die possessed of." The best bed that I have goes to my grand daughter, Mary McDaniel"

Witnesses: James Higginbotham, Saml. W. Christian, Eugene Higginbotham.

In a codicil to his will, dated September 6, 1827, he leaves to his son James S. Higginbotham, "a fee simple Title to the Tract of Land I now live on containing about 100 acres," also two Negroe boys, Reuben and Zackeria.
Witnesses: Jesse Higginbotham, Allsion Ogden, Eugene Higginbotham
Executor's Bond $10,000.

Jospeh Higginbotham came to America from Ireland. He was living in Virginia in 1751. He married Frances Riley. Moses, a son, and father Joseph, died in Amherst County in 1791.

George Eyestone appears to have been illeterate, having to make his "mark" at the conclusion of his will, drawn up before John McCarty, clerk of Fayette Circuit and witnessed by Franiz Veach & Mordici Mitchner. This will was signed on 4/18/1826, which makes the death date for Geo. Eyestone suspect. Most likely he died AFTER this date, but noting that he could only make his mark, perhaps it was executed at his deathbed. If so, perhaps George could indeed write.

Chances ARE that the full name begins with WILLIAM, but there is NO PROOF of this. His daughter, Nancy, married Jonathan Eyestone of the German Augenstein family, hence the grandson among 14 other siblings.
