"Probate Summary:-Consistory Court of Durham 1811
Appoints Robert Walters of Newcastle, Genteleman as Trustee Wife Elizabeth Ismay to use of rents from real estates, upon her death the estate to be divided equally amongst his children as and when they reach the age of 21.
This is the last Will and Testament of me Thomas Ismay the younger of Nether Heworth in the Chapelry of Heworth in the County of Durham, Gentleman. I give devise and bequeath all my real and personal estates of what nature or kind soever unto Robert Walters of Newcastle upon Tyne, Gentleman. To hold to him, his heirs, Excutors and Administrators according to the natures and tenures thereof upon Trust to call in and receive such part of my personal estate as shall be in money at my death and sell dispose and convert the residue thereof into Money and place the same out at Interest on real or Government securities.
And upon further Trust to pay the interest to arise therefrom to my dear wife Elizabeth Ismay during her life. And also upon trust to pay or otherwise permit her to receive the rents of my real estate during her life. And after the death of my said wife upon further trust to sell and dispose of my real estate at such times and in such manner as my said Trustee shall think proper and to pay the produce thereof and also the produce of my personal estate to be laid out at Interst as aforesaid to and amongst my children by my said wife in equal shares and proportions as and when they shall respectrively attain the age of twenty one years with the benefit of surviorship to and amongst them. And in the mean time and until they shall respectively attian their age of twenty one years to pay the interest of their respective shares to my said real and personal estates for their maintenance and education in such manner as my said Trustee shall think proper. I appoint the said Robert Walters Executor in Trust of this my last Will. In Witness whereof I have hereunto set my Hand and seal the 16th day July in the year of our Lord 1803. Signed sealed published and declared by the said Testator {.....} for his last Will and Testament in the Presence of us who in his presence at his request and in the presence of each other have hereto subscribed our names as Witnesses Jn Kirsop, John William Lambert, Pere: Geo: Ellison On the fourth day of March 1811 Letter of Administration with {.........} of all and singular the Goods, Chattels and credits of Thomas Ismay the younger the {....} were {comitted} and granted to Eliz Ismay of Nether Heworth in the County of Durham widow the relict and {........} legatee for life within named she having been first duly sworn before the Rev'd Geo Emmerson Clerk, a commissioner in this behalf lawfully appointed {well and faithfully to execute and perform the same as usual}.
