The Planning Commission also recommended conditional final plan approval contingent upon all of the outstanding items listed in ARRO’s March 7, 2003, review letter being addressed. Josele has also prepared a list of conditions for approval. Eric Johnston, the applicant’s engineer, would also like to discuss a proposed recreation area adjustment plan with the Board.

PAGE TWO
- Martin B. Zimmerman –
Mr. Zimmerman requested waivers of the land development plan processing procedures and the stormwater management plan requirements. The Planning Commission thought that Mr. Zimmerman might not meet the definition of ownership concerning a family farm support business. After a discussion, the members thought that Mr. Zimmerman might be a sub-contractor. Would federal employment law need to be applied to make a determination of ownership? Also, Mr. Zimmerman said that he would be using recycled plastic as well as wood in his shop. The Planning Commission members wondered if using plastic might put the shop in a different category. The Planning Commission members asked the manager to check with the solicitor on these two issues. The solicitor has said that federal employment law does not need to be considered in this situation. Also, the use of recycled plastic does not put Mr. Zimmerman’s project into a different category. The Planning Commission also recommended that the applicant submit a preliminary plan.
- Vernon Beiler –
Mr. Beiler is proposing to construct a new dwelling on his parcel and remove the old dwelling. The zoning officer recommended that Mr. Beiler sign a declaration that a temporary occupancy permit would be issued, but that the old dwelling would be removed within 90 days. The planning commission agreed with the zoning officer, except that Mr. Beiler be 150 days to remove the old dwelling. The Planning Commission recommended a waiver of the land development process contingent upon the applicant signing a declaration provided by the zoning officer which would give him 150 days to remove the old dwelling.
- Andy Boehler Plan –
The Planning Commission recommended that a note be added to the plan which would require sidewalks when the township deemed necessary. The Planning Commission also recommended waivers of the plan scale requirement and the preliminary plan requirement. Final plan approval was recommended contingent upon all engineering comments being addressed.
