Joseph Robinson to Samuel Telfer

Deed Joseph Robinson & wife to Samuel Telfer} This Indenture made this Twenty-fourth day of April in the year of our Lord one thousand eight hundred and thirty-nine between Joseph Robinson of Toboyne township, Perry County and state of Pennsylvania and Elizabeth his wife of the one part, and Samuel Telfer of Tuscarora township Juniata County and state aforesaid of the other part Whereas by virtue of the right of Improvement and actual settlement Alexander Telfer became lawfully seized in his demesne in and to a certain tract or parcel of land situated in the township of Lack (now Tuscarora) and county of Mifflin (now Juniata) and state of Pennsylvania, and being so thereof seized, made his last will and testament in writing wherein among other things he devised his real estate to his daughter, Elizabeth (now the wife of Joseph Robinson party hereto) and his sons James, Samuel, and Thomas to be equally inherited by them. And whereas by virtue of the said will or of some other assurances in law Thomas Telfer a son of the said Alexander Telfer deceased became seized of his share or part of said tract or parcel of land and being so thereof seized died intestate leaving no issue, whereby Jane Telfer widow and relict of said deceased, Joseph Robinson and Elizabeth his wife (party hereto) sister, and James and Samuel Telfer brothers of said deceased, became the only heirs, to whom the same did descend and come. Now this Indenture Witnesseth that the said Joseph Robinson and Elizabeth his wife, for and in consideration of the sum of Three hundred Dollars to them in hand paid by the said Samuel Telfer, at end before the sealing and delivery hereof, the receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said Samuel Telfer, his heirs executors, and administrators by these presents, have granted, bargained, sold, aliened, enfroffed, released, and confirmed, and by these presents do grant, bargain, sell, alien, enfroff, release, and confirm, unto the said Samuel Telfer, and to his heirs and assigns, all their estate, right, title, interest, property, claim and demand whatsoever, on account of their share or shares, part, or dividend by inheritance or otherwise, of, in, to, or out of, all that certain messuage, tract, or parcel of land situated in the township of Tuscarora aforesaid, bounded by lands formerly of Samuel Barton, William Con, the heirs of James Thompson, Alexander Thompson, George Glasson and Nathaniel McWilliams, containing two hundred and eighty-acres and twenty eight perches, with the allowance (be the same more or less) surveyed by virtue of a warrant for the same bearing date the second day of September on thousand eight hundred and twenty two, granted to Thomas Telfer, in the name and behalf of the heirs of the said Alexander Telfer deceased, as by the said warrant remaining filed in the Surveyor Generals office relation being thereunto had will appear. Together with all and singular the houses, outhouses, buildings, barns, stables, ways, wood, water, watercourses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging, or in any wise appertaining. Subject to the claims of the commonwealth for Patent fees, and the reversions and remainders, rents, issues, and profits thereof: And also all the estate right, title, interest, property claim, and demand whatsoever of them, the said Joseph Robinson and Elizabeth his wife, in law or equity or otherwise however, of in, to, or out of the same. To have and to hold the said messuage or tenement and parcel of land and premises hereby granted, or mentioned, or intended so to be, with the appurtenances, subject to the claims of the commonwealth aforesaid, unto the said Samuel Telfer his heirs and assigns, to the only proper use and behoof of the said Samuel Telfer, his heirs and assigns forever. And the said Joseph Robinson for himself, his heirs, executors, and administrators, doth covenant, promise, grant, and agree, to and with the said Samuel Telfer his heirs and assigns by these presents that he the said Joseph Robinson and his heirs, the said above mentioned and described messuage and tenement and tract of land, hereditaments and premises hereby granted, or mentioned or intended so to be, with the appurtenances, unto the said Samuel Telfer his heirs and assigns against him the said Joseph Robinson, and his heirs, and against every other person whosoever, lawfully claiming or to claim any rights, title or interest in and to the same except the commonwealth shall and will warrant and forever defend by those presents. In witness whereof the said Joseph Robinson and Elizabeth his wife have hereunto set their hands and seals the day and year first above written. Deed Jane Telfer to Samuel Telfer} This Indenture made the fourteenth day of September in the year of our Lord one thousand eight hundred and forty one Between Jane Telfer of the one part and Samuel Telfer of the other part, both of Juniata County and State of Pennsylvania, whereas by virtue of will and descent or of some other assurances in the law Thomas Telfer a son of Alexander Telfer and Jane Telfer, deceased, became seized of his share or part of a tract or parcel of land owned by his father, Situated in the township of Tuscarora and County of Juniata and State of Pennsylvania and being so thereof seized, died intestate leaving no issue, whereby Jane Telfer widow and relict of said deceased, Elizabeth Robinson sister and James Telfer and Samuel Tefer brothers of said deceased became the only heirs to whom the same did descend and come. Now this indenture Witnesseth that the said Jane Telfer, for and in consideration of the sum of one hundred and fifty dollars to her in hand paid by the said Samuel Telfer at and before the sealing and delivery hereof, the receipt, whereof she does hereby acknowledge and thereof acquit and forever discharge the said Samuel Telfer his heirs Executors and Administrators by these presents, have granted, bargained, sold, aliened, enfroffed, release, and confirmed and by these present do grant, bargain, sell, alien, enfroff, release and confirm unto the said Samuel Telfer and to his heirs and assigns, all her estate, right, title, interest, property, claim and demand, whatsoever on account of her share or shares, part or dividend, by inheritance or otherwise of in, to, or out of, all that certain messuage, tract, or parcel of land, Situate in the township of Tuscarora aforesaid, Bounded by lands, formerly of Samuel Barton, William Conn, the heirs of James Thompson, Alexander Thomson, George Glasson and Nathaniel McWilliam. General Power of Attorney to Samuel Telfer}
Know all men by these presents that I, James Telfer, of Jefferson County and state of Ohio am entitled to my share of a tract of land owned by my father now deceased and also to a lot in the town of Petersburgh owned by my brother Thomas, now deceased both tracts or lots are situate in the state of Pennsylvania. Now know ye, that I the said James Telfer, have made, constituted and appointed and by these presents do make constitute and appoint Samuel Telfer of Juniata County and state of Pennsylvania my true and Lawful attorney, for me and in my name to lease, let sell or demise my share in said land and lot, to such person or persons, and for such a term or number of years, and at or under such yearly rents as he shall think fit; or otherwise to sell, grant and convey the same absolutely in fee simple for such price or sum of money to such person or persons as he shall think fit an convenient, and also for me and in my name to seal execute and deliver, such deeds, conveyances. Bargains and sales, for the absolute sales and disposal thereof or of any part thereof, with such clauses, convenants and agreements to be therein contained as my said attorney shall think fit and expedient hereby ratifying and confirming, all such lease or leases Decds, conveyances, Bargains, or sales which shall at any time hereafter be sealed and executed by my said attorney touching or concerning the premises. In witness whereof I have hereunto set my hand and seal this 22 day of January A.D. 1833. James Telfer {seal} Witness present John Shober, Nathaniel Mcwilliams State of Ohio Jefferson County SS,br. This Indenture made the 17th day of December in the year of our Lord one thousand eight hundred and thirty two between David Johnston and Jane his wife of the county of Jefferson and State of Ohio of the one part and James Tilford of the same County and State of the other part. Witnesseth that the said David Johnston and Jane, his wife, for and in consideration of the sum of thirty dollars to them in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained and sold and by those presents do grant, bargain, sell, convey and confirm unto the said James Tilford his heirs and assigns all the following described lot of land with the appurtenances, Situate, lying and being in the county of Jefferson and State of Ohio the same being lot number 21 in the Town of Amsterdam fronting 60 feet on the east side of Main Street and one hundred and twenty feet on the South Side of Upper Alley. To have and to hold the above described lot of land and premises with the appurtenances to the said James Tilford his heirs and assigns forever to the only proper use and behoof of them the said James Tilford his heirs and assigns forever. And the said David Johnston and Jane his wife for themselves and their heirs executors and Administrators, do hereby covenant and agree to and with the said James Tilford his heirs and assigns that they the said David Johnston and Jane, his wife, the above described Lot of Land and premises to the said James Tilford his heirs and assigns shall and will warrant and forever defend against all lawful claims whatsoever. In Testimony whereof the aforesaid David Johnston and David his wife have hereunto set their hand and seal the day and year first above written David Johnston {seal} Jane Johnston {seal} Sealed and delivered in presence of Eli Davidson Robert Leslie. State of Ohio Jefferson County - On the 17th day of December in the year of our Lord one thousand eight hundred and thirty two personally appeared before me a Justice of the peace in the for said County, the above named David Johnston and Jane his wife and severally acknowledged the above instrument of writing to be his voluntary act and deed for the purposes therein expressed and requested that the same might be recorded as such. she the said Jane being by me personally examined separate and apart from her said husband and declared that she signed and as her act and deed delivered the same without any coercion or compulsion from her said husband. Deed Vol 11 page 379 William & Alexander Reynolds to Nathaniel Telfer - Received for Record Oct 12, 1849 Know all men by these presents that we William Reynolds & Alexander Reynolds and Katherine Reynolds wife of said Alexander Reynolds of the County of Carroll State of Ohio in consideration of the sum of two hundred dollars in hand paid by Nathaniel Telfer of the same place have bargained and sold and do hereby grant bargain sell and convey unto the said Nathaniel Telfer his heirs and assigns forever the following premises situate in the county of Carroll in the State of Ohio and in the Steubenville district and bounded and described as follows. Being part of the East half of the Northeast quarter of Section Number two in township Number thirteen in Range Number five and is bounded as follows. Beginning at the Northeast corner of said Section thence south two perches to a stake thence south sixty degree west sixty perches to a stake in a spring run thence North sixty degrees West thirty seven perches to a stake in the west boundary line of said half quarter from which a white oak tree 12 inches diameter bears N. 3 degrees E 13 links thence North fifteen perches to a stake in the North boundary line of said 1/2 quarter thence East Eighty two perches to the beginning containing ten acres and ninety four and one half perches be the same more or less being the same described tract of land. Deeded by Martin Myers to George Reynolds and by said George Reynolds to Alexander and William Reynolds. To have and to hold said premises with the appurtenances unto the said Nathaniel Telfer his heirs and assigns forever and the said William Reynolds and Alexander Reynolds for themselves and heirs doth hereby covenant with said Nathanil Telfer his heirs and assigns that they are lawfully seized of the premises aforesaid that the premises are free and clear from all encumbrances whatsoever and that they will forever warrant and defend the same with the appurtenances unto the said Nathaneil Telfer his heirs and assigns against the lawful claim of all persons whosoever. In Testimony Whereof the said William Reynolds Alexander Reynolds and Katherine Reynolds have hereunto set their hands and seals this fifteenth day of September in the year of our Lord one thousand eight hundred and forty nine.

Deed Vol 14 - page 339 Nathaniel Telfer & Wife To Samuel McIntire Deed A.D. 1854 Know all men by the presents that we Nathaniel Telfer and Sarah Telfer wife of said Nathaniel Telfer of the County Carroll, State of Ohio in consideration of the sum of Two hundred and fifty dollars in hand paid by Samuel McIntire of the same place have bargained and do hereby grant bargain sell and convey unto the said Samuel McIntire his heirs and assigns forever the following premises situate in the County of Carroll in the State of Ohio and in the Steubenville land district and bounded and described as follows. Being part of the East half of the North East quarter of Section number two (2) in Township number Thirteen (13) in range number five (5) and is bounded as follows. Beginning at the North East corner of said Section Thence South two perches to a stake. Thence South sixty degrees West sixty perches to stake in a spring ____. In testimony whereof the said Nathaniel Telfer and Sarah Telfer have hereunto set their hands and seals this fourteenth day of September in the year of our Lord one thousand eight hundred and fifty four. Nathnl Telfer to Daniel Young Know all men by these presents that we Nathaniel Telfer and Sarah Telfer wife of said Nathaniel Telfer of the County of Jefferson State of Ohio in consideration of the sum of Eighteen hundred dollars in hand paid by Daniel Young of County of Jefferson State of Ohio have bargained and sold and do hereby grant, and convey unto the said Daniel Young his heirs and assigns forever, the following premises Situate in the County of Jefferson in the State of Ohio and in the South West quarter Section One Township 12, Range 4, and bounded and described as follows, commencing at a stake in the center of said Section, thence West Sixty perches and twelve links to a stone thence South to the Section line, thence East Sixty perches and twelve links to a stake, thence North to the centre of said Section it being the place of beginning.. Containing Sixty acres more or less. To have and to hold said premises with the appurtenances unto the said Daniel Young his heirs and assigns forever. And the said Nathaniel Telfer for himself and his heirs doth hereby covenant with said Daniel Young his heirs and assigns that he is lawfully seized of the premises aforesaid, that said premises are free and clear from all encumbrances whatsoever and that he will forever warrant and defend the same with the appurtenances unto the said Daniel Young his heirs and assigns against the lawful claims of all persons whomsoever. In Testimony whereof the said Nathaniel Telfer and Sarah Telfer have hereunto set their hands and seals this Eleventh day of December in the year of our Lord one thousand Eight hundred and Sixty three. Archibald McCorkle to Nathl Telfer Know all men by these presents that one Archibald McCorkle and Margaret McCorkle, wife of the said Archibald McCorkle, of the county of Jefferson and State of Ohio, for and in consideration of the sum of Fifteen hundred Dollars to him in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained and sold and by these presents, do grant, bargain, sell, convey and confirm unto Nathaniel Telfer of the County of Jefferson and State of Ohio his heirs or assigns, all the following described Land with the appurtenances Situate in the County of Jefferson State of Ohio, and in the Steubenville Land district more particularly described as follows. viz; it being the west half of the North East portion of Section Twenty, Township Eleven, Range Three. To have and to hold the above described Tract of Land and Premises, with the appurtenances unto the said Nathaniel Telfer his heirs and assigns forever And the said Archibald McCorkle for himself, his heirs Executors and administrators, hereby covenant with the said Nathaniel Telfer his heirs and assigns that he is lawfully seized of the premises aforesaid, that they are free and clear from all encumbrances whatsoever, and that he will forever warrant and defend the same unto the said Nathaniel Telfer his heirs and assigns against all lawful claims whatsoever. In Testimony whereof the aforesaid Archibald McCorkle and Margaret McCorkle his wife have hereunto set their hand and seal this fourth day of March A.D. 1864. Sutton Know all men by these presents, that we Nathaniel Telfer and Sarah Telfer wife of the said Nathaniel Telfer of the County of Jefferson and State of Ohio for and in consideration of the sum of fourteen hundred Dollars to him in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained, and sold and by these presents do grant, bargain, sell, convey and confirm unto William W. Sutton of the county of Jefferson and State of Ohio his heirs or assigns, all the following described Land with the appurtenances, Situate in the County of Jefferson, State of Ohio and in the Steubenville Land district, more particularly described as follows, viz. it being the west half of the north East quarter of Section twenty, Township Eleven, Range three. To have and to Hold the above described Tract of Land and premises with the appurtenances unto the said William W. Sutton his heirs and assigns forever. And the said Nathaniel Telfer for himself, heirs, executors and administrators hereby covenant with the said William W. Sutton his heirs and assigns that he is lawfully seized of the premises aforesaid that they are free and clear from all encumbrances whatsoever, and that he will forever warrant and defend the same unto the said William W. Sutton his heirs and assigns against all lawful claims whatsoever. In testimony whereof the aforesaid Nathaniel Telfer and Sarah Telfer his wife have hereunto set their hands and seals this 12th day of August A.D. 1864. And the said Sarah Telfer wife of the said Nathaniel Telfer being by me examined Separate and apart from her said husband and the contents of the said deed being made known to her by reading the same in her presence, she did declare upon such separate examination that she did voluntarily sign, seal and acknowledge the same and that she is still satisfied therewith. Be it remembered, That at a term of the Probate Court within and for Jefferson County, Ohio, begun and held at the Court House in the City of Steubenville on the first day of January in the year of our Lord One Thousand Eight Hundred and Ninety Five by and before Wm Mc D. Miller Judge of said Court on the 2nd day of April A.D. 1895 an authenicated copy of the will of Nathaniel Telfer, deceased from the Probate Court of Carroll County, Ohio, was presented and an order of Court and entry was made as follows: Said authenicated copy of the said record is in words and figures a follows, to wit:

In the matter of the last Will and Testament of Nathaniel Telfer, Dec�d:

Be it remembered that on the 2 day of January A.D. 1895, the paper writing purporting to be the last will and testament of Nathaniel Telfer, late of Springfield Township, Jefferson County, Ohio, deceased, was presented to the Probate Court within and for said Carroll County for probate and record whereupon the following entry and order was had by the court, to wit:

Presentation of Will for Probate.
On the 2 day of January A.D. 1895 an instrument of writing purporting to be the last will of Nathaniel Telfer, late of Springfield township Jefferson County, Ohio, deceased, devising real estate situate in this county was produced in open court for probate. It is now ordered that said will be filed in this court and that due notice thereof and of application to admit the same to probate and record be given to the widow and next of kin of the testator, resident of the State of Ohio, and that said application will be for hearing before this court on the 27 day of March A.D. 1895 at 12 o�clock M.

In the matter of the last will and } Admission of Will to Probate
Testament of Nathaniel Telfer, deceased }

On the 27 day of March A.D. 1895, this matter came on further to be heard on application of James M. Telfer to admit to probate and record the will of Nathaniel Telfer, deceased heretofore filed in this court therefore, and it now being shown to the satisfaction of the court that due notice of the filing of said will and of the application to admit the same to probate and record in this court has been given to the widow and next of kin of said testator residents of Ohio and Daniel Eckley and John F. Jervine the subscribing witnesses t o said will having this day appeared in open court and having been duly sworn testified to the due execution and attestation of said will which testimony was reduced to writing and was subscribed by them respectively and was filed with said will whereupon the court finds that the aforesaid instrument writing is the last will and testament of Nathaniel Telfer, deceased. that it was duly executed and attested that the testator at the time of signing said will was of lawful age of sound mind and memory and not under any restraint. It is therefore by the court ordered that the said will be admitted to probate and that it together with the said testimony of the witness is above named be entered of record in this court:

Which written instrument so admitted to probate as aforesaid together with the testimony thereon is in the words and figures following to wit:

LAST WILL AND TESTAMENT

I, Nathaniel Telfer, of the Township of Brown County of Carroll and Sate of Ohio, being about seventy-three years of age, and being of sound and disposing mind and memory, Do Make, Publish and Declare this my Last Will and Testament, hereby revoking and making null and void all other Last Wills and Testaments by me made heretofore:

First. - My Will is that all my just Debts and Funeral Expenses shall be paid out of my Estate as soon after my decease as shall be found convenient.

Second. - I Give, Devise and Bequeath to my beloved wife Sarah Telfer all the property both real and personal of which I may die seized and possessed to have and to hold for and during the period of her natural life: my real estate now consisting of lots numbered Twenty-Seven (27), Twenty-Eight (28) and Twenty-Nine (29) in Harlem, Ohio.

Third. -At the death of my said wife, or at my death in the event my said wife should die prior to my decease, it is my will that the personal property there remaining and the title to my said real estate or that part undisposed of shall pass to and vest in my son James M. Telfer and his heirs forever - subjects however to the payment of my just debts and the following legacies: $25.00 to my grandson William D. Telfer of Harlem, Ohio and $25.00 to my granddaughter Mrs. Annie Ficus of Sherrodsville, Ohio. Said legacies to be due and payable in one year after my decease.

Fourth. - I desire to state that no bequests are herein made to my son Wm M. Telfer of Weelsburg, West Va and my daughter Mrs. Margaret Maple of near Minerva, Ohio for the reason that I have already advanced or given to these what I regard as being their portion or shares respectively of my estate.

Fifth. - I do hereby nominate and appoint my said son James M. Telfer executor of this my last will and Testament and I do also hereby authorize and empower him if it shall become necessary in order to pay my debts to sell by private sale or in such manner upon such terms of credit or otherwise as he shall think proper all or any part of my real estate and to execute acknowledge and deliver to the purchaser or purchasey thereof deeds - in fee - simple for the same.

Further - I devise that no bond be required of my said executor and that there be no appraisement of my estate or any part thereof.

In Testimony Whereof, I have set my hand to this, my Last Will and Testament, at Minerva, Ohio, this 28th day of December, in the year of our Lord One Thousand Eight Hundred and Eighty-nine.

Nathaniel Telfer The foregoing Instrument was signed by the said Nathaniel Telfer in our presence, and by him published and declared as and for his Last Will and Testament, and at his request, and in his presence, and in the presence of each other, we hereunto subscribe our Names as Attesting Witnesses, at Minerva, Ohio this 28th Day of December, A.D. 1889. Testimony of Witnesses to Will
The State of Ohio } In Probate Court
Jefferson County, SS } March 27 1895

Personally appeared in open Court, Daniel Eckly and John F. Irvine the subscribing witnesses to the last Will and Testament of Nathaniel Telfer now deceased, who being duly sworn according to law, deposes and say that the paper before them purporting to be last Will and Testament of Nathaniel Telfer who resided in Springfield township in Jefferson County, Ohio and died on the 25 day of December 1894 was duly executed as said Will by said Nathaniel Telfer on the 28th day of December 1889 and at they were present at the execution of said will and at the request of Testator subscribed their names to the same as witnesses in his presence and in the presence of each other and that they seen the said Nathaniel Telfer sign said will and heard him acknowledge the same to be his last will and Testament: That the said Nathaniel Telfer at the time of making and signing said Will was of legal age of sound and disposing mind and memory and under no undue and unlawful restraint whatsoever.
