1) Should the Buyer's payments become delinquent by as much as thirty (30) days, Buyer will forfeit all rights and title to this feline, with all payments made as liquidated damages to Seller.
2) Deposits are a sign of good faith are NON-REFUNDABLE. Some circumstances may be extenuating, as the sole discretion of Aristopurr Persians.
3) Under NO circumstances will this feline be sold, leased or given to any pet shop, research laboratory or similar facility.
4) Buyer agrees to provide adequate food, water, indoor heated shelter and good maintenance to this cat at all times, as well as proper Veterinary care when required.
5) This cat/kitten's health is guaranteed for a period of four (4) days from the date of possession by the Buyer, provided this feline is examined by a licensed Veterinarian during this period. If at anytime in the next one (1) year this feline develops a life threatening genetically inherited illness, Seller does agree to replace free of charge this feline with one of equal value, provided a Veterinary certificate is produced and confirmed. Seller may elect to have a second professional opinion. Shipping charges if applicable will be the responsibility of the Buyer.
6) Buyer agrees that during term of the Health Guarantee said feline will not be kept on a premises where communicable diseases and/or conditions have existed within the last sixty (60) days, nor will the Buyer expose this feline to any other animals during this period. Any damages to Seller as a result of non-compliance with this provision on a returned animal will be the sole financial responsibility of the Buyer.
7) If the Buyer returns this animal for medical reasons, he/she agrees to do so within four (4) business days from the date of possession, accompanied by a Veterinary certificate outlining the reason for this return. In case of dispute, Seller may elect to have this feline examined by a Veterinarian that both parties can agree upon. Shipping is the responsibility of the Buyer.
8) Seller swears to no knowledge of exposure of this feline to any communicable diseases.
9) If feline was shipped to Buyer and Buyer is dissatisfied with her/his purchase, Buyer may elect to return this feline for a refund or exchange. Buyer is responsible for all shipping expenses. Feline must be returned on the NEXT available flight to obtain a refund. If Seller is not contacted immediately after receipt of feline, the refund option will be null and void.
10) If this feline is returned to Seller in compliance with provisions five (5) and eight (8) of this agreement, Buyer may elect to have a full refund of all monies paid to seller, or may have the option of selecting another feline offered by the Seller.
11) Cats/kittens sold as show cats must be shown to at least Championship.
12) Buyer agrees not to let this feline run loose outdoors at any time.
13) Seller guarantees that this feline is fully registered with CFA (Cat Fanciers Association).
14) Buyer agrees that if any time in the future that he/she is unable to keep the above feline, the feline will be offered first to Aristopurr Persians.
****** IT IS AGREED THAT THE UNDERSIGNEDS THAT THIS IS AN "AS IS" SALE, SUBJECT ONLY TO THE WARRANTIES OUTLINED HEREIN WHICH IS THE FINAL AGREEMENT OF ALL PARTIES. THE UNDERSIGNEDS ACKNOWLEDGE THAT HE/SHE HAS READ THIS CONTRACT IN IT'S ENTIRETY AND AGREES TO ALL IT'S REQUIREMENTS, STIPULATIONS AND TERMS THEREOF, AND HAS RECEIVED A COPY OF SAME.
