The 5000 Sentinel Unit (the "Unit") contains the closest gas phase absorbent commercially available to reduce levels of certain toxic gases. This unit must be used in conjunction with the use of gas masks, appropriate protective clothing and proper shelter. The effectiveness of the Unit depends on the exposure and or exposure time and timing of exposure and on the concentration and amount of the toxic gas, the area of the room or building in which it is installed, the physical characteristics of the person / persons who is / are using it, the climate and atmospheric conditions then existing and other conditions related thereto.
Effectiveness of the Unit is increased by the number of units in place.
Vendor warrants that the Unit is free from defect in workmanship and material at the time it is delivered to the Purchaser. This warranty is exclusive to the Purchaser and is not transferable to any subsequent purchaser or acquirer. Vendor disclaims all other express or implied warranties as to the quality of the Unit including implied warranties of fitness for particular purposes. In the event of any defect in workmanship or materials, the sole remedy of the Purchaser shall be the repair or replacement of the Unit or reimbursement of the purchase price. Any such claim shall be made in writing. This warranty shall be for a period of twelve (12) months following the purchase of the Unit by the Purchaser. This warranty shall not apply to any Unit which has been subject to misuse, misapplication, negligence, accident, modifications or tampering and is in lieu of all other warranties, express or implied and of all other obligations or liabilities on the part of the Vendor. Without limiting the generality of the foregoing, the Vendor shall not be liable for any consequential damages under any circumstances whatsoever whether based on lost goodwill, loss of profits, work stoppages or otherwise and whether arising out of breach of any warranty herein, breach of contract, negligence, tort or otherwise nor shall the Vendor be liable for punitive or exemplary damages.
