Se ha recibido de la Embajada de España en Nueva Delhi información
sobre la gestión de los expedientes que se encuentran en tramite en
Nepal y que, en el momento de la suspensión de las adopciones, tenian
niño asignado con la aprobación del CDO y estaban pendientes de
registro en el Ministerio de Justicia.

Según esta información, desde la Embajada se ha contactado con el
Secretario del Ministerio de la mujer, la infancia y bienestar social de
Nepal para interesarse por la tramitación de los expedientes arriba
indicados. El citado Secretario les ha comunicado que estaba informado
del compromiso adquirido por la Ministra de la infancia Nepalí con
las autoridades españolas de revisar dichos expedientes.

En este sentido, informó que se ha efectuado una "previsión legal"
a estos efectos y que estan preparados para comenzar próximamente el
proceso de revisión. Señaló que ninguno de estos expedientes ha
tenido aún entrada en su Ministerio y, por ello, señalo que las
ECAI´S deben acudir a los CDÓ´S y pedir que sean enviados ya los
expedientes al Ministerio de la Mujer, la infancia y el bienestar
social.

En el supuesto de tramitación por vía pública, las familias
deberan hacer las gestiones oportunas para que sus expedientes lleguen
al Ministerio de la Mujer, la infancia y el bienestar social.

Por otra parte, la Embajada de España ha informado que ha enviado
una carta a la Ministra de Infancia Nepalí solicitando su ayuda para
agilizar al máximo el proceso de revisión de los expedientes
pendientes, entregándole una relación con los casos afectados.

Lukewarm response to adoption license call

KATHMANDU, July 10 - International agencies interested to work in Nepal on adoption have shown lukewarm response to the notice of Ministry of Women Children and Social Welfare (MWCSW), which has called on them to submit documents to get adoption license under strict new terms and conditions.
Until Thursday, only four Americans and one Italian agency submitted documents showing interest in inter-country adoption. However, Prakash Kumar Adhikari, law officer at MWCSW, expressed hope that agencies from other countries would also submit documents, seeking license for adoption. Only two orphanages have submitted documents in this regard.

On June 23, MWCSW published a notice in a government-owned national daily inviting international adoption agencies for listing at the Investigating, Recommendation and Monitoring Committee of the Ministry, giving a deadline of 60 days.

After suspending international adoptions a year ago because of reported widespread corruption, the gssovernment passed new regulations for foreigners wanting to adopt Nepali children.

As per the new terms and conditions, the Adoption Recommendation Committee, formed under secretary of WCSW, will formally approve and give final decision on applications of adopting parents.

Adopting parents need to contact the ministry either through authorized international adoption agencies or through concerned embassies located in the capital. Now the orphanages only have to submit a list of eligible children meant for adoption, and adopting parents need to select from the same list provided by the ministry.

Kathmandu: The Ministry of Women Children and Social Welfare has
recently announced the names of 38 orphanages allowing them to do
adoptions according to the new terms and conditions. 48 children
homes had applied for listing. After close study and several
checkings of the children homes from government levels, 38 children
homes were listed. These homes can now recommend children who are
free for adoption to the government of Nepal, GON will be matching
the child and family or applicant as per the new terms and
conditions of International Adoption.

NOTA INFORMATIVA SOBRE ADOPCIÓN EN NEPAL

Se ha recibido comunicación del Consulado de España en la India en el que nos comunican que los expedientes de solicitud de adopción para Nepal deben ser presentados al Ministerio de la Mujer, Infancia y Bienestar Social.

Por esta razón, y en virtud del acuerdo de la última reunión de la Comisión Interautonómica de Directores Generales de Infancia del pasado 8 de Julio, podría iniciarse la tramitación por vía pública de expedientes de adopción en los términos acordados. Esto es, de expedientes que con fecha 24 de abril de 2007 contaban con Certificado de Idoneidad emitido por las Comunidades Autónomas y en los que los solicitantes hubieran optado por la tramitación por vía administraciones públicas.

El envío será del expediente completo de los solicitantes y se remitirá desde este Ministerio a la Embajada de España en la India, tal y como exigen las nuevas normas nepalíes, para ser posteriormente enviados a Nepal al organismo arriba indicado.

Se recuerda que, tras la consulta efectuada por la Embajada de España al Ministerio de Asuntos Exteriores de Nepal, éste informó que los Cónsules honorarios de Nepal no están autorizados para legalizar documentos públicos.

Los expedientes con Certificado de Idoneidad posterior al 24 de abril serán remitidos por vía ECAIs.

La tramitación a través de ECAIs está pendiente de que estas sean registradas en Nepal para poder reiniciar la tramitación de expedientes.

This Ministry would like to inform that inter-country adoption process of Nepali children for alien pursuant to “Terms and Conditions and Process for Granting Approval for Adoption of Nepali Child by an Alien - 2065 (2008)” is open from January 2009. The sample application forms and other requirements are posted on the Ministry''''s website: www.mowcsw.gov.np

All respective Embassies/Diplomatic Missions/Adoption Agencies are requested to take notes of the followings:

1.- Applications of the adoptive parent/s will be processed on "First come, first served" basis, but, for the first time, not exceeding more than 10 (ten) received from each Embassy, Mission or enlisted Agency for the year 2009.

2.- Subject to the number of available adoptive children in the Orphanage/Children''''s Homes, Ministry may invite next applications.

3.- Applications of those parent/s who are asking to adopt children with special needs will be put in the fast track. Applications demanding this category of children will not be counted as stipulated in Number 1 above.

4.- Applications received in this Ministry will be processed depending on the demand of adoptive parent/s seeking for older children. First priority will be given to parent/s who are willing to adopt the children of more than 10 years old, second priority to 5-10 years old, and last priority to 0-5 years old.

5.- It is required that all applications should be attached with the proof of bank transfer of an advance payment (non-refundable) of US$ 300 (three hundred) - 10% of the charges payable to Government of Nepal Ministry of Women, Children and Social Welfare in the following account:

Adoption Notice

In an announcement dated January 1, 2009, the Ministry of Women, Children and Social Welfare (MWCSW) established procedures for processing adoptions pursuant to the Government of Nepal’s (GON) new Terms and Conditions for adoptions. The initial announcement stated that only 10 applications will be processed from each Embassy, Mission, or enlisted Agency in 2009. We understand these requirements have been provided to all approved agencies. According to Nepali officials, the new requirements will apply to all intercountry adoptions. There is NO provision to permit adoptive families who may have already begun an adoption to continue (be “grandfathered”) under the previous regulations.

Prospective adoptive parents should be aware that Nepal suspended intercountry adoptions in 2007 because of serious irregularities as well as credible claims of fraud and possible child-buying. It is not clear that the new adoption procedures will provide sufficient safeguards to ensure that intercountry adoption procedures will be transparent and will adequately protect the rights of children, birth parents, and adoptive parents.

Although the government has announced that the MWCSW is prepared to begin processing intercountry adoptions, adoptive parents considering an intercountry adoption from Nepal should be aware that the current transition period likely will pose considerable delays and challenges as the Government of Nepal seeks to implement its new policies and regulations. The Embassy continues to seek clarification regarding these procedures and will post additional details as they are available.

1- SE RATIFICA EL ACUERDO ADOPTADO EL 13 DE NOVIEMBRE DE 2008 POR EL QUE SE DETERMINABA NO INICIAR LA TRAMITACIÓN DE NUEVOS EXPEDIENTES A TRAVÉS DE ECAIS.

2- SE PRECISA NO OBSTANTE QUE LAS ECAIs PODRÁN TRAMITAR LOS EXPEDIENTES CON CERTIFICADO DE IDONEIDAD EMITIDO HASTA EL 25 DE MAYO DE 2007, FECHA DE SUSPENSIÓN DE LA TRAMITACIÓN DE ADOPCIONES POR DECISIÓN DE LAS AUTORIDADES NEPALIES.

3- RESPECTO DE LOS EXPEDIENTES EN CURSO, SE COMUNICA LO SIGUIENTE:

a) Nepal está estudiando la aprobación de un procedimiento especial para tramitar los expedientes de adopción que en el momento de la suspensión que tuvo lugar el 25 de mayo de 2007 tuvieran un menor

preasignado por los centros de menores.

b) Respecto al resto de expedientes sin preasignación:

ï‚· las ECAIs sólo podrán tramitar 10 expedientes este año (el orden será el fijado por cada CCAA con la ECAI)

ï‚· y VÍA EMBAJADA sólo podrán tramitarse 10 expedientes para toda España.

El Ministerio de Educación, Política Social y Deporte ha solicitado una serie de datos para confeccionar el orden.

Se informará oportunamente a las familias acerca de su situación.

4- ANTE LA SITUACIÓN EXPUESTA, SE ACUERDA NO PROCEDER A LA VALORACIÓN DE NUEVAS SOLICITUDES PARA NEPAL HASTA QUE NO SE CONOZCA LA EVOLUCIÓN

KATHMANDU, Feb 14 - The process of inter-country adoption has speeded up with Nepal accepting applications from potential foster parents.

The Ministry of Women, Children and Social Affairs has so far accepted at least 50 applications seeking adoption of Nepali children -- orphans, children abandoned by their families or given for adoption by parents unable to care for them -- from registered agencies.

The ministry is reviewing applications but no decision has been taken on the new applications. It will take about a month for the applications to be processed and adoptions to resume as the selection committee needs to approve these applications, officials said.

Ministry officials said the process of matching prospective parents and children would also begin soon after receiving documents of children available for adoption from orphanages. The registered orphanages, however, have still not submitted the status of children.

The process was put on hold for over one and half year since March 17, 2007, after irregularities in the adoption process came to light.

In order to regularise the process, the ministry had prepared new terms and conditions. As per the new conditions, the entire process will be dealt with by the ministry and the Home Ministry will have no role as was the case earlier.

Prospective parents need to pay fees of US $ 8,000 with US $ 5,000 going to children's homes and US $ 3,000 to the government.

The government has registered 62 international adoption agencies, which will each have to spend at least US $ 10,000 per year on the welfare of children. Each agency, on the other hand, is allowed to forward 10 applications of foster parents.

Records show that foreign foster parents have adopted 2,244 Nepali children since 2000.

Como saben, en los primeros días de enero las autoridades de dicho país decidieron levantar la suspensión de las adopciones y admitir el envío de expedientes. En una primera etapa el número no debe exceder de 10 por Embajada y 10 por cada una de las ECAIs extranjeras para el año 2009. El número de niños susceptibles de adopción en los orfanatos de Nepal, podría llevar al Ministerio de Nepal a solicitar nuevos expedientes. Esta limitación en el número de expediente no es aplicable a los expedientes de solicitantes de adopción de niños con necesidades especiales.

Ante esta nueva situación, que limita en cantidad el envío de expedientes, las Entidades Públicas españolas competentes en protección de menores han tenido que fijar de forma coordinada los criterios a seguir para el envío de los mismos.

Por esta razón, se ha acordado elaborar, respecto a los expedientes que se vieron afectados por la suspensión de la adopción en Nepal en mayo de 2007, que contaban con Certificado de Idoneidad y habían optado por la tramitación a través de las entidades públicas, un listado único de solicitantes para toda España. Dichos expedientes, según las nuevas normas de Nepal, deben ser presentados al Ministerio de la Mujer , Infancia y Bienestar Social de dicho país, por la Embajada de España en Nueva Delhi.

Los criterios aprobados han sido: fecha de Certificado de Idoneidad en primer término y, en caso de coincidir, fecha de entrada de la solicitud de adopción en la Comunidad Autónoma.

Una vez elaborado el listado, éste será distribuido entre todas las Comunidades Autónomas, ordenado según estos criterios, para que los solicitantes de adopción puedan ser debidamente informados, pudiendo las familias afectadas consultar en su propia Comunidad Autónoma.

Los diez primeros expedientes serán remitidos entonces desde este Ministerio de Educación, Política Social y Deporte, vía valija diplomática, a la Embajada de España en Nueva Delhi para su presentación ante el Ministerio nepalí competente en materia de adopción.

Esta decisión se refiere a la tramitación de expedientes vía entidades públicas y Embajada. Así mismo se acordó que las ECAIs procederán, siguiendo criterios similares a los arriba expuestos, al envío de su cupo inicial de 10 al Ministerio de Nepal.

Por otra parte, en la fecha en que Nepal decidió la suspensión de las adopciones, se encontraban en el país expedientes con niño pre-asignado por los orfanatos a los solicitantes. Eran expedientes que no tenían aún la aprobación del CDO y por tanto no contaban tampoco con entrada en el Ministerio, sino que se encontraban en una fase bastante anterior del procedimiento.

Para estos expedientes, desde la Embajada de España en India y con los Consulados de Francia y de Estados Unidos en Nepal, se han mantenido recientemente conversaciones con las autoridades nepalíes con la intención de que pudieran ser objeto de un tratamiento especial en el sentido de que, antes de que estos menores pudieran ser asignados a otras familias según el nuevo sistema, se valorara la posibilidad de adopción con los solicitantes a los que inicialmente se les había pre-asignado.

Para estos casos y según información de nuestra Embajada, las autoridades de Nepal han acordado proponer al Ministro de la Mujer, Infancia y Bienestar Social, el establecimiento de un procedimiento especial para el estudio de estas solicitudes. La resolución está aún pendiente de ser aprobada. Sin embargo, con el fin de poder facilitar a la Embajada de España una relación de posibles solicitantes de adopción en esta situación, se ha acordado que todas las Comunidades Autónomas facilitarían a este Ministerio dicha información para su traslado a la Embajada.

Desde este Ministerio se está manteniendo una estrecha coordinación con la Embajada de España en India para conocer la decisión final que se adopte en Nepal. En todo caso, en las conversaciones mantenidas por los representantes consulares, estos expedientes quedan fuera del cupo de 10 nuevos expedientes.

Como se desprende de todo lo arriba señalado, la apertura de la adopción en Nepal ha exigido a las autoridades españolas el establecimiento de unos criterios compartidos y homogéneos para el tratamiento de todos los expedientes de adopción que se remitan desde España.

Espero con esta carta haber logrado transmitir la complejidad de la situación y las acciones que han tenido que llevar a cabo las Administraciones Públicas españolas para poder iniciar la tramitación de adopciones con Nepal.

Dear Faith families,

I hope this update finds you all in good health. As you may all know, the
Maoist party pulled out of the Government of Nepal on May 4, 2009. This was the
result of an ongoing dispute between the Maoist leader, Prime Minister Dahal
(Pranchandra) and President Ram Baran Yadav, who had resisted efforts to
integrate former Maoist fighters into the military. After weeks of political
turmoil, the Parliament elected Madhav Kumar of the Communist Party of Nepal
(United Marxist Leninist) to be the new Prime Minister. He has the support of
all 22 political parties.

When the Maoist Party pulled out of the government, each of their Ministers left
their posts. This included the Minister's position at the Ministry of Women,
Children and Social Welfare. We are still waiting for the announcement of whom
the new Minister will be. Why is it taking so long to appoint a new Minister?
Good question. Here is what we believe is the hold up:

The Ministry of Women, Children and Social Welfare has been given to the
Madheshi Janadhikar Forum (MJF) political party. There is a dispute as to who
is the leader of this party. Deputy Prime Minister Bijaya Kumar Gachhadar has
claimed that the faction led by him is the official MJF. MJF Party Chairman
Upendra also claims to be the leader of the official MJF. Due to this internal
dispute, the MJF party cannot reach an agreement on the appointment of a new
Minister.

Due to the absence of a Minister, the Ministry has not issued the most recent
referrals they have made. Additionally, they have not issued notices of the
approvals for the original 40 referrals that were issued to the families. We
are hopeful that the MJF party will agree on an appointment of a new Minister
here shortly. Many interested groups have been pushing for this and there is
some speculation that a new Minister will be appointed here shortly. Let us all
hope so..

We have been informed that more and more children are being registered with the
Ministry. This is a good sign as it means more children will have an
opportunity for a permanent loving family. Additionally, we believe that when
the amount of registered children exceeds the number of prospective adoptive
parents the Ministry will increase the number of dossiers agencies can file.

The Ministry has instituted a new numbering system when dossiers are registered.
There is no rhyme or reason to their approach but the new system started with
the number "1." Previously the numerical system had lots of numbers that lead
to a confusion as to how many dossiers were actually registered. With the new
system we should have a better understanding of the number of waiting families.

We also understand that a good number of children's homes have applied for
licensing with the Ministry. The issuance of the new licenses should be coming
soon. We are not sure if the Ministry will wait until a new Minister is
appointed. We hope not. With the increase in the number of registered homes we
should see an increase in the registering with the Ministry of children in need
of permanency options.

The International Conference on Permanency Options for Orphans in Nepal has been
postponed from August 1-2 to a date to be set in October. We are not sure of
the exact date but are participating as a key sponsor for the event. We will
let you know when the date is set.

We sincerely appreciate your continued patience in the reopening of adoptions in
Nepal. As we learn more we will promptly update you.

My husband and I are back from our visit with our Nepali lawyer and another
representative. I left with an overall positive outlook on the Nepal adoption
process. Only time will tell if it will finally happen. I will try to list
everything discussed. I know that there are other families on this group that
were at this meeting please feel free to correct or add anything else that I may
have forgotten.

in Kathmandu but one which is located in Chitawan. Chitawan is a 4 hour drive
by car from Kathmandu. If your child comes from Chitawan you will have to
travel there to pick up your child then travel back to Kathmandu.

1. Will there be any adoptions completed before the end of 2009?

Yes, we will complete some adoptions before the end of the year

2. Why is there no minister yet?

The political process in the Nepal has been very unstable. There are 22
political parties in Nepal and PM has to make sure that there is balance between
the parties.

Also one of the major problems is that the MOWCSW is a lesser ministry. It has
no budget, no funding and the position holds no power. It comes with a lot of
work and headaches and basically no one wants the position. However, the PM
will appoint someone if the party in charge does not put someone in. Probably
in a month or two.

3. Once the minister is appointed will the matched dossiers be released?

Yes, once the minister is appointed he will give the secretary the authority to
release the dossiers and approve travel for the families already matched. Also,
those families with dossiers approved but not matched will be given the
opportunity to change the age of the child requested if they wish to do so.
Those families agencies will be contacted and in turn the agency will notify the
families. According to the rep. all you will have to do is submit a new
adoption application with the age change and not submit a new homestudy or
immigration approval. However, for US families a new homestudy with the changes
will have to be submitted to USCIS before you can get your visa to bring the
child home.

4. Are dossiers still being reviewed and matched even with no minister?

Yes, the dossiers are still being reviewed and sent to the matching committee.
Once the match is made with a child, the dossier is sent to the children's home
where the child is and the director has to sign off on the match as well.

5. When will the family be able to travel once the referral is accepted?

Immediately if they wish. We are going to try and group families together for
travel to help with the paperwork. Also, for US families the Embassy may
dictate travel by given visa appointments.

6. How long is the stay in Nepal to complete the adoption?

There will be a few days in which the family will visit the child at the home
before the family can leave with them. Once the family picks up there child it
will take about 7 business days to process the Nepali paper work for the
adoption. The US Embassy paper work and medical evaluation will take about 5
business days.

7. Why only 10 dossiers per year?

When we discussed the new process we thought that we would be able to complete
around 500 dossiers per year.

8. Is it possible for the PM to appoint an individual as the minister that
would be independent from the political process and therefore not affected by
any changes in government?

No, because each political party has their own part of the government (in other
words the party does not want to give up any ministry no matter how great or
small it is)

Se acaba de recibir información de la Embajada de España en India sobre la situación de la adopción en Nepal.

En ella se señala que se ha hecho entrega al primer Ministro Koirala de Nepal de cartas de los tres Primeros Ministros de España, Italia y Francia para agilizar los casos de adopción pendientes.

Según información de la Embajada, han comunicado que el Gobierno nepalí no contempla aprobar la nueva legislación de adopción en un futuro inmediato, pero si resolver los casos pendientes antes de Navidades, previo análisis de los expedientes uno por uno y de acuerdo con la actual legislación. Se hará cargo del tema el Ministro de Justicia ,ahora encargado también de la cartera de la Mujer y la Infancia

Katmandú: El comité de la adopción internacional en el Ministerio de la Mujer, el Niño y Bienestar Social se reunió ayer por primera vez desde la larga espera. De acuerdo a informes de la reunión decidió celebrar reuniones periódicas aproximadamente tres veces a la semana para aclarar los casos pendientes en línea. La comisión también decidió escribir a los CDOs que no habían enviado los expedientes que se les pidió, ya que los pidió el gabinete para examinarlos. En tercer lugar se han decidido a emitir decretos de aprobación de los cinco casos antiguos que ya había sido examinado y aprobados por la anterior reunión de la comisión celebrada antes del parón de las adopciones. Estos cinco casos también han sido objeto de revisión a pesar de que había sido revisados y aprobados por el comité.

Kathmandu: The international adoption committe at the Ministry of Women Children and Social Welfare met yesterday for the first time since the long hold. according to reports the meeting decided to hold regular meetings aprosimately three times a week to clear the pending cases on line. the committe also decided to write to the CDO who has not yet send the files back asking them to do so since the cabinet announced to review the recomendations sent back to the CDO. Thirdly they have decided to issue adoption decrees to the five old cases which had already been reviewed and finalised by the earlier committe meeting held before the hold on adoptions. These five cases had also come under hold though it had been reviewed and passed by the committe than.

Kathmandu: The Ministry of Women Children and Social Welfare's
adoption committe has reviewed files upto 2250, of which files without
errors are ready to be forwared to the Secretary for his approval
signatures. Files forwarded, without errors, up to 2170 has been
recently signed by the Secretary. MOWSC team are working hard to
complete the pending cases as soon as possible in the coming weeks.
According to officials at Ministry they are also working on the new
rules and said would work more extensively towards it after the
completion of the pending adoption files.

El comité ha revisado hasta el expediente 2.250, de los cuales los sin errores, están listos para ser enviados al Secretario para su firma. De los expedientes ya enviados, sin errores, y hasta el 2.170, han sido recientemente firmados por el Secretario. El equipo del Mowcs está trabajando duramente para completar los expedientes aún pendientes en las próximas semanas. De acuerdo con funcionarios del Ministerio, también se está trabajando en la nueva normativa y se trabajará aún más intensamente una vez se acabe con los expedientes pendientes.

Según fuente del Ministerio, obtuve la información que los números hasta el 2.198 quedaron firmados ayer por la tarde por parte de Neupane. Están revisando expedientes hasta el 2.235 y seguramente estarán listos en una semana, el próximo lunes o martes. El comité empezó a revisar expedientes hasta el 2.260. Esta duración en el tiempo se debe al hecho de que los 5 miembros ya no se reunen juntos porque sus agendas no les permiten reunirse juntos a menudo. Cada miembro de la comisión viene al Ministerio cuando su agenda se lo permite, y algunos tienen más tiempo o hacen un estudio más rápido de cada expediente.

From a source in the Ministry, I got the information that filesnumbers up to 2.198 got yesterday evening the final signature by M.Neupane. Files numbers up to 2.235 are under review, and supposed to be finaliseafter one week, next monday or tuesday. Files numbers up to 2.260 start to be reviewed by the committee. This extension in the time comes from the fact the 5 members do notmeet together anymore, as their agendas didn't match to meet often alltogether. Each member of the commission comes to the Ministry when hisagenda allowed to do so, and some of them have more time, or a fasterstudy of each file.

Adoption to open with New Rules

Kathmandu: According to information the new Adoption
Rules is scheduled to be tabled in the coming cabinet
meeting. The highlights of the new rules are- adoption
application will have to come through agencies or
embassies of the respective country, Central authority
matching of child and the family, fees will be set up,
agencies needs to get approval from Nepal government
and one trip for all. According to information the new
rules also includes to do application according to the old
rules for those files that has been filed at the Chief
District Offices dated before the files returned to the
CDOs from the Ministry. The files were returned to the
CDOs in May 2007 when Mr. Bishwokarma Khadga was
the Minister than. He belonged to the Maoist party.

It seems Minister Ms. Pampha Bhusal wants to bring in
the new rules before her adoption monitoring trip.
Recently six teams have been formed to visit different
countries for the annual monitoring of the Nepalese
children adopted abroad. Ms. Bhusal will be leading a
team to Spain and Germany.

Ms. Bhusal also belongs to the Maoist party who has
emerged as the biggest winning party in the recent
constitution assembly polls in Nepal. Ms. Bhusal also won
in the recent election from Lalitpur constitunecy 3
Kathmandu Valley.

Likewise the pending 442 international cases have almost
been completed by the Ministry of Women Children and
Social Welfare. There are thirteen cases pending most of
which have either document error or the children are
reallocated. The cases will be completed after the
officials and authorities return from the monitoring trip.
